This book, as a monograph devoted to the concept of right, takes as its vantage point the historical transformation of human society from agricultural civilization to commercial–industrial civilization. It traces the formation and evolution of the concept of right, analyzes the strengths and weaknesses of the right‑related thought of three major Western jurisprudential traditions and their representative figures, repudiates the intellectual constraints that existing Western notions of right have imposed upon the Chinese legal academy, and develops a theoretical system of right supported by such core concepts as the constitution of right, the ontological foundation of right, the bearer of right, the function of right, and the semantic transformation of right.

Ius Gentium: Comparative Perspectives on Law and Justice

The contemporary significance of the subject “Social Rights, Inequalities and Affirmative Action” is indisputable. In periods of social polarization, conflict and crisis, it is imperative that the obligation of our societies to protect and promote social rights is addressed and acknowledged. It is also necessary to recognize the way in which social rights are jeopardized by inequalities that impede the cultivation of robust social relationships and to document instances of the implementation of affirmative actions in this scenario. The aims of this work are as follows: firstly, to establish general topics (part I); secondly, to undertake more specific investigations within the primary topic (part II); and thirdly, to address the challenges posed by the technological transition currently taking place in society, which has significant consequences for social rights, (in)equality, and affirmative action (part III). The study is organized into three sections corresponding to these targets. For the purposes of this study, the analysis will commence, in the Part I of this book, at the genesis of the debates, as outlined in the chapter concerning the old and the new forms of racism. This contribution is followed by a chapter on the growing recognition of intersectional discrimination in European and global human rights frameworks and by another on structural discrimination and the function of the law against unjust enrichment. To further explore and expand upon the subjects addressed in the preceding chapters, the final chapter of Part I of this book delves into the topic of affirmative action in the United States. The second part of this work is dedicated primarily to specific forms of affirmative action, thereby deepening the discussion initiated in the first part of this book. The initial topic examines the way in which the pandemic has impacted specific social groups and led to the emergence of health disparities in the UK. The subsequent chapter is devoted to an examination of the alterations in the benefits of minimum income support in Brazil in recent years. The fourth chapter undertakes a detailed investigation of a specific affirmative action program for children and adolescents with the objective of reducing violence in urban areas. The final chapter conducts an analysis of ageing, public policies and inclusion in Brazil. The third and final section is dedicated to an examination of the challenges faced by our technological societies. The field of “Social Rights, Inequalities and Affirmative Action” is set to be impacted by the regulation of artificial intelligence, the increasing digitalization of activities, and the development of new tools designed to enhance the efficiency of the social state. The initial chapter of the concluding section deals with the regulation of artificial intelligence in Brazil and the impacts of neurotechnology. The second study examines conservative digitalization and structural inequalities in Latin American information societies, while the final study focuses on the emergence of the social digital state and the use of instruments that produce inequality and discrimination.

Provisional Measures in Investor-State Arbitration and China's Legal Practice

This book offers a comprehensive reconstruction of proportionality in constitutional law, tracing its trajectory from its origins in Prussian administrative law and German constitutional adjudication to its contemporary application across diverse legal systems. Against the conventional approaches that equate proportionality with the weighing of competing values, it argues that this test was originally conceived as a dogmatic instrument for the protection of rights, not as a balancing technique. Through a detailed comparative analysis of the German and Brazilian experiences, the book reconstructs how proportionality gradually shifted from a strict limit on state power to an open formula of judicial discretion, and proposes a coherent model to restore its normative function. The book critically re-examines the philosophical and theoretical assumptions that transformed proportionality into an indeterminate balancing exercise and reconstructs it as a structured dogmatic test defined by constitutional parameters of protection. Engaging with authors such as Robert Alexy, Bernhard Schlink and Ralf Poscher, it maps how proportionality became the dominant method of constitutional adjudication and how that dominance produced both methodological uncertainty and jurisprudential uniformity. Finally, it proposes a theoretical framework that distinguishes proportionality in the singular, as a general abstraction, from proportionalities in the plural, calibrated to the specificities of each right, context and mode of judicial review. This plural and context-sensitive approach restores the analytical precision that contemporary constitutional law often lacks. By combining historical analysis, comparative dogmatics and legal theory, the study contributes to current debates on the legitimacy and limits of judicial review, the boundaries of fundamental rights and the crisis of constitutional interpretation in modern democracies.

European Union and its Neighbours in a Globalized World

This book provides an in-depth and timely analysis of a relevant and controversial issue: the relationship between European Union values and international law. It examines whether and to what extent the EU succeeds in influencing international law by upholding and promoting its values (listed in Article 2 of the Treaty on European Union) globally, as explicitly provided for in Article 3(5) and in Article 21 of the Treaty on European Union, through its international agreements. In particular, the book focuses on the free trade agreements concluded by the Union with States and other regional organisations. The reason for this choice is based on the assumption that this is the area where the EU can make the most effective use of its soft power, which derives from its commercial strength and namely from the attractiveness of the access to its internal market. What makes this volume unique is its approach to the topic, tracing the historical and philosophical foundations of European values, both from a historical perspective and through comparative legal analysis. This solid foundation enables the reader to gain an in-depth understanding of the values that the Union seeks to promote in the wider world. Thus, the analysis looks at how selected core values—such as democracy and the rule of law, peace and security, human rights and minority protection, sustainable development, data protection, dispute settlement, and respect for international law—are incorporated and promoted through EU free trade agreements. It investigates both the impact of individual agreements on the domestic legal orders of partner States and the cumulative effect of EU FTAs on the broader development of international law, questioning whether they contribute to shaping a rules-based multilateral order aligned with EU normative commitment. This reflection is particularly relevant and necessary in today's international context, which is marked by crises that challenge the very notion of a global order based on common principles and values.This book offers a valuable resource for practitioners and academics, particularly those interested in international law, EU law, international trade law, as well as history of law, constitutional law, comparative law and international relations. China (the Mainland of PRC) trades with other states in trillions of USD every year, and about 95% of the cargoes are carried by ocean-going ships calling at hundreds of Chinese ports each singe day. Due to the enormous trade volume and shipping activities, foreign ships, companies and professionals are often caught in the Chinese maritime law and court.
