Die Stellung des Appellate Body im Streitbeilegungsverfahren der Welthandelsorganisation (WTO)

Es werden Entstehung, Zusammensetzung und Verfahrensablauf des Berufungsgremiums systematisch dargestellt sowie dessen Rolle als rechtliche Kontrollinstanz gegenüber den Panelberichten beleuchtet. 
Ein besonderer Fokus liegt auf den Schwächen des aktuellen Systems und dem internationalen Reformbedarf im Rahmen der Doha-Runde. 
Die Arbeit bietet einen fundierten Einblick in die Funktionsweise des WTO-Rechtsmittelverfahrens und liefert wertvolle Impulse für Jurist:innen, die sich mit internationalem Handelsrecht beschäftigen.

Over his half-century career, Thomas Cottier has promoted the development of international trade law by shaping our understanding of how multiple layers of law interact to form a global legal system. While multilateral trade law is the "melody" of the system, it is made fuller by a host of regional and national layers of harmonising - and sometimes discordant - legal rules. Covering both general trade policy and the economic relations between Switzerland and the EU, the chapters examine Thomas Cottier's fundamental belief in the necessity of studying the interaction of every level of governance - local, national, and international - when considering the policies of economic exchange between countries, as well as his cosmopolitan belief in the need to foster a global community dedicated to bettering the lives of individuals around the world. Die Arbeit betrachtet und analysiert umfassend die Rechtsprechung des Europäischen Gerichtshofs zu den internen Rechtswirkungen völkerrechtlicher Normen, die im rechtswissenschaftlichen Schrifttum als dogmatisch bedenklich und politisch motiviert beschrieben wird. Insbesondere werden die vielschichtigen Gründe dafür herausgearbeitet, dass der Gerichtshof vielen völkerrechtlichen Regeln - des Welthandelsrechts, des Seerechts oder des Umweltrechts - gegenüber originärem Unionsrecht nur sehr restriktiv zur Durchsetzung verhilft. Abschließend unternimmt die Arbeit einen Versuch, die Dogmatik des Gerichtshofs fortzuentwickeln, um der breiten Kritik zu begegnen.

Industrial policy, decarbonisation, de-risking of supply chains: the regulation of subsidies is at the forefront of the transformations that the world economy is undergoing. This book provides an overview of the foundations of EU State aid law, one of the most dynamic areas of EU law. An up-to-date and accessible framework explains the core conditions underpinning the notion of State aid - including advantage and selectivity.

The book also looks at how the EU model has changed over the past decade. It helps navigate the complex case law on the application of EU State aid law to tax rulings concluded with large multinationals (such as the Applesaga) as well as the perma-crisis of the regime up until the adoption of the Clean Industrial Deal Framework.

What rules of international law apply to the disintegration of a non-state subject of international law? This question arose against the background of Brexit and its practical effects on international agreements of the EU and its member states. The book first shows that the frequently invoked international treaty law does not provide a suitable basis for discussion to answer this question. An alternative explanatory approach is then analysed: Based on an evaluation of the preliminary work on the Vienna Convention on State Succession in Respect of Treaties, the book justifies an analogy between an EU withdrawal and state separations and argues in favour of treating Brexit as a case of treaty succession.
