This edited collection provides an international collection of essays addressing the most important challenge confronting courts in all jurisdictions, common and civil law: how can we restrict the use of imprisonment to avoid unnecessary human and fiscal costs? It evaluates the rise of the World Wide Web and the model of cybercrime, questions whether existing criminological thought offers relevance and efficacy in current circumstances, conditions and future predictions, and revisits the concept of Relative Deprivation and&nbsp;the underpinning social psychological and socio-political foundations of it. It argues that&nbsp;Relative Deprivation&nbsp;allied to post-industrial precarity provides a central platform for understanding crime and deviance in a hyper-connected and hyper-commercial neoliberal world.&nbsp;The book develops to explore current criminological and security conceptions of artificial intelligence, big data, crime and social control, as well as hacktivism, and how opportunities for crime have become ‘democratised’ and expanded through the Web. Drawing&nbsp;on empirical data, theoretical narratives and a review of the state of crime now and in a speculative near future, Hamerton and Webber discuss some potential directions for a new transdisciplinary critical criminology.&nbsp;

This is a study of elite English men of English law and the methods they used to retain and justify their power and privilege, through controlling the story of the legal person. It looks at how these men of legal authority thought of themselves and their institution; how they studied and explained law; and how they put themselves in the middle of it, as the standard human in need of legal regulation and protection and in charge of that regulation and protection, and assigned to women an inferior legal role and being. The main strategy used to do all this was manipulation of the concept of 'the legal person'. From the 1860s to the 1920s the courts declared that women were not 'persons' who could exercise public power - to vote, to sit in Parliament, to gain degrees, to be lawyers. Up to the end of the 20th century, and into the 21st, women's personhood remained precarious in the private sphere, for rape was excused within a marriage and female reproduction remained under state control (as it still does). The book examines the active exclusion of women from the means of making legal meaning, especially the ability to shape law's central concept and shows the epistemological effects of this sex differential of legal power which are still felt today. Leading legal thinkers who helped to masculinise the concept of the person, to the detriment of women, are still revered. Law's continuing male orientation is neither seen nor acknowledged and the legal person is treated (falsely) as if he had always been and remains anyone.

This book offers the first comprehensive, empirically grounded analysis of how corporate human rights and environmental responsibilities are conceptualised, interpreted, and operationalised through OECD National Contact Point (NCP) case law. Moving beyond doctrinal debates, it examines 394 specific instances handled between 2000 and 2024 to demonstrate how NCP statements function as an evolving body of quasi-juridical authority that progressively shapes the meaning, scope, and content of the corporate responsibility to respect under the UN Guiding Principles on Business and Human Rights (UNGPs) and the OECD Guidelines for Multinational Enterprises. Combining traditional legal analysis with systematic content analysis using MAXQDA, the book traces how norms are articulated across all dimensions of human rights due diligence: policy commitments, risk identification, prevention and mitigation, tracking, communication, remediation, and stakeholder engagement. Each thematic chapter distils key findings from the case law, highlighting both best practices and persistent shortcomings, and showing how companies navigate complex questions of causation, leverage, and corporate involvement in harm—whether through their subsidiaries, supply chains, investment relationships, or broader business structures. The book further clarifies corporate responsibilities in context: gender-based impacts, workers’ rights, Indigenous Peoples’ rights, minority protection, environmental harm, climate impacts, conflict-affected areas, and alignment with the Sustainable Development Goals. A dedicated analysis of different corporate actors—parent companies, investors, financial institutions, non-profit organisations, and state-owned enterprises—reveals distinct patterns of accountability and influence within transnational economic activity. Finally, the book turns to the state duty to protect, offering a critical examination of how home states regulate extraterritorial corporate conduct, the forms of complicity that emerge, and the regulatory measures reflected across NCP practice. The conclusion argues that, taken cumulatively, NCP statements amount to a significant and under-recognised source of normative authority: a soft-law mechanism whose interpretive influence is shaping the future direction of corporate human rights and environmental responsibility.

A Bottom-Up Analysis through OECD Case Law

Conceptualising the Corporate Human Rights and Environmental Responsibilities

This book is the first comprehensive academic treatment of the International Covenant on Economic, Social and Cultural Rights (ICESCR) and employment rights, which has a global vocation demonstrated by having been ratified by 173 States since it was adopted in 1966. Workers' rights need protection and reinforcement. To achieve this aim, international human rights standards can play an important role. The ICESCR is the most important global UN instrument in this respect. It covers a wide range of employment rights, including the right to strike, and has global application. But it is not sufficiently developed and used, and national implementation often needs improvement. Part 1 of the book analyses general issues related to the Covenant, such as context, development, challenges, influences at the global and regional levels, interpretation and procedural elements. Part 2 deals with the specific provisions which are directly linked to the employment relation. The book is based on a thorough analysis, mainly, but not exclusively, of the case law of the Committee on Economic, Social and Cultural Rights (CESCR), that is monitoring the national implementation of the Covenant. Together, the chapters in this book will empower academics and practitioners in labour law to find answers to relevant and practical problems in order to better enforce and improve workers' rights. The book is the result of a project by the 'Transnational Trade Union Rights' experts Network (TTUR), linked to the European Trade Union Institute (ETUI).

A clarion call to recognize soldiers' rights, arguing that volunteering to fight and die for one's country does not mean consenting to exploitation in the process. American leaders endlessly profess their admiration for military service members. But these effusive declarations hardly comport with reality. Soldiers receive shoddy equipment and inadequate medical care; they are ordered to commit crimes and deployed to illegal wars. Such treatment is rarely recognized for what it is: a violation of the duty owed to soldiers by their government. When American service members are injured or killed during training, for example, they and their families are barred from suing the military for negligence or malfeasance. And when the torture of detainees at Abu Ghraib came to light, the subsequent proceedings focused just on low-ranking perpetrators. The psychological harm done to the soldiers themselves by commanders who ordered them to commit torture in the first place went unacknowledged. Examining statutes, treaties, court cases, and congressional hearings, Saira Mohamed shows how the law encourages the treatment of soldiers as mere instruments, to be used and abused however the government wishes. She also unearths overlooked laws that point in the other direction, suggesting the possibility of robust protections for service members. Paradoxically, these get ignored in part because of the popular adulation of the military--the vision of service members as heroes who selflessly endure unlimited sacrifice. The all-volunteer nature of the force also promotes the misguided notion that soldiers have willingly accepted whatever mistreatment they might endure. What a Country Owes Its Soldiers shows how laws and mindsets can change, enabling genuine respect for soldiers' humanity. Acknowledging their rights can transform our understanding of those who fight America's wars, and of American warmaking itself.
