This book presents a critical and philosophical analysis of Islamic law (Sharia), focusing on its legal structure. The work argues that Islamic jurisprudence should be understood as a human interpretive endeavour, shaped by its historical and social contexts rather than as a fixed divine code. 
The book is organised into two chapters and a conclusion:Chapter One presents the foundational perspectives on Islamic law, examining both traditional and rational approaches and clarifies their practical implications.
Chapter Two offers a critical reassessment of the traditional concept of Islamic law, arguing that it no longer adequately addresses the complexities and challenges of the modern world.
The conclusion synthesises the key findings and proposes a new interpretive framework for understanding and applying Islamic law in today's context.

This open access book offers an in-depth understanding of the challenges, dilemmas and strategies of reinstating the rule of law after the dismantling of a constitutional order. Drawing on the case of Poland's democratic transition back to the rule of law, the volume explores the uncharted territory of restoring independent institutions within an EU Member State. After eight years of autocratic interference with the judiciary, media and state institutions, the Parliamentary elections of October 2023 mark a turning point for Poland. The new government now faces the complex challenge of restoring the rule of law, with European and international law playing a pivotal role. Still, at numerous crossroads a dilemma comes up: Can the rule of law be disregarded to restore it? Or must the rule of law be adhered to at the risk of legal and institutional paralysis? This book presents strategies for solving this dilemma in theory and practice, thereby paving the way for other states' transitions to come. Through a comparative and interdisciplinary approach, including historical and contextual analysis, the authors show that restoring the rule of law is more than just a legal challenge. This volume equips academics and policymakers with conceptual tools and practical guidance to address the pressing issue of reinstating the rule of law, both in Poland and beyond. Jaimie Morse traces how this assemblage was championed as a rights project in medicine, moving from the margins to the center of health care responses to sexual violence through new clinical standards of care, first in the United States and then in global humanitarian medicine. Drawing on archival research, interviews with experts and activists, and fieldwork at international meetings, the book chronicles a novel process of legal mobilization in medicine and interrogates the existential meanings and stakes of rape kits, their associated practices, and their underlying assumptions and expectations for survivors of sexual violence.

Heimat gibt sich uns dabei so selbstverständlich, dass wir ihrer paradoxerweise erst im Modus der Abwesenheit, des Verlustes und Entzuges gegenwärtig werden.
Den Menschen kennzeichnet ein spannungsvoller Grundbezug zum Heimatlichen: weil ihn sowohl das Bedürfnis nach Heimischsein als auch ein ebenso elementares Unterwegssein und der Aufbruch und Exodus aus dem Gewohnten hinaus in die Fremde charakterisieren. Heimat grenzt und schirmt sich gegen das un-heim-liche Fremde ab. Zugleich sind Heimat und Fremde konstitutiv aufeinander bezogen: Das und der Fremde erweisen sich letztlich sogar als Lehrer des Eigenen.

Anna Irene Baka challenges dominant liberal and legalist paradigms in international law by reinterpreting the right of peoples to self-determination through the lenses of Aristotelian philosophy, phenomenology, social psychology, and corrective justice.
Focusing on high-profile postcolonial conflicts in Kosovo, Cyprus, and Palestine, Baka argues that abstract international and constitutional legal doctrines on self-determination fail to account for the lived realities of collective deprivation and historical trauma. Baka offers a compelling critique not only of mainstream theories of self-determination, but also of the shortcomings of critical movements such as Critical Legal Studies. In their place, she advances a renewed ethical and conceptual framework for international law-one grounded in responsibility, rational judgment, and moral engagement.
