The Little Book of Restorative Justice in Schools

Dans cet essai, l'auteur propose une analyse lucide et engagée des fondements de l'entrepreneuriat africain, en plaçant les petites et moyennes entreprises (PME) au cœur des stratégies de développement du continent. Véritables piliers des économies africaines, les PME contribuent massivement à la création d'emplois, à l'innovation locale et à la résilience sociale, tout en demeurant confrontées à des obstacles structurels persistants. L'essai démontre que les politiques de promotion de l'entrepreneuriat, longtemps construites selon une logique institutionnelle descendante, peinent à produire des effets durables. Trop souvent, les entrepreneurs sont perçus comme de simples bénéficiaires de dispositifs d'aide, alors qu'ils devraient être reconnus comme des acteurs centraux et des co-concepteurs des stratégies publiques. Cette marginalisation freine l'autonomie entrepreneuriale et limite l'impact réel des politiques de soutien. S'appuyant sur une analyse rigoureuse des réalités économiques africaines, l'auteur met en lumière les spécificités juridiques, sociales et culturelles des PME, souvent ignorées par des cadres normatifs importés et inadaptés. Il plaide pour une refondation des politiques de promotion, fondée sur l'éducation entrepreneuriale, l'appropriation d'une idéologie de croissance adaptée aux contextes locaux et la mise en place d'un environnement juridique sécurisé. L'essai insiste également sur l'importance de l'accompagnement post-création et du renforcement des structures d'incubation, afin de permettre aux entrepreneurs de surmonter les difficultés liées à la mise en œuvre de leurs projets. En définitive, cet essai invite décideurs publics, entrepreneurs et partenaires au développement à repenser en profondeur les politiques de promotion de l'entrepreneuriat africain, afin d'en faire un véritable moteur de transformation durable, d'innovation et de croissance inclusive au service du continent.

Governments around the world are privatizing everything, with dramatic but largely ignored negative consequences for human rights. This open access book outlines the response that is urgently needed. Corporations are being given control over water, healthcare, housing, public transportation, child welfare services, aged care, and much else. Privatization is promoted by international financial institutions, consulting firms, and development actors as the answer to public finances devastated by the very tax cuts insistently pushed by these groups. Their pitch is based upon a mythology that extols the virtues of an idealized market while ignoring the heavy human rights costs incurred. Building on the latest evidence and on specially commissioned case studies, this book shows how the touted 'efficiency' of the private sector is often predicated on higher charges and/or reduced services, destructive employment practices, and the highly predictable exclusion of many users. Privatization generally costs states more money, marginalizes democratic decision-making, and transforms citizens from rights-holders into customers while sidelining accountability. The authors develop an approach designed to enable human rights actors, including courts, UN treaty monitoring bodies, and NGOs to move beyond their longstanding agnosticism towards privatization. It starts with a presumption that privatization is inherently retrogressive in human rights terms. Whatever mix of public and private is reflected in any given arrangement, governments must retain the degree of control necessary to ensure respect for rights, and the legal, financial and administrative ability to do so. The book charts a new direction for responding to the ever-growing threat that privatization poses to human rights. Current Issues in Corrections explores a variety of the most timely and salient challenges facing the correctional system today. The text is comprised of chapters written by experts in the field who have experience as both academic and criminal justice practitioners.

The book begins with an exploration of issues in private corrections and then moves forward to discuss the rights of individuals in correctional institutions and under community supervision, the Criminal Justice Reform Act of 2018, jails and immigration, the role of drug courts in reducing recidivism, institutional programming, inmate reentry, educational trajectories of post-incarcerated youth, and more. The text concludes by considering the future of capital punishment. Each chapter includes opening questions, key terms, and discussion questions to stimulate reflection and critical thinking.

For the second edition, updates have been made throughout the chapters to reflect the most current information and statistics. The lack of a social scientific foundation across the field of negligence means that social life and scientific knowledge are transformed and mutated by a negligence paradigm that is unable to fulfil the social purposes typically attributed to it. Analysing the extent to which the reparation ideal has polluted and confused attempts to find radical alternatives to negligence, this book argues for a critical separation between the issue of harm minimisation and reparation; a separation that, it is argued, provides the basis for a different policy approach to the human experience of injury, error and misfortune.

Beyond the Negligence Paradigm offers a novel engagement with key problems and failings which have long been identified with the operation of the negligence system.
