Audience behavior began to shift dramatically in the mid 1990s. Since then, people have become more spontaneous in purchasing tickets and increasingly prefer selecting specific programs to attend rather than buying a subscription series. Arts attenders also expect more responsive customer service than ever before. Because of these and other factors, many audience development strategies that sustained nonprofit arts organizations in the past are no longer dependable and performing arts marketers face many new challenges in their efforts to build and retain their audiences. &lt;p&gt;Im Jahr 1998 unterzeichnen 42 Staaten die Washingtoner Prinzipien. Es werden "gerechte und faire Lösungen" gefordert und dazu die Schaffung "innerstaatlicher Verfahren zur Umsetzung dieser Richtlinien" als notwendig ausgemacht. In Deutschland, Österreich, den Niederlanden, Frankreich und dem Vereinigten Königreich wurden entsprechende Verfahren eingerichtet. Die Studie vergleicht die fünf Verfahren umfassend aus funktional rechtsvergleichender Perspektive und entwickelt aus einer anschließenden Kontextualisierung und Evaluierung im Lichte der Washingtoner Prinzipien 13 konkrete Verfahrensbausteine eines Idealverfahrens. Diese sind als Beitrag zum öffentlichen Diskurs, aber auch als Angebot an die Praxis zur Schaffung neuer oder zur Stärkung bestehender Kommissionen zu verstehen. &lt;/p&gt;

Bausteine eines Verfahrens im Sinne der Washingtoner Prinzipien

Gerecht und fair?

&lt;p&gt;Frankreich war 1998 einer der 44 Signatarstaaten der Washingtoner Erklärung. Die Frage, ob die Republik ihren Verpflichtungen aus dieser Erklärung nachgekommen ist, wird im Rahmen dieser Arbeit unter Auswertung der umfangreichen Fallpraxis näher beleuchtet. Im Unterschied zu anderen Staaten existieren in Frankreich mehrere rechtliche Instrumente und Verfahren zur Restitution von NS-Raubkunst: Neben heute noch geltenden Gesetzen aus der direkten Nachkriegszeit wurden nach 1998 weitere Regelungen – 2023 zuletzt ein Restitutionsgesetz – geschaffen, die erstmals einer systematischen Darstellung und kritischen Analyse unter rechtsvergleichenden Gesichtspunkten unterzogen werden. Dieser Band liefert auf diese Weise auch wichtige Orientierungspunkte für die Restitutionsdebatte in Deutschland und anderen Staaten.&lt;/p&gt;
