Swiss Justice in Comparison

An Outline of the Swiss Judicial System According to the Approach by Devlin and Dodek

Inhalt

What are the operating principles of the jurisdiction of Switzerland? By applying the model of the «regulatory pyramid», a conceptual framework developed by Richard Devlin and Adam Dodek in their book «Regulating Judges – Beyond Independence and Accountability» (2016), this study assesses the position of Swiss judges and courts. The regulatory pyramid has become a standard model for comparing jurisdiction systems around the world. Devlin and Dodek’s approach goes beyond the traditional focus of independence and accountability and provides a broad overview of how a judiciary functions.
