Die Rufe nach einem umfassenden Arbeitnehmerdatenschutz sind mit den jüngsten Datenschutzskandalen in deutschen Konzernen wieder lauter geworden. Ein eigenes Arbeitnehmerdatenschutzgesetz lässt aber weiter auf sich warten. Auch die geltenden Regelungen lassen den Arbeitnehmer jedoch nicht schutzlos. Der Schwerpunkt des Praxishandbuches liegt daher in der Darstellung des Datenschutzes im Arbeitsverhältnis und seiner praktischen Umsetzung. The book explores the links between fundamental rights and cultural identity in the European legal order especially in the case law of the European Court of Human Rights. The book analyses the issues surrounding the relationship between cultural diversity and fundamental rights with special emphasis on cultural rights and their protection in the European legal order. The book addresses general fundamental rights questions such as universality and cultural relativism and the principles of equality and non-discrimination. Secondly, several cases are discussed in which human rights were invoked to protect cultural interests of minorities in the European Court of Human Rights. Individual and collective dimensions of fundamental rights are also taken into consideration. Also, the book explores the cases were human rights are invoked in order to protect individual from cultural practices which are considered harmful or against public order, public morals, public healthor the rights of others.
The book provides a comprehensive overview of the case law of the ECHR on issues related to cultural identity and proposes a human rights framework for the management of cultural diversity in multi-cultural societies based on the case law of the European Court of Human Rights.

Since the Chinese Civil Code came into force in 2021, it is still at an early stage of comparing Australian contract law and contract law principles in the Chinese Civil Code. To date, there are few systematic studies on the comparison of contract law in Australia and in China. The existing literature on the comparison is much more based on the old Chinese contract law of 1999. In addition, the existing literature on Australian contract law generally lacks a comparative dimension, particularly with China. The standard Australian contract law books and articles contain little reference to what similar problems might be conceived of or dealt with in a civil law jurisdiction like China. In the case of the Chinese Civil Code, although there are useful works on its legislative provisions, theories and doctrines, the contents of those works may not be readily comprehensible by an Australian lawyer or scholar unless set in a comparable context. This book seeks to fill this gap in the existing literature.

This book will also provide a comparison and analysis of Chinese and Australian contract law to show international legal scholars and practitioners not only the judicial interpretation and application of contract law rules in China but also the scholastic understandings of and approaches to the comparison of it with a common law jurisdiction, such as Australia. Das vorliegende Open-Access-Buch widmet sich einer besonderen Behörde: den sogenannten gemeinsamen Einrichtungen, in denen die Bundesagentur für Arbeit und die Kommunen die Aufgaben des SGB II in einer gemeinsamen Organisation wahrnehmen. Es handelt sich somit um den im deutschen Bundesstaat seltenen Typus einer Mischverwaltung. Hieraus entsteht ein komplexes Steuerungsmodell, das trotz gewisser zentraler Vorgaben erhebliche lokale Handlungsspielräume eröffnet. Jonas Hafner untersucht die Aufbau- und Ablauforganisation von Jobcentern, mit Fokus auf das beschäftigungsorientierte Fallmanagement und die Arbeitgeberbetreuung. Ausgehend vom Soziologischen Neoinstitutionalismus und dem Situativen Ansatz wird der Frage nachgegangen, inwieweit sich die Verwaltungsorganisation der gemeinsamen Einrichtungen voneinander unterscheidet und welche Faktoren Variationen verursachen. Mit einem Mixed-Methods-Design, bestehend aus einer bundesweiten quantitativen Befragung sowie qualitativen Interviews mit Mitarbeitenden von Jobcentern, zeigt die Studie zwei zentrale Befunde: Während bestimmte Organisationsmerkmale verbreitet sind, offenbart sich jenseits grundlegender Strukturen eine große Vielfalt. Erklärungen bieten situative Faktoren, insbesondere die Organisationsgröße, sowie institutionelle Logiken, die von den Akteuren des Handlungsfeldes geteilt werden.
