50 Years of The Waitangi Tribunal

Doctoral Thesis / Dissertation from the year 2018 in the subject Economics - Case Scenarios, , language: English, abstract: Publicly Owned Enterprises (POEs) in Kosovo are present largely in the market, with a focus on sectors such as electricity, railways, telecommunications, waste management, etc. This presence is followed by the constant need for subsidies from the government and weak financial and commercial performance. POEs in Kosovo are faced with numerous challenges including weak governance and management. Agency Theory is used widely as a tool with which to explain governance and functioning of organisations and companies. In addition, Agency Theory is used to explore relations between stakeholders in politics and the economy. This study first elaborates upon the applicability of Principal–Agent Theory in POEs in Kosovo and then identifies the presence of principal–agent problems and identifies the nexus between such problems and poor performance of POEs. Identification of principal–agent problems may help to identify the reason for poor performance of POEs and the lack of transparency, accountability and supervision. POEs are subsidised by the state on an annual basis, which makes the identification of problems in having profitable POEs important for public interests, too. Such importance is due not only to the fact that POEs are financed by taxpayers but also to the fact that they are supposed to provide services in public interests by being self-sustainable and profitable for the government as a shareholder. The study aims to conclude that principal–agent problems such as capture, rent-seeking, moral hazard, information asymmetry and adverse selection are present in POEs in Kosovo, and that they have a negative impact on their performance. Such principal–agent problems and their negative performance may also be influenced by gaps in legislation and weak law enforcement.

“Badfellas” takes the reader behind the scenes to reveal what it is like to be a trial lawyer in justice’s great arena, the courts of America.  Mr. Roth writes from the vantage point of an attorney who had been a prosecutor, defense attorney and civil litigant for more than 40 years.  His “badfellas” include drug traffickers, organized criminals, terrorists, murders, a pimp, a pedophile priest, and a TV talk show villain.  He chooses 7 of his most intriguing cases and trials to tell his compelling story:
•	“The Smuggler and the Terrorist Prince”:  The prosecution of America’s most wanted drug smuggler who became a hostage aboard an airliner hijacked by Pakistani terrorists.
•	“Welcome to Palermo”: The prosecution of the first Sicilian Connection heroin importation case, where the top echelon of an entire international smuggling operation was dismantled in coordinated trials in New York and Italy.
•	“The Charity That Wasn’t”:  The trial of a gang of incorrigible criminals and murderers which used a charity as a front for their drug organization.
•	“Hush Money”:  A lawsuit involving a pedophile priest and the Catholic’s Church’s unsuccessful attempts to conceal the clergyman’s crimes.
•	“The Mouth That Roared”:  The defense of a popular television personality who was charged with assaulting a gay rights activist on his show. 
•	“Tony Montana and the Bird Dog”:  The defense of an Atlantic City pimp accused of laundering money for a 25-year-old crack kingpin who fancied  himself the “Tony Montana” of Queens.
•	“The Bad Side of Mansfield”:  A DEA Agent who faced the travails of a modern-day Job, all orchestrated by a rogue drug informant whose deceitful conduct turned the criminal justice system upside down.

This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. &lt;i&gt;Gender, Power and Restorative Justice&lt;/i&gt; expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses.

&lt;p&gt;This is the first socio-legal multi-jurisdictional study on hazing (ragging). This book considers four countries: the USA, India, Sri Lanka, and Australia. It states the legal position, identifies lacunas in law, and proposes possible legal solutions. Unfortunately, laws, regulations, and policies have failed to stamp out hazing from university campuses and residential colleges.&lt;/p&gt;&lt;p&gt;Hazing has spiralled out of control in a number of countries. It has descended into a cruel, barbaric, and inhuman practice. The number of students subjected to hazing and sexual abuse is alarming. According to a 2022 survey, more than half (53%) of American students who were part of a fraternity or sorority experienced hazing. Students are murdered, harmed, abused, and suffer long-term trauma. The prevention of hazing is one of the most important responsibilities of 21st century universities.&lt;/p&gt;&lt;p&gt;The theme of the book is that universities are in the best position to protect students from hazing and must play a vital role. As a sociological study, the book also considers why hazing occurs and what can be done to prevent it. Without engaging with the underlying causes, legal punitive measures continue to address the symptom rather than the cause. The book, therefore, explores how a more innovative approach to regulation can help tackle the cause.&lt;/p&gt;&lt;p&gt;The book will be of interest to policy makers, regulators at universities, education and legal academics, and personal injury lawyers.&lt;/p&gt;&lt;p&gt;&lt;/p&gt;

Hazing (Ragging) at Universities: A Legal Perspective

E-commerce brings with it many pros and cons. In addition, it significantly affects agreements between the various players of competition law. This research paper seeks to analyse the impact of e-commerce on vertical agreements, particularly, selective distribution agreements. Vertical agreements are agreements which are entered into by undertakings or firms which operate at different levels of the market. Selective distribution systems are a type of vertical agreement within which a supplier sells goods or services to distributors who are obliged to sell these goods or services based on specific criteria. Throughout this paper, the repercussions of e-commerce which are experienced by manufacturers, distributors and consumers will be examined in order to determine the role and effect of e-commerce on selective distribution systems. There will also be critical examination of the rules governing vertical agreements in the European Union and an assessment of their appropriateness and applicability. The pertinency of the aforementioned rules will be discussed and recommendations will be made accordingly.Both primary and secondary sources are to be utilized in the execution of this research paper. Through a critical examination of such materials, there will be thorough analysis of the primary focus of this paper, the impact of e-commerce on selective distribution systems.

&lt;p&gt;&lt;i&gt;Societal Stress and Law&lt;/i&gt; draws attention to the social side effects of law by developing the sociological concept of society-level stress, a corollary of the concept of individual-level stress in the biological sciences.&amp;nbsp;To encourage interest in societal stress, the book looks at (1) instances of law adopted by American states that the U.S. Supreme Court held unconstitutional and (2) actions by American states with regard to a proposal to amend the federal Constitution.&amp;nbsp;The Court rulings and the proposed constitutional amendment were capable of producing societal stress because they were seen by a sizeable segment of the U.S. public as being incompatible with significant American traditions.&amp;nbsp;In original studies that apply logistic regression to state-level statistical data, the book identifies sociological variables that predict state differences in the adoption of this law and state differences in actions on the proposed constitutional amendment.&amp;nbsp;Because these variables represent societal agents that affected whether a state experienced social stress from the rulings and proposal, the book blends theory with empirical research and illustrates how each can support the other in law-focused scholarship.&lt;/p&gt;
