Judging Poverty and Inequality in Brazil offers an unprecedented empirical analysis of the judicialisation of poverty in Brazil. Anchored in the Brazilian context - a postcolonial society where structural and intersectional discrimination continues to correlate with poverty today - the book explores the complex relationship between poverty and inequality, enriching critical debates on how law can more effectively respond to material deprivation and social exclusion. Its analysis centres on the case law of two prominent courts with jurisdiction over the Brazilian State: the Brazilian Federal Supreme Court (STF) and the Inter-American Court of Human Rights (IACtHR). The book unfolds in two parts. Part I examines the theoretical interconnections between poverty and inequality, drawing on law, sociology, and political science. Part II turns to the Brazilian experience. It tracks the evolution of poverty from the promulgation of the 1988 Constitution, which marked the start of a new constitutional era in the country after more than two decades of military dictatorship, to 2023. It then analyses how the STF and the IACtHR have addressed poverty and inequality in their case law, assessing the impact of these decisions on poverty reduction and its intersectional manifestations in Brazil. Historically, employment law was defined in terms of its autonomy from general private law. This achievement of autonomy was highly prized, and considered necessary to facilitate industrial freedoms for trade unions and the protection of employees from exploitation. But the contractual basis of employment means that any such autonomy has always been partial and unstable. Furthermore, as trade unions have declined and governments have deregulated statutory employment rights, private law has assumed growing practical importance in strategic appellate litigation. In many common law jurisdictions, private law doctrines have become the new battleground between employers, workers and trade unions. The essays in this book examine specific doctrinal issues against this dynamic backdrop of changing social, economic and constitutional conditions. A silent revolution is underway in India today. Starting in 2020, twelve states have rolled out unconditional cash transfers to nearly 118 million women. While the media disparages these transfers as 'freebies', Wages for Housework: India's Experiment with Unconditional Cash Transfers to Women offers the first book-length study of these transfers, using social reproduction feminism, particularly the wages for housework campaign, to theorize unconditional cash transfers as providing economic recognition of women's unpaid domestic and care work. Against the backdrop of a low female labour force participation rate, a residual welfare regime, and an entrenched culture of gendered familialism wherein women are presumed responsible for care, the book addresses arguments for and against unconditional cash transfers in feminist economics and welfare theory. In doing so, it recollects the vision of the founding mothers of the Indian Constitution who advocated for the recognition of women's unpaid work. It traces how Indian courts have, since Independence, treated women's unpaid domestic and care work as being on par with an occupation to hold that the economic recognition of unpaid work is a step towards the constitutional vision of equality and dignity. Through an in-depth study of unconditional cash transfers in three states, namely, Goa, Assam, and West Bengal (implemented in 2013, 2020, and 2021, respectively), Kotiswaran elaborates on state-specific welfare regimes and analyses the implementation of cash transfers through interviews with bureaucrats, academics, feminist activists, and women beneficiaries to understand if and how they have resulted in women's empowerment, whether in terms of education, paid employment, or the gendered division of labour. In conclusion, the work posits that unconditional cash transfers represent an unprecedented and welcome expansion of the Indian welfare regime and to be truly gender transformative, they need to be embedded in a broader feminist agenda for care.
