Globalization and digitalization, together with the growing urgency of global challenges, are reshaping the boundaries of law. Democracies face mounting pressure as crucial decisions are increasingly taken outside of national procedures. Using Switzerland as a case study, Charlotte Sieber-Gasser demonstrates how these dynamics alter the balance of power among the legislative, executive, and judicial branches, while simultaneously eroding the mechanisms of direct democratic participation. Her analysis integrates empirical legal data with normative and legal-theoretical reflection, focusing in particular on public economic law, processes of Europeanization, and the constitutional significance of intergenerational justice. The study delivers a precise diagnosis of the institutional challenges and sketches pathways toward an internationalized democracy capable of safeguarding legitimacy, the rule of law, and social cohesion.
