Globalization and digitalization, together with the growing urgency of global challenges, are reshaping the boundaries of law. Democracies face mounting pressure as crucial decisions are increasingly taken outside of national procedures. Using Switzerland as a case study, Charlotte Sieber-Gasser demonstrates how these dynamics alter the balance of power among the legislative, executive, and judicial branches, while simultaneously eroding the mechanisms of direct democratic participation. Her analysis integrates empirical legal data with normative and legal-theoretical reflection, focusing in particular on public economic law, processes of Europeanization, and the constitutional significance of intergenerational justice. The study delivers a precise diagnosis of the institutional challenges and sketches pathways toward an internationalized democracy capable of safeguarding legitimacy, the rule of law, and social cohesion.

Four hundred years ago, Hugo Grotius's work 
 De jure belli ac pacis libri tres
 presented a description of the mutual legal relationship of peoples and states, which is rightly regarded as a milestone in the history of international law. The question of a just war and all subsequent questions are the starting point for this draft of a comprehensive legal system that claims validity without being based on legislation. For centuries, this work by Grotius was a key reference text at universities. This is the first time that a Latin-German edition of Grotius's major work has been published. The extensive sources used by Grotius are documented in a detailed appendix.

De jure belli ac pacis libri tres

Die juristische Methode und ihre Kritik können auf eine lange Geschichte zurückblicken. Einen Meilenstein bildet der sogenannte "Methodenstreit", der um die Frage kreist, was geschieht, wenn in der Rechtspraxis Urteile gefällt werden? Die Antwort lautet: Es entscheiden nicht nur Texte, sondern auch das Rechtsgefühl, da Juristen Menschen sind. Herausforderungen wie Künstliche Intelligenz verdeutlichen die Grenzen mechanistischer Ansätze, da KI keinen Leib hat, keine Gefühle kennt und ihre Entscheidungen oft undurchsichtig bleiben. Angesichts dieser Defizite wird die klassische Methode, soweit sie an den Erfordernissen von Transparenz, Kohärenz, menschlicher Erfahrung und juristischer Überzeugungskraft festhält, auch im Zeitalter der Digitalisierung eine Zukunft haben.

This book offers a critical and original examination of how the doctrine of superior responsibility has been interpreted and applied in international criminal law. It challenges prevailing scholarly approaches by shifting the focus from legal characterization to the doctrine’s conceptual components — an often overlooked but more pressing arena.
At the same time, by tracing the doctrine’s evolution from ancient military theory through religious and medieval legal traditions to its current position in international criminal law, the book interrogates the underlying tension between its nature as a form of vicarious liability and the principle of personal culpability central to criminal law theory — an approach the book critically examines, and perhaps ultimately rejects.
Rather than merely summarizing case law, the book explores how and why international tribunals — particularly the International Criminal Court in the landmark&nbsp;Bemba case — have applied the doctrine inconsistently. It engages with jurisprudence from ad hoc and hybrid tribunals to expose doctrinal ambiguities and recurring misapplications that undermine legal coherence and accountability.
An additional contribution of this work is the development of a syllogistic test for assessing superior responsibility in contexts involving human rights violations and treaty-based offenses. Balancing doctrinal critique with a normative analysis, the book offers a deeper theoretical and practical lens on one of international criminal law’s most debated areas.
Intended for legal scholars, practitioners and graduate students, this book is a valuable resource for anyone seeking a more principled and analytically rigorous understanding of superior responsibility in both historical and contemporary contexts.

Im Zuge der Neuentdeckung der juristischen Grundlagendisziplinen und in der Folge von Diskussionen, die bis in die Feuilletons reichten - Ist der/die Rechtsanwender:in ein "Pianist", der Normen wie ein/eine Künstler:in zu interpretieren hat? -, tritt ihre überragende Bedeutung jedoch wieder hervor.
Das Lehrbuch wendet sich mit zahlreichen Beispielen an fortgeschrittene Studierende, mit der Darstellung der Querbezüge auch an fertige Jurist:innen, Praktiker:innen wie Theoretiker:innen. Es hat den Anspruch, die Methodenlehre nicht nur als Disziplinierungsinstrument zur Sicherung der Gesetzesbindung, sondern auch als Hilfe und Handwerkszeug zur Analyse der Parteiinteressen, zur leichteren Erschließung unbekannter Rechtstexte sowie zur Auswertung von Gerichtsentscheidungen fruchtbar zu machen. Methodenlehre ist danach im Kern Verständnislehre.
Die das Buch durchziehenden Falllösungshinweise machen die Relevanz der Aussagen für Studium und Prüfung deutlich.

The contributors analyse the dynamic interplay between democracy and law within a Japanese-German comparative framework. Emphasis is placed on the democratic legitimacy of legislation as a prerequisite for societal acceptance and on the role of enacted norms in shaping administrative and judicial practice. The volume examines the structure of the democratic principle, the interaction of public law and private law mechanisms, and their combined relevance for modern democratic systems.
 

 Historical developments, legal-philosophical perspectives, and theoretical foundations are discussed, showing how Germany and Japan, despite distinct cultural and institutional traditions, have incorporated elements of the Anglo-American legal sphere. The symposium builds on earlier joint research initiatives and extends the analysis of legal governance in selected fields of law. Particular attention is given to the comparatively unexplored significance of procedural norm implementation for the functioning of democratic orders. Further chapters address economic, labour, and social regulatory frameworks, the tension between market freedom and social responsibility, and emerging security issues, including those in civil protection law. European and international dimensions of democratic guarantees complement the discussion. Against the backdrop of global political developments, the theme "Democracy and Law" proves its continued relevance for understanding and developing constitutional democracies.
