        &lt;p&gt;Der EU-Gesetzgeber hat mit der Richtlinie 2041/2022 über angemessene Mindestlöhne in der Europäischen Union die Grenzen der sozialpolitischen Kompetenzen in bisher nicht gekannter Deutlichkeit herausgefordert. Art. 153 Abs. 5 AEUV entzieht dem EU-Gesetzgeber ausdrücklich die Kompetenz für das „Arbeitsentgelt“. Vielfach wird die vor dem EuGH angefochtene (C-19/23) Mindestlohnrichtlinie als kompetenzwidrig angesehen. Vor dem Hintergrund dieses Kompetenzkonfliktes untersucht die Arbeit die Dogmatik der Bereichsausnahme für das „Arbeitsentgelt“ in Art. 153 Abs. 5 AEUV und arbeitet dabei unter anderem deren Entstehungsgeschichte und Zwecke heraus. Die Arbeit zeigt auf, unter welchen Bedingungen eine EU-Mindestlohngesetzgebung kompetenzgemäß ist.&lt;/p&gt;

This transformation has been driven by advancements in technology and the increasing interconnectedness of the global economy. It allows businesses to reach international markets more quickly and efficiently, transcending geographical barriers. The internet, mobile devices, cloud computing, and artificial intelligence have facilitated this digital transformation. These technologies enable seamless communication, data storage and processing, automation, and personalised services, revolutionising how businesses operate and engage in international trade.Digital trade has created new opportunities for businesses of all sizes. Small and medium-sized enterprises have benefited from the ability to access global markets through digital platforms and e-commerce. These platforms provide a means for Small and medium-sized enterprises to connect with potential customers worldwide, establish their presence, and market their products and services without needing a physical presence in foreign markets. This has lowered entry barriers and empowered Small and medium-sized enterprises to participate in global value chains, expanding their reach and contributing to economic growth. One of the notable developments in the digital trade era is the rise of platform-based businesses. These platforms, such as e-commerce marketplaces, ride-sharing services, and online payment systems, act as intermediaries connecting buyers and sellers across borders. They facilitate transactions, provide infrastructure and services, and enable businesses to expand their customer base globally. Platforms have become influential players in international trade, shaping market dynamics and redefining traditional trading system.

Rules on Digital Trade in the Light of World Trade Organization Agreements

&lt;p&gt;&lt;em&gt;Mental Health, Crime and Justice&lt;/em&gt; brings together original and state of the art contributions from theoretical, empirical, and policy-related scholarship concerned with the ways people with mental health illnesses are understood, ‘managed’, ‘controlled’ and responded to. Drawing on critical scholarship from a variety of disciplines, the collection pays careful attention to the controversial relationship between mental health and crime, as well as key issues relating to justice and social harm. It presents a synthesis of discipline-specific approaches, from law, psychiatry, sociology, and criminology, but will also bridge together developments in both theory and practice.&lt;/p&gt;

&lt;p&gt;The book explores the relationship between mental health and crime by deconstructing and analysing two important facets of the justice system: (1) the various ways in which people with mental disorder navigate and are navigated through the criminal justice (and forensic mental health) system(s); and (2) how so called ‘problematised populations’ are governed, with a particular emphasis on mental health as an unfolding dimension of social harm.&lt;/p&gt;

&lt;p&gt;Unique to this volume, well-rehearsed debates are cross-examined with contemporary critiques about social harm and justice. By considering the multifaceted dimensions of violence to include ‘gendered’, ‘structural’, and ‘systemic’, this book provides a nuanced insight that exposes the controversial relationship that is said to exist between mental health and crime. The collection seeks to highlight the harm and injustice that people with mental health disorders are subject to when interacting with the criminal justice system.&lt;/p&gt;

Academic Paper from the year 2024 in the subject Law - European and International Law, Intellectual Properties, grade: 28/30, Bocconi University, course: European and International Advanced IP Law, language: English, abstract: This paper aims to explore the interplay between trademark law and the often-elusive concept of bad faith against the backdrop of protecting the Champagne Geographical Indication by examining the case of CIVC and INAO v. Keep Waddling International Pte. Ltd. [2020] SGIPOS 10 and its implications within trademark and GI jurisprudence. 

The unique reputation of champagne is guaranteed by the protection afforded by the Champagne GI, a type of intellectual property right primarily cited in the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), ensuring that the label champagne can only be used for sparkling wines produced from certain grape varieties grown in the eponymous region in France. Protecting the appellation of origin reassures the consumer product authenticity and the strict restraints on the words use by the CIVC and INAO is motivated by the anticipation of the term and therefore the product of champagne becoming arbitrary and universal with unlimited use. 

The degree of similarity of terms and the therefore resulting likelihood of confusion for the consumer plays an essential role in deciding whether signs for products manufactured outside the Champagne region can be granted legal protection or not. In the case considered, the inclusion of "ChamPeng" in the Applicant’s trademark led to the refusal of its protection, not because the trademark would not meet the necessary registration requirements, but because its similarity to the champagne term gave inference for bad faith. Since the case’s dispute does not arise from a false claim or deceptive information, it particularly diverges from traditionally established bad faith categories. Therefore, the following question arises: How does the case contribute to the conduct of protection of GIs in trademark law?

