Academic Paper from the year 2024 in the subject Law - European and International Law, Intellectual Properties, grade: 28/30, Bocconi University, course: European and International Advanced IP Law, language: English, abstract: This paper aims to explore the interplay between trademark law and the often-elusive concept of bad faith against the backdrop of protecting the Champagne Geographical Indication by examining the case of CIVC and INAO v. Keep Waddling International Pte. Ltd. [2020] SGIPOS 10 and its implications within trademark and GI jurisprudence. 

The unique reputation of champagne is guaranteed by the protection afforded by the Champagne GI, a type of intellectual property right primarily cited in the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), ensuring that the label champagne can only be used for sparkling wines produced from certain grape varieties grown in the eponymous region in France. Protecting the appellation of origin reassures the consumer product authenticity and the strict restraints on the words use by the CIVC and INAO is motivated by the anticipation of the term and therefore the product of champagne becoming arbitrary and universal with unlimited use. 

The degree of similarity of terms and the therefore resulting likelihood of confusion for the consumer plays an essential role in deciding whether signs for products manufactured outside the Champagne region can be granted legal protection or not. In the case considered, the inclusion of "ChamPeng" in the Applicant’s trademark led to the refusal of its protection, not because the trademark would not meet the necessary registration requirements, but because its similarity to the champagne term gave inference for bad faith. Since the case’s dispute does not arise from a false claim or deceptive information, it particularly diverges from traditionally established bad faith categories. Therefore, the following question arises: How does the case contribute to the conduct of protection of GIs in trademark law?

The examination of the aforementioned issue will involve a comprehensive review of the case under consideration. Initially, the legal foundations and the Applicant's claims that prompted the legal proceedings will be outlined to establish the legal basis of the case. Subsequently, attention will be directed towards presenting the counterpart’s position, providing insights into the potential resolution of the dispute afterwards. Finally, the Court's ultimate decision will be scrutinized to discern its potential impact on enhancing the broader legal framework and in its challenging of conventional boundaries within trademark jurisprudence.

Protecting Champagne as a Geographical Indication. The ChamPengWine Case

&lt;p&gt;&lt;i&gt;Societal Stress and Law&lt;/i&gt; draws attention to the social side effects of law by developing the sociological concept of society-level stress, a corollary of the concept of individual-level stress in the biological sciences.&amp;nbsp;To encourage interest in societal stress, the book looks at (1) instances of law adopted by American states that the U.S. Supreme Court held unconstitutional and (2) actions by American states with regard to a proposal to amend the federal Constitution.&amp;nbsp;The Court rulings and the proposed constitutional amendment were capable of producing societal stress because they were seen by a sizeable segment of the U.S. public as being incompatible with significant American traditions.&amp;nbsp;In original studies that apply logistic regression to state-level statistical data, the book identifies sociological variables that predict state differences in the adoption of this law and state differences in actions on the proposed constitutional amendment.&amp;nbsp;Because these variables represent societal agents that affected whether a state experienced social stress from the rulings and proposal, the book blends theory with empirical research and illustrates how each can support the other in law-focused scholarship.&lt;/p&gt;

Data - a term that is no longer unknown in today's age. Rather, they seem to be everywhere, data is collected everywhere in our everyday lives. From the supermarket around the corner to banks to doctor's visits, data is collected everywhere. With the help of new information technology, smartphones, wearables such as watches and other sensors, data collection is being given a whole new reach. Data is collected from the user everywhere and at all times. What is happening around us, where are we going, what time of day are we out and about, who or what are we spending our time with, all this is data that is collected in real time and then analysed. The business with this data is also no longer unknown. Big names like Google, Facebook and Amazon are common. To give a clue to the entire idea: Google is said to have about two trillion users a year. Facebook can boast 2.91 billion users in the third quarter of 2021 and Amazon has 548 million active customer accounts so far this year.

It regulates various details of our everyday life, often without us noticing it. We act in the role of a consumer, take advantage of our guarantee for a product or buy a device and thereby conclude a contract of sales. However, we go through all these steps without even being aware of the legal background of our actions. Having this in mind, naturally not every country has the same rules and laws when it comes to regulating life within their borders. That is why, in the following we are going to take Germany, France and Spain as an example to explain different topics that have an impact on every citizen in those countries. To be more precise, the next sections will give a detailed insight into the topics of contract law and breach of contract.

Part B begins with the origins of the right to repair movement and its significance. Part C discusses restrictions on repair rights, including the role of IPRs. Part D discusses how the EU legal framework recognises repair rights and contrasts this with the Australian approach. Part E discusses the suggestions of scholars on reforms to the EU legal framework to better tackle restrictions on repair rights.Modern electronics constitute not only the hardware in the device itself but also the embedded software that is critical to the device’s functionality. This software is usually pre-installed on the device by the manufacturer to run all its basic operations. This integration of software systems to devices, sometimes called the "softening of hardware",  requires the intervention of intellectual property rights (IPRs) to delineate the blurry lines separating the device and its functional components in software.  Consequently, manufacturers use IPRs on the embedded software to limit the consumer’s control over a device and effectively lock them out from doing basic repairs to restore functionality. These limitations discourage many consumers from pursuing repairs in favour of purchasing new devices and discarding the faulty ones. The result is a linear model of consumption and a throw away culture contributing to large amounts of electronics waste (e-waste) disposed worldwide.  In 2019, consumer electronics comprised 54 million Metric Tons of e-waste, with Europe contributing 12 million Metric Tons.  Worse still, the effects of e-waste pileups have for decades flowed downstream from developed to developing countries. In response, the European Union (EU) has focused on achieving a circular economy to reduce e-waste by extending the lifespan and usability of products through, inter alia, recognising the right to repair movement.
