Recognition and Protection of Well-Known Marks under Rwanda's Intellectual Property Law

Es wird der theoretische Rahmen des Freihandelsabkommens diskutiert, die Rolle und Kompetenz der GHP analysiert, sowie die vertragliche Handelspolitik und das Zustandekommen von gemischten Abkommen detailliert dargestellt. Schließlich werden die Ergebnisse zusammengefasst und betrachtet.

Studienarbeit aus dem Jahr 2023 im Fachbereich Jura - Europarecht, Völkerrecht, Internationales Privatrecht, Note: 1.0, Technische Universität Dresden (Institut für Internationales Recht, Geistiges Eigentum und Technikrecht), Veranstaltung: Seminar Militärische Gewalt als Bedrohung für das Kulturerbe der Welt und die kulturelle Vielfalt, Sprache: Deutsch, Abstract: Diese Arbeit versucht darzustellen, an welche Pflichten betreffend Kulturgut Besatzungsmächte im Allgemeinen völkergewohnheitsrechtlich gebunden sind; der völkerrechtliche Stand des Kulturgutschutzes soll kritisch bewertet werden. Darüber hinaus wird die Besatzung der Palästinensischen Gebiete durch Israel, unter Einbeziehung des sogenannten IGH Mauergutachtens, exemplarisch in Bezug auf Kulturgutschutzpflichten beleuchtet. Dabei wird der Argumentation des IGHs folgend die Legalität der Siedlungen Israels in den Palästinensischen Gebieten sowie die Errichtung der israelischen Schutzmauer beurteilt, anhand Fallstudien wird der Einfluss dieser auf Kulturgüter dargestellt. Weiterer Gegenstand dieser Analyse ist die Befolgung von Pflichten, an die Israel in den Palästinensischen Gebieten gebunden ist sowie die Gewährleistung des Kulturgutschutz im Rahmen der UNESCO in den Palästinensischen Gebieten, insbesondere in der Altstadt Jerusalems. Schlussendlich stellt sich die im Lichte eklatanter Rechtsbrüche zwangsläufige Frage, wie die Implementierungsmechanismen, insbesondere der in der Altstadt Jerusalems greifende Reactive Monitoring Process der UNESCO, nachhaltiger durchgesetzt werden können bzw. welche Alternativen für die Staatengemeinschaft bestehen.

Dargestellt anhand der Palästinensischen Gebiete und des IGH Mauergutachtens

Pflichten einer militärischen Besatzungsmacht betreffend Kulturgut

Studienarbeit aus dem Jahr 2020 im Fachbereich Jura - Europarecht, Völkerrecht, Internationales Privatrecht, Note: 13, Friedrich-Alexander-Universität Erlangen-Nürnberg, Sprache: Deutsch, Abstract: In dieser Arbeit wird insbesondere auf das Urteil des EGMR vom 13. Februar 2020 (Az.: 8675/15 und 8697/15) eingegangen, mit welchem die Große Kammer des EGMR Beschwerden von zwei Afrikanern gegen Spanien zurückgewiesen hat. Ferner zeugt die Beteiligung zahlreicher Dritter - sowohl Regierungen als auch NGOs - an diesem Fall von einem großen öffentlichen Interesse.Das Urteil wirft wichtige Fragen auf, vor allem hinsichtlich der von den Parteien im Asylverfahren zu beachtenden Pflichten. Welche Unsicherheiten ergeben sich aus dem Urteil? Werden durch eine solche Zurückschiebung Menschenrechte beeinträchtigt? Werden durch die Zulässigkeit von Push-Backs gewaltsame Rückschiebepraktiken gestärkt? Im Rahmen der Arbeit wird das Urteil analysiert, in den menschen- und europarechtlichen Kontext eingeordnet und auf seine Konsequenzen hin untersucht.

Zur menschenrechtlichen Zulässigkeit von Push-Backs

Masterarbeit aus dem Jahr 2023 im Fachbereich Jura - Europarecht, Völkerrecht, Internationales Privatrecht, Note: Gut, , Veranstaltung: Europarecht, Sprache: Deutsch, Abstract: Die vorliegende Masterarbeit widmet sich einem hochaktuellen und komplexen Thema: der Investoren-Staat-Schiedsgerichtsbarkeit im Kontext des EU-Rechts. 
Ausgehend von der eingehenden Betrachtung der Komstroy-Entscheidung des EuGH und ihrer weitreichenden Implikationen, befasst sich diese Arbeit mit der Fragestellung, wie sich die jüngsten Entwicklungen auf die Praxis der Investitionsschiedsgerichtsbarkeit auswirken und welche rechtlichen Herausforderungen sich daraus ergeben.

