</p><p>The book deals in redress for mass harm in modern legal orders on both sides of the Atlantic. The US have created class actions. Europe prefers a mix of public and private tools for redress of mass harm including collective redress or representative actions. Managerial judges, entrepreneurial lawyers, contingency fees, absence of cost shifting rules in the US and notice pleadings are examined. Lack of managerial judging and traditional prohibition of entrepreneurial lawyering in many nations in the EU is discussed. Contingency fees (pacta de quota litis) are not yet generally accepted in the EU collective redress where cost-shifting rules (the loser pays principle) are applied. The fundamentally different approach between the US and Europe suggests that EU collective redress does not have the same significance as the US class action thus making copy-pasting of US experience in class action very questionable.</p><p></p>

In this volume, the authors address the often invoked crisis of the rule of law. Requirements, challenges, and the significance of the concept of the rule of law are illustrated from a comparative German, Turkish and Japanese perspective on the basis of civil procedure.</p>

The book explores the institution of the insurance ombudsman – an alternative dispute resolution service outside of the court dedicated to resolving complaints filed by customers against insurers and insurance intermediaries. The ombudsman scheme constitutes a significant element of every insurance market, as it contributes to enhancing consumer protection and increasing trust in the insurance industry. Despite these valuable functions, not all jurisdictions provide insurance consumers with easy and effective access to ombudsman services.

In the interest of promoting good market practices, this book provides an in-depth discussion on the role and workings of insurance ombudsman services in Europe. The book may serve as a source of inspiration for both established ombudsman institutions when rethinking their structure, and for emerging markets when considering the introduction of ombudsman schemes. The main body consists of reports on insurance ombudsman schemes in ten representative European jurisdictions, based on a detailed, uniform questionnaire.

Written by experts from academia and representatives of insurance ombudsman offices, the book will benefit ombudsman officers, regulators, supervisors, practitioners, academics, students and, more generally, all those involved with or interested in insurance, dispute resolution and consumer protection.</p>

<p>The book focuses on the new Chinese Civil Code. It will be a great promotion of the Chinese Civil Code and enhance its understanding at the international level. It will also promote the understanding of Chinese law in the context of the One Belt One Road Initiative.&nbsp;</p>

<p>Since the Chinese Civil Code came into force in 2021, it is still at an early stage of comparing Australian contract law and contract law principles in the Chinese Civil Code. To date, there are few systematic studies on the comparison of contract law in Australia and in China. The existing literature on the comparison is much more based on the old Chinese contract law of 1999. In addition, the existing literature on Australian contract law generally lacks a comparative dimension, particularly with China. The standard Australian contract law books and articles contain little reference to what similar problems might be conceived of or dealt with in a civil law jurisdiction like China. In the case of the Chinese Civil Code, although there are useful works on its legislative provisions, theories and doctrines, the contents of those works may not be readily comprehensible by an Australian lawyer or scholar unless set in a comparable context. This book seeks to fill this gap in the existing literature.</p>

<p>This book will also provide a comparison and analysis of Chinese and Australian contract law to show international legal scholars and practitioners not only the judicial interpretation and application of contract law rules in China but also the scholastic understandings of and approaches to the comparison of it with a common law jurisdiction, such as Australia. Another aim of the book is to lay a foundation to commence a long-term project to comprehensively compare selected areas and topics in Australian contract law and Chinese contract law, such as damages.</p>

Deconstructing the Interdisciplinary Study of International Law and International Relations

The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.
