Ce Commentaire de la Loi sur la protection de l’environnement (LPE), en deux volumes, reprend le contenu des deux premiers classeurs publiés en 2010 et 2012 et les complète, dans la perspective de présenter une analyse intégrale de cette loi et de ses principales ordonnances d’exécution (OPB, OPair, ORNI, OPAM). Elle inclut le commentaire des articles non traités jusqu’ici, notamment ceux liés aux derniers développements législatifs (économie circulaire, modification du régime de la protection contre le bruit, dispositions pénales), ainsi qu'une mise à jour des articles déjà traités. L’ouvrage est destiné tant aux praticien·nes qu’aux chercheur·ses et enseignant·es en droit de l’environnement. Il fait le point sur la jurisprudence et la doctrine en la matière, que ce soit dans le contexte des principes qui la sous-tendent (prévention, précaution, pollueur-payeur, durabilité, information de la population), ou dans l’analyse des régimes spécifiques de la LPE, tels ceux de la gestion des atteintes et des risques, des déchets ou des sites pollués. À l’heure où plusieurs arrêts de la CEDH évoquent les obligations positives de l’État en matière de protection de l’environnement, une attention soutenue a été accordée à cette jurisprudence.
