A Contribution to the History of Doctrine in Tort Law': The state of legal disorder that exists in the dogma of tort law is examined in a longitudinal study of the history of dogma to determine its origins. To this end, the present work focuses on the basic concepts of tort law. The origins of the difference hypothesis are examined and its transferability to contemporary tort law is critically questioned. The long-contested concept of damages is traced back to its conceptual and dogmatic core.
