Over the past decades a growing number of countries have offered citizenship or residence in return for a donation or investment. Taking a multi-disciplinary approach to the study of this phenomenon, this open access collection examines its legal, political, and conceptual implications. The volume consists of four parts. The first part documents recent trends in investment migration and seeks to understand its implications for our understanding of the concept of citizenship. The second part provides a legal and normative assessment of investment migration, from the perspective of both EU and international law. The third part presents case studies of investment migration practices in countries from around the world, including from jurisdictions that have so far remained under-researched. The fourth part deals with the specific EU legal-political context and also engages with the case launched by the European Commission against Malta. The book assembles the leading experts in the field and offers a rigorous and balanced analysis of this sometimes controversial field. Investment Migration in Europe and the World

Hart Monographs in Transnational and International Law

This book delves into the legal and labour history of the Hashemite Kingdom of Iraq to explore the role international law and its institutions played in Iraq's state formation. Focusing on a turbulent period in global and Middle East history, it shows how the case of Iraq became a laboratory for experimentation with the concept of sovereignty by the Permanent Mandates Commission of the League of Nations in Geneva. This resulted in the development of a doctrine of 'semiperipheral sovereignty' to justify Iraq's independence from the Mandate process. This novel doctrine and its operation within the provisions of the 1930 Anglo- Iraq Treaty ensured the maintenance of British dominance over Iraq, especially to safeguard the extraction and transportation of its valuable oil resources to Western markets. The book traces how this legal doctrine impacted the everyday lives of working class Iraqis. It explores the governance of the extraterritorial spaces of capitalist accumulation and labour exploitation, in particular the Iraq Petroleum Company oil fi elds, the Iraq State Railways and the Port of Basra. It goes on to detail how the oil, railway and port workers led by the Iraqi Communist Party effectively organised themselves into a nationalist revolutionary labour movement. They waged an anti-colonial struggle against these imperial legal structures to improve their lot, leading up to the 1948 Wathba, the 1953 Intifada, and ultimately the July Revolution of 1958, which upended the British-sponsored monarchy. Spanning various international archives and Arabic primary source materials, this book offers an example of a social, legal and labour history written from below, centering ordinary working peoples' agency in the historiography of international law. Drawing on Third World Approaches to International Law (TWAIL) and Marxist methodologies, it emphasises the signifi cance of the semi-periphery in the making of the international legal order.

This book retraces the emergence of conceptions of authorship in late-eighteenth-century Germany by studying the material form of Immanuel Kant's 1785 essay, 'On the Wrongfulness of Reprinting'. Drawing upon book history, media theory, and literary studies, Benjamin Goh analyses the essay's paratexts as indices of literary production in the German Enlightenment. Far from being an idealist proponent of intellectual property, Kant is shown to be a media theorist and practitioner, whose critical negotiation with the evolving print machinery in his time helps illuminate our present struggle with digital technology and the mounting pressures borne by copyright as a proprietary institution. Through its novel perspective on established debates surrounding authorship, this book critiques the proprietary conception of authorship in copyright law, and proposes an ethical alternative that responds to the production, circulation, and reading of literature. The book explains the essential characteristics of Chinese partnership law and Chinese limited partnership, highlighting difficult and developing areas by examining relevant legislation and recent cases. In addition to Chinese authorities, it also covers legislation and cases from overseas jurisdictions, such as the UK and the US. New developments such as the amendments to the PRC Partnership Enterprise Law 2007, new legislation and regulations on foreign partnerships and private equity funds are also covered. This collection reviews Hegel in relation to the key themes of history, politics and philosophy. It shows how Hegel is a historical thinker, whose theories are
developed via a philosophical consideration of historical development at a number of levels. Hegel’s expertise in the history of philosophy leads him to
recognize the distinctiveness of the present, while building upon philosophical predecessors. This perspective sheds light on Hegel’s distinctive reading of the
political, which is both insightful and timely. Hegel’s reading of political economy emerges out of his conception of modernity and remains relevant to contemporary conceptions of civil society.
