Lastly, the Court's decisions is assessed. In cases C-466/98, C-467/98, C-468/98, C-469/98, C-471/98, C-472/98, C-475/98 and C-476/9,8 delivered on November 5, 2002, also referred to as the “Open Skies” cases, the Commission took Austria, Belgium, Denmark, Finland, Germany, Luxembourg and Sweden to the European Court of Justice due to their concluded “Open Skies” agreements with the US, as well as the UK due to its Bermuda II agreement with the US.

        &lt;p&gt;Der EU-Gesetzgeber hat mit der Richtlinie 2041/2022 über angemessene Mindestlöhne in der Europäischen Union die Grenzen der sozialpolitischen Kompetenzen in bisher nicht gekannter Deutlichkeit herausgefordert. Art. 153 Abs. 5 AEUV entzieht dem EU-Gesetzgeber ausdrücklich die Kompetenz für das „Arbeitsentgelt“. Vielfach wird die vor dem EuGH angefochtene (C-19/23) Mindestlohnrichtlinie als kompetenzwidrig angesehen. Vor dem Hintergrund dieses Kompetenzkonfliktes untersucht die Arbeit die Dogmatik der Bereichsausnahme für das „Arbeitsentgelt“ in Art. 153 Abs. 5 AEUV und arbeitet dabei unter anderem deren Entstehungsgeschichte und Zwecke heraus. Die Arbeit zeigt auf, unter welchen Bedingungen eine EU-Mindestlohngesetzgebung kompetenzgemäß ist.&lt;/p&gt;

In the Maltese scenario this system is regulated under Chapter 318 of the Laws of Malta. Social security benefits are important in society as they support residents and vulnerable groups from becoming financially deprived.  Yet, I personally feel that more monitoring needs to be adopted in order to ensure that such benefits are really going to people who need them rather than to those who do not. The government spends a lot of money in this area and residents contribute to be entitled for certain benefits, so it is important to ensure that the right people are receiving these benefits.

&lt;p&gt;&lt;i&gt;Societal Stress and Law&lt;/i&gt; draws attention to the social side effects of law by developing the sociological concept of society-level stress, a corollary of the concept of individual-level stress in the biological sciences.&amp;nbsp;To encourage interest in societal stress, the book looks at (1) instances of law adopted by American states that the U.S. Supreme Court held unconstitutional and (2) actions by American states with regard to a proposal to amend the federal Constitution.&amp;nbsp;The Court rulings and the proposed constitutional amendment were capable of producing societal stress because they were seen by a sizeable segment of the U.S. public as being incompatible with significant American traditions.&amp;nbsp;In original studies that apply logistic regression to state-level statistical data, the book identifies sociological variables that predict state differences in the adoption of this law and state differences in actions on the proposed constitutional amendment.&amp;nbsp;Because these variables represent societal agents that affected whether a state experienced social stress from the rulings and proposal, the book blends theory with empirical research and illustrates how each can support the other in law-focused scholarship.&lt;/p&gt;

&lt;p&gt;Die Washingtoner Prinzipien von 1998 rufen zu „gerechten und fairen Lösungen“ im Umgang mit NS-Raubkunst auf. Zeitgleich hat Österreich als einziger europäischer Staat ein eigenes Kunstrückgabegesetz verabschiedet, auf dessen Grundlage der Kunstrückgabebeirat eine umfassende Empfehlungspraxis entwickelt hat. Auch in Deutschland werden die Stimmen nach einer gesetzlichen Lösung lauter. Der Praxis des Kunstrückgabebeirats wird dabei oftmals eine Vorbildfunktion zugeschrieben. Doch stellt sie tatsächlich die geforderte „gerechte und faire Lösung“ dar? Distinguished Professor Osipitan SAN differentiated the two in the following words: “Competence deals with the status of a witness to testify in court proceedings while Compellability deals with the powers of the court to force/compel a competent witness to attend court proceedings purposely to testify or tender (a) document(s)”. It follows that for a person to be compellable to testify in court, he must first qualify as a competent witness.

