Reason in an Unreasonable Form

This book challenges the view that legal positivism should be reduced to a conceptual analysis of legal validity. Instead, Elena Namli reclaims legal positivism as a theory of the relationship between law, morality, and politics. Presenting novel interpretations of the classical works of Herbert L. A. Hart, Joseph Raz, and Jürgen Habermas, Namli frames legal positivism as a theory that makes possible a moral and political critique of valid law. Moreover, this book defends the dialectical relationship between law, politics, and morality by combining a positivist approach to legal validity with a constructivist ethical theory which strengthens the critical potential of legal positivism. Legally valid norms may not always be morally justified, but understanding the moral quality of legal regulations is essential for comprehending modern law.

The book's interdisciplinary authors first derive a critical framework and set of social-psychological hypotheses from the long-neglected criminological writings of the early Frankfurt School. They then test and explore these hypotheses with new data and analyses in a series of chapters that guide the reader down the ladder of capitalist individualism. In the process, the authors synthesize and critically examine scholarship of Constitutional law; big data on indebtedness, segregation, and police militarization; psychological surveys capturing and comparing attitudes and emotions around debt and policing; and the intimate testimony of those who are deeply in debt or are currently incarcerated. A Theory of Capitalist Individualism

When individuals invoke their identity in court, they seek to strengthen their claims - but what does "identity" mean in legal terms? This study explores why and how law ascribes identity to individuals, arguing that the concept becomes theoretically coherent only within anti-discrimination law. Examining the categories of 
 gender
 , 
 religion
 , and 
 disability
 , it shows that the law treats identity as both mutable and immutable. Drawing on case law from gender registration, health and social insurance claims of transgender persons, recognition of queer and religious refugees, constitutional protection of religion, and disability rights, the author uncovers a fundamental contradiction: the very categories meant to protect individuals also define and limit them. Through an immanent critique and a systematic dialogue with Hegel's theory of freedom and "second nature", the study conceptualises identity as both contradiction and form of freedom. Legal identity, understood in this dialectical sense, is the condition for self-determination within liberal anti-discrimination law. The author concludes that only a dynamic-yet not arbitrary-treatment of legal categories can sustain freedom without dissolving its normative coherence.

The new macroeconomics is about distributions and flows, rather than points and intersections. Market frictions imply that the search for trading partners is time consuming and costly. Consequently, market participants flow between economic states, and trades occur at dispersed prices. This generates motives for continued search for better market opportunities, and for bargaining between potential trading partners. This volume takes the empirical analysis of markets with frictions to a new level by using unique merged registers from Denmark on firm accounting data, individual employee data, and international trade data to estimate empirically the relevant flow rates, dispersions, and relations among key variables of interest, including productivity, firm size, wages, exports, growth, and unemployment. The results serve to inform researchers and policy makers about the functioning of markets, justify the interpretation of dispersion and flows as equilibrium outcomes, and provide an understanding of cycles, adjustment, and potentials for public policy.
