The Little Book of Restorative Justice in Schools

This book discusses contemporary standards of legal safeguards in the area of bulk electronic surveillance from the perspective of the European legal model. Bulk, or untargeted, surveillance, although traditionally associated with the interception of electronic communications, is increasingly used as a convenient tool for collecting information on large groups of society. The collection of redundant information, which is intrinsic to bulk surveillance, is no longer a side effect but an important objective of the use of bulk powers. As a result, untargeted surveillance is everywhere increasingly being implemented, and without any clear link to state security or crime-fighting objectives. This work examines the origins of untargeted measures, explores their mechanics and key concepts, and defines what distinguishes them from other forms of surveillance. The various elements of the legal safeguards in place, which are fundamental to protecting individuals from the risks of abuse of power, are analysed in detail. The book discusses not only the different standards of legal safeguards, but also gives examples of their implementation in individual European countries. It also examines the relationship between the development of the global data market and untargeted surveillance powers, in particular in the context of the risks associated with algorithmic surveillance, client-side scanning, the privatisation of surveillance - or surveillance as a service - and the increasingly widespread use of preventive content filtering mechanisms. The book will be a valuable resource for academics and researchers working in the areas of law, international relations, public policy, engineering and sociology. A Comparative Perspective

Bulk Surveillance, Democracy and Human Rights Law in Europe

Political systems across much of the West are now subject to populist disruption, which often takes an anti-Constitutional form. This interdisciplinary book argues that the current analysis of anti-Constitutional populism, while often astute, is focused far too narrowly. It is held here that due to an obscured complex of dynamics that has shaped the history of the West since its inception and which remains active today, we do not understand the present. This complex not only explains the current disruptions across the fields of contemporary religion, politics, economics and emerging artificial intelligence but also how these disruptions derive each from originary sources. This work thereby explains not only the manner in which this complex has functioned across historical time but also why it is that its inherent, unresolvable flaws have triggered the shifts between these key fields as well as the intractability of these present disruptions. It is this flawed complex of factors that has led to current conflicts about abortion reform, political populism, the failure of neoliberalism and the imminent quantum shift in generative artificial intelligence. It is argued that in this, law is heavily implicated, especially at the constitutional level. Presenting a forensic examination of the root causes of all these disruptions, the study provides a toolbox of ideas with which to confront these challenges. Patrick Tschech develops a methodology for the advancement of EU secondary law based on a consistent integration of legal theory, linguistic theory, and European law doctrine. To this end, he first designs-drawing on the Pure Theory of Law-a theoretical model that describes the process of law-making and law realization within a specific legal order. On this basis, he analyses the EU legal order and defines the role of the Court of Justice of the European Union in relation to other branches of power.
 

 To reflect this functional distribution, it is also useful in the context of secondary law to apply the distinction, familiar in German legal methodology, between interpretation and legal development. However, for reasons related to linguistic theory, this distinction cannot be based on the possible literal meaning. Instead, Tschech proposes a separate criterion aligned with the Court's function and explains why interpretation and legal development are in fact distinct methods rather than merely different stages within a single process of legal reasoning.
 

 Building on this, he develops a theory of legal gaps that enables the Court to fulfil its role in ensuring the coherence of EU law without unilaterally extending its scope of regulation at the expense of the Member States.
