By applying the model of the «regulatory pyramid», a conceptual framework developed by Richard Devlin and Adam Dodek in their book «Regulating Judges – Beyond Independence and Accountability» (2016), this study assesses the position of Swiss judges and courts.
The regulatory pyramid has become a standard model for comparing jurisdiction systems around the world. Devlin and Dodek’s approach goes beyond the traditional focus of independence and accountability and provides a broad overview of how a judiciary functions.
