How Reasoning Shapes Legal Reality

Law as Philosophy

Das auf mehrere Bande angelegte Werk prasentiert nahezu das gesamte deutsche Verfassungsrecht des Zeitraumes zwischen 1806 und 1918. Hiermit wird der sich gleichsam schrittweise vollziehende Ubergang von einem traditionell standischen oder gar furstlich-absolutistischen zu einem zumeist monarchisch-konstitutionellen System aufgearbeitet, dessen jaher Untergang schlielich in die nationalstaatlich-republikanisch gepragte demokratisch-parlamentarische Staatsform Weimars mundet. Mit dem Gesamtwerk steht dem Fachpublikum eine leicht zugangliche, bislang nicht gekannte Fulle von Dokumenten zur Verfugung, die fur die verfassungsrechtliche Entwicklung Deutschlands und seiner einzelnen Staaten von zentraler Bedeutung waren. Dabei wird groer Wert auf die authentische, d. h. buchstaben- und zeichengetreue Ubernahme der Texte gelegt. Dem jeweiligen Dokumententeil sind in jedem Band "Historische Einfuhrungen" vorangestellt. In diesem Rahmen werden an den einschlagigen Dokumenten orientierte (verfassungs-) rechtliche, zeitlich wie territorial ubergreifende entwicklungsgeschichtliche Darstellungen vorgenommen. In dem hier vorliegenden 3. Band werden erstmals uber 450 Verfassungsdokumente prasentiert, welche fur die verfassungsstaatliche Entwicklung des Groherzogtums Berg und des Herzogtums Braunschweig pragend waren. Begleitet wird diese Textedition durch eine ausfuhrliche historische Einfuhrung.

Deutsches Verfassungsrecht 1806 - 1918

This book gives extraordinary new insights into the legal, political and industrial strife in the UK of the early 1970s, focusing on the National Industrial Relations Court and how its independence came to be injured at a time of national crisis. Constitutional and employment lawyers, and indeed anyone interested in the history of the times, will not want to be without this deeply researched yet entertaining work. When the Heath Government came to power in 1970, it set up the National Industrial Relations Court to referee highly contentious disputes between unions and employers. Regarded with hostility by the labour movement from the start, the Court and its President, Sir John Donaldson, faced mounting suspicion, and were regularly front-page news. When Donaldson jailed five dockers in 1972 - the Pentonville Five - for defying the Court's orders, strikes erupted and the docks closed. With the country's food supplies dwindling, a state of emergency loomed. How had it come to this? Could a way through be found? This is a revelatory account of the National Industrial Relations Court's defining crisis, set in the context of a wider, and frequently startling, exposition of how Donaldson went about his role as its President. Peter Oldham KC combines decades of experience as a barrister with archival research to shine a bright new light on how and why the Court found itself doing - in Donaldson's own words - 'rather peculiar things'.

Mit der Entdeckung der Veroneser Handschrift der Institutionen des Gaius 1816 wurde das wohl wichtigste selbständig überlieferte Zeugnis des römischen Rechts der klassischen Zeit zu einem Forschungsgegenstand ersten Ranges. Friedrich Carl von Savigny, der den Fund vorbereitet hatte, unterzog den Text einer tiefgehenden Analyse und hielt exegetische Vorlesungen, in denen er das Werk des römischen Juristen insgesamt und dessen einzelne Lehrsätze interpretierte. So eröffnete die Verbindung von Forschung und Lehre noch vor dem Erscheinen des Textes im Druck den Blick auf dessen Wahrnehmung durch den prominentesten Juristen seiner Zeit. In 38 Londres Street, Philippe Sands blends personal memoir, historical detective work and gripping courtroom drama to probe a secret double story of mass murder, one that reveals a shocking thread that links the horrors of the 1940s with those of our own times. The house at 38 Londres Street is home to the legacies of two men whose personal stories span continents, nationalities and decades of atrocity: Augusto Pinochet, President of Chile, and Walther Rauff, a Nazi SS officer responsible for the use of gas vans. On the run from justice at the end of the Second World War, Rauff crosses the ocean to southern Chile. He settles in Punta Arenas, Patagonia, managing a king crab cannery at the end of the world. In Late Antiquity, private individuals could acquire land or other assets through acts of the emperor or the administration. These often originated from confiscations, e.g. of estates without heirs (
 bona vacantia
 , 
 caduca
 ), the property of convicted criminals (
 bona damnatorum
 ), or ownerless slaves (
 vaga mancipia
 ). Since the 
 fiscus
 was often unable to make economically effective use of these assets, and the emperor was under political pressure to reward influential individuals, they were frequently transferred - sometimes for payment, but often free of charge. In this context, a procedure developed whereby beneficiaries could petition for an imperial grant by means of a 
 petitio
 .
 

 By analysing Late Antique imperial constitutions, the study examines this procedure, as well as the private-law status of the recipients. The analysis shows that they generally acquired ownership - even where the assets had not belonged to the 
 fiscus
 . As Roman law in principle did not allow acquisition in good faith from a non-owner, this form of acquisition is best understood as one effected by sovereign act.
 

 At the same time, it becomes clear that Late Antique emperors established nuanced and carefully considered rules and sought to achieve a fair balance of interests. A decline in legal culture, as suggested by the theory of so-called Late Antique vulgar law, cannot be observed.