&lt;p&gt;&lt;b&gt;Explores the burgeoning menstrual advocacy movement and analyzes how law should evolve to take menstruation into account.&lt;/b&gt;&lt;br&gt;&lt;br&gt;Approximately half the population menstruates for a large portion of their lives, but the law is mostly silent about the topic. Until recently, most people would have said that periods are private matters not to be discussed in public. But the last few years have seen a new willingness among advocates and allies of all ages to speak openly about periods. Slowly around the globe, people are recognizing the basic fundamental human right to address menstruation in a safe and affordable way, free of stigma, shame, or barriers to access.&lt;br&gt;&lt;br&gt;&lt;i&gt;Menstruation Matters&lt;/i&gt; explores the role of law in this movement. It asks what the law currently says about menstruation (spoiler alert: not much) and provides a roadmap for legal reform that can move society closer to a world where no one is held back or disadvantaged by menstruation. Bridget J. Crawford and Emily Gold Waldman examine these issues in a wide range of contexts, from schools to workplaces to prisons to tax policies and more. Ultimately, they seek to transform both law and society so that menstruation is no longer an obstacle to full participation in all aspects of public and private life.&lt;/p&gt;

Challenging the Law's Silence on Periods

Research Paper (postgraduate) from the year 2023 in the subject Law - European and International Law, Intellectual Properties, grade: 72, University of Kent, course: Contemporary Topics in IP Law, language: English, abstract: This Paper argues that the EU needs to adopt a harmonised policy framework promoting the right to repair and limiting manufacturers’ use of IPRs on software to restrict repair rights which ultimately impacts the achievement of sustainability goals. Part B begins with the origins of the right to repair movement and its significance. Part C discusses restrictions on repair rights, including the role of IPRs. Part D discusses how the EU legal framework recognises repair rights and contrasts this with the Australian approach. Part E discusses the suggestions of scholars on reforms to the EU legal framework to better tackle restrictions on repair rights.Modern electronics constitute not only the hardware in the device itself but also the embedded software that is critical to the device’s functionality. This software is usually pre-installed on the device by the manufacturer to run all its basic operations. This integration of software systems to devices, sometimes called the "softening of hardware",  requires the intervention of intellectual property rights (IPRs) to delineate the blurry lines separating the device and its functional components in software.  Consequently, manufacturers use IPRs on the embedded software to limit the consumer’s control over a device and effectively lock them out from doing basic repairs to restore functionality. These limitations discourage many consumers from pursuing repairs in favour of purchasing new devices and discarding the faulty ones. The result is a linear model of consumption and a throw away culture contributing to large amounts of electronics waste (e-waste) disposed worldwide.  In 2019, consumer electronics comprised 54 million Metric Tons of e-waste, with Europe contributing 12 million Metric Tons.  Worse still, the effects of e-waste pileups have for decades flowed downstream from developed to developing countries. In response, the European Union (EU) has focused on achieving a circular economy to reduce e-waste by extending the lifespan and usability of products through, inter alia, recognising the right to repair movement.

Restrictions on the Right to Repair under IP Law. Impacts on Achievement of Sustainability Goals

Doctoral Thesis / Dissertation from the year 2018 in the subject Economics - Case Scenarios, , language: English, abstract: Publicly Owned Enterprises (POEs) in Kosovo are present largely in the market, with a focus on sectors such as electricity, railways, telecommunications, waste management, etc. This presence is followed by the constant need for subsidies from the government and weak financial and commercial performance. POEs in Kosovo are faced with numerous challenges including weak governance and management. Agency Theory is used widely as a tool with which to explain governance and functioning of organisations and companies. In addition, Agency Theory is used to explore relations between stakeholders in politics and the economy. This study first elaborates upon the applicability of Principal–Agent Theory in POEs in Kosovo and then identifies the presence of principal–agent problems and identifies the nexus between such problems and poor performance of POEs. Identification of principal–agent problems may help to identify the reason for poor performance of POEs and the lack of transparency, accountability and supervision. POEs are subsidised by the state on an annual basis, which makes the identification of problems in having profitable POEs important for public interests, too. Such importance is due not only to the fact that POEs are financed by taxpayers but also to the fact that they are supposed to provide services in public interests by being self-sustainable and profitable for the government as a shareholder. The study aims to conclude that principal–agent problems such as capture, rent-seeking, moral hazard, information asymmetry and adverse selection are present in POEs in Kosovo, and that they have a negative impact on their performance. Such principal–agent problems and their negative performance may also be influenced by gaps in legislation and weak law enforcement.
