La redacción de este libro empezó hace dos años y medio; su contenido está centrado en el análisis del debate proteccionismo versus el libre comercio. Al presentarse la crisis derivada del covid-19 el estudio de sus efectos fue incorporado a la investigación, por lo que el análisis inicial quedó circunscrito en un extenso capítulo (4) y en los demás se analizan las consecuencias de la crisis en la economía nacional y cómo la enfrentó el gobierno federal. Se revisa también la manera en la que la economía estadunidense afrontó la crisis, así como las diferentes posturas a favor y en contra de los paquetes de estímulo fiscal y monetario instrumentados y sus consecuencias para la economía nacional.

The book focuses on online platforms as the out-of-state regulators of social and economic issues. The analysis embraces regulatory schemes created by platforms and the interrelation between them and the state's supervision and enforcement. The volume consists of three parts: first, the foundational issues of private regulation in the entire platform economy or in its substantial parts; second, the cross-sectoral questions of platforms' private regulation, such as the enforcement of rules created by platforms under EU contract law, and the 'internal' vs. 'external' enforcement of platform regulatory frameworks; and third the judicial, doctrinal and policy discourses addressing the enforcement of the rules created by platforms in selected EU Member States. The authors seek to provide a broad outline of overlapping issues in the platforms' self-regulation and the various responses adopted in various jurisdictions.

Access to civil justice continues to be undermined by State retrenchment of legal aid budgets, increases in procedural costs, the complexity of court procedures, and severe delays in the dispensation of justice. This has resulted in a shift from public to private funding of civil litigation, and the emergence of new business models and forms of private justice. The book explores the dynamic landscape of legal costs and financing from 3 perspectives: regulatory frameworks in public and private funding; new trends and challenges in contemporary legal financing; and the transformative potential of alternative dispute resolution (ADR) and online dispute resolution (ODR) procedures to streamline civil justice processes and expand access to justice. European Union and its Neighbours in a Globalized World

Alternative Dispute Resolution (ADR) is increasingly recognized as an attractive alternative to national court proceedings, especially in international business relations. This open access book focuses on ADR mechanisms in one specific geographical region: the Western Balkans. This region comprises Albania, Bosnia and Herzegovina, Croatia, North Macedonia, Montenegro, Kosovo, and Serbia. Although these countries generally have legal frameworks for ADR mechanisms in place, they remain largely underutilised in practice. Promoting ADR mechanisms in the countries of the Western Balkans could make them more attractive to foreign investors, thereby fostering economic growth. Additionally, the effective implementation of ADR mechanisms could have spill-over effects on national judiciaries, thereby increasing domestic rule of law standards. This would be highly beneficial for the Western Balkan countries, most of which are still aspiring to become Member States of the European Union (EU). To achieve this, they are required to promote the use of ADR mechanisms and align their legal frameworks with EU standards.Against this background, this book aims to explore the trends and challenges of ADR in the Western Balkans. The different chapters primarily focus on international commercial arbitration, investment treaty arbitration, and mediation. Some chapters address systemic challenges, such as capacity building and dispute prevention, which extend to the entire region. Others offer country-specific analyses of particular national framework. While some chapters adopt the perspective of international or EU law, others remain at the national level. Collectively, the wide diversity in topics and perspectives provides a comprehensive overview of the trends and challenges of ADR mechanisms in the Western Balkan.