The examination of the aforementioned issue will involve a comprehensive review of the case under consideration. Initially, the legal foundations and the Applicant's claims that prompted the legal proceedings will be outlined to establish the legal basis of the case. Subsequently, attention will be directed towards presenting the counterpart’s position, providing insights into the potential resolution of the dispute afterwards. Finally, the Court's ultimate decision will be scrutinized to discern its potential impact on enhancing the broader legal framework and in its challenging of conventional boundaries within trademark jurisprudence.

Doctoral Thesis / Dissertation from the year 2018 in the subject Economics - Case Scenarios, , language: English, abstract: Publicly Owned Enterprises (POEs) in Kosovo are present largely in the market, with a focus on sectors such as electricity, railways, telecommunications, waste management, etc. This presence is followed by the constant need for subsidies from the government and weak financial and commercial performance. POEs in Kosovo are faced with numerous challenges including weak governance and management. Agency Theory is used widely as a tool with which to explain governance and functioning of organisations and companies. In addition, Agency Theory is used to explore relations between stakeholders in politics and the economy. This study first elaborates upon the applicability of Principal–Agent Theory in POEs in Kosovo and then identifies the presence of principal–agent problems and identifies the nexus between such problems and poor performance of POEs. Identification of principal–agent problems may help to identify the reason for poor performance of POEs and the lack of transparency, accountability and supervision. POEs are subsidised by the state on an annual basis, which makes the identification of problems in having profitable POEs important for public interests, too. Such importance is due not only to the fact that POEs are financed by taxpayers but also to the fact that they are supposed to provide services in public interests by being self-sustainable and profitable for the government as a shareholder. The study aims to conclude that principal–agent problems such as capture, rent-seeking, moral hazard, information asymmetry and adverse selection are present in POEs in Kosovo, and that they have a negative impact on their performance. Such principal–agent problems and their negative performance may also be influenced by gaps in legislation and weak law enforcement.

Principal-Agent Problems in Public Enterprises in Kosovo

&lt;p&gt;This is the first socio-legal multi-jurisdictional study on hazing (ragging). This book considers four countries: the USA, India, Sri Lanka, and Australia. It states the legal position, identifies lacunas in law, and proposes possible legal solutions. Unfortunately, laws, regulations, and policies have failed to stamp out hazing from university campuses and residential colleges.&lt;/p&gt;&lt;p&gt;Hazing has spiralled out of control in a number of countries. It has descended into a cruel, barbaric, and inhuman practice. The number of students subjected to hazing and sexual abuse is alarming. According to a 2022 survey, more than half (53%) of American students who were part of a fraternity or sorority experienced hazing. Students are murdered, harmed, abused, and suffer long-term trauma. The prevention of hazing is one of the most important responsibilities of 21st century universities.&lt;/p&gt;&lt;p&gt;The theme of the book is that universities are in the best position to protect students from hazing and must play a vital role. As a sociological study, the book also considers why hazing occurs and what can be done to prevent it. Without engaging with the underlying causes, legal punitive measures continue to address the symptom rather than the cause. The book, therefore, explores how a more innovative approach to regulation can help tackle the cause.&lt;/p&gt;&lt;p&gt;The book will be of interest to policy makers, regulators at universities, education and legal academics, and personal injury lawyers.&lt;/p&gt;&lt;p&gt;&lt;/p&gt;

Hazing (Ragging) at Universities: A Legal Perspective

Academic Paper from the year 2021 in the subject Law - Civil Action / Lawsuit Law, grade: 5.0, University of Lagos (Law), course: Law, language: English, abstract: This paper sets out to analyze the application of good and bad character evidence to criminal proceedings within the corpus of the Evidence Act, 2011. The term "character" has been defined by several legal writers and Judges for the purpose of determining its scope in the light of the law of evidence. The general consensus from the several definitions is that “character” is the general reputation as opposed to his disposition. Under the Nigerian Evidence Act 2011, the same definition was given pursuant to section 77 which defines the expression “character” to mean reputation as distinguished from disposition. It goes on to state that except as mentioned in sections 78 to 82, evidence may be given only of the general reputation, and not of the particular acts by which reputation or disposition is shown.Unlike in civil proceedings, the Evidence Act creates a distinction between bad and good character for the purpose of determining the admissibility of character evidence in criminal proceedings.

Das Lehrbuch zur juristischen Argumentationstheorie stellt die Modelle juristischen Argumentierens vor und unterzieht sie einer (kritischen) Würdigung. Das betrifft etwa die Argumentationsanalyse seitens der „Strukturierenden Rechtslehre“ und das sogenannte „pragma-dialektische“ Modell der Argumentation. Explizit warnt der Band vor einem postmodernen Irrationalismus, der die Regelorientierung juristischen Argumentierens grundsätzlich in Zweifel zieht. Zeitgleich hat Österreich als einziger europäischer Staat ein eigenes Kunstrückgabegesetz verabschiedet, auf dessen Grundlage der Kunstrückgabebeirat eine umfassende Empfehlungspraxis entwickelt hat. Auch in Deutschland werden die Stimmen nach einer gesetzlichen Lösung lauter. Der Praxis des Kunstrückgabebeirats wird dabei oftmals eine Vorbildfunktion zugeschrieben. Doch stellt sie tatsächlich die geforderte „gerechte und faire Lösung“ dar?
