Untersuchung einer rechtsgeschäftsdogmatischen Rechtfertigung der an Kenntnis bei Vertragsschluss anknüpfenden Ausschlusstatbestände im Gewährleistungsrecht anhand der §§ 442 Abs. 1 S. 1, 536b S. 1 BGB

'The Legal Transaction Doctrine Pertaining to the Knowledge of Defect at the Time of Contract Conclusion. An Analysis of the Legal Transaction Doctrine and its Rationale for the Exceptions to Warranty Law Based on Knowledge at the Time of Contract Conclusion, as Stipulated in Sections 442(1) 1 and 536b 1 of the German Civil Code': The majority of legal scholarship currently rejects the justification of the warranty exclusions of Secs. 442(1) 1, 536b 1 of the German Civil Code based on transactional intent. This study analyses the requirements and legal consequences that may be derived from the legal transaction doctrine for the examined sections. Overall, the legal transaction doctrine proves to be convincing, given its stronger normative foundation and greater tangibility compared to other legal approaches.