Internationale Schiedsgerichtsbarkeit gilt als das präferierte Forum für Streitigkeiten zwischen Investoren und Staaten, die unter Bilateralen Investitionsschutzverträgen (BITs) und dem Vertrag über die Energiecharta (ECT) entstehen. Die Entscheidung des Gerichtshofs der Europäischen Union (EuGH oder Gerichtshof) im Fall Komstroy hat bereits Ende 2023 gezeigt, dass sie weitreichende Folgen hat, da sie die Zuständigkeit von Schiedsgerichten in Schiedsverfahren sowie die Anerkennung, Vollstreckung und Aufhebung solcher Entscheidungen in nationalen Gerichtsverfahren beeinflusst. 
Seit 2018 hat sich der EuGH in drei Fällen – Achmea im März 2018,  Komstroy im September 2021  und PL Holdings im Oktober 2021  – zu der Vereinbarkeit von Schiedsklauseln mit dem EU-Recht geäussert. Diese Entscheidungen verdeutlichen die ablehnende Haltung des EuGH gegenüber Schiedsverfahren zwischen Investoren und Staaten innerhalb der EU. Besonders bemerkenswert war der Fall Komstroy: Sowohl die Republik Moldau als auch die Ukraine, wo das Unternehmen Komstroy seinen Sitz hat, sind keine EU-Mitgliedstaaten. Daher war die Anwendbarkeit der Schiedsklausel des ECT auf Streitigkeiten innerhalb der EU weder relevant noch Gegenstand der dem EuGH vorgelegten Fragen. Der EuGH bezog sich auf diese Fragestellung daher nur beiläufig in seinem obiter dictum.

Von Achmea und Komstroy: Zur Unionsrechtswidrigkeit von intra-EU-Investitionsschiedsgerichtsbarkeit

Studienarbeit aus dem Jahr 2023 im Fachbereich Jura - Europarecht, Völkerrecht, Internationales Privatrecht, Note: 15, Bayerische Julius-Maximilians-Universität Würzburg (Juristische Fakultät), Sprache: Deutsch, Abstract: Die Einhaltung des Rechtsstaatsprinzips in den Mitgliedstaaten ist eine elementare Voraussetzung für das Bestehen der EU als Rechtsgemeinschaft. Gleichzeitig ist jedoch eine Verschlechterung der Lage der Rechtsstaatlichkeit in einigen Mitgliedstaaten zu beobachten. Daher besteht für die EU die Aufgabe die Rechtsstaatlichkeit in der EU, im Rahmen der durch die Verträge erteilten Befugnisse, zu schützen. Das neuste Instrumentarium, der Konditionalitätsmechanismus, erweitert nun als hard-law-Instrument die Handlungsmöglichkeiten der EU. Primäres Ziel des Konditionalitätsmechanismus ist es, die finanziellen Interessen der EU zu schützen. Hierfür ist die Achtung der Rechtsstaatlichkeit wesentlich. Rechtsstaatsdefizite, beispielsweise in der Unabhängigkeit der Gerichte, gefährden die wirtschaftliche Durchführung des EU-Haushalts und verhindern einen wirksamen Schutz gegen Betrug und Korruption.

Der Konditionalitätsmechanismus im Lichte der Maßstäbe des EU-Rechts

Studienarbeit aus dem Jahr 2024 im Fachbereich Jura - Europarecht, Völkerrecht, Internationales Privatrecht, Note: 10, Universität Leipzig, Sprache: Deutsch, Abstract: Die unionsautonome Abgrenzung von Vertrags- und Deliktsgerichtsstand nach der Brüssel Ia-VO wird flankiert von gegensätzlichen Vorstellungen in den Mitgliedsstaaten. In Frankreich und Luxemburg etwa schließt das Bestehen eines Vertrags zwischen Schädiger und Geschädigtem die Zuständigkeit des forum delicti effektiv aus. Das knappe Brogsitter-Urteil (EuGH, Urt. v. 13.03.2014 – C-548/12, Brogsitter) wurde teilweise als Adaption dieses Non-Cumul-Prinzips verstanden. Kritiker bemängelten den hierin angelegten Bedeutungsverlust des Deliktsgerichtsstands sowie den unklaren Anwendungsbereich der Doktrin. Die Unsicherheiten im Umgang mit Art. 7 Brüssel Ia-VO nach Brogsitter führten schnell zu Wikingerhof (EuGH, Urt. v. 24.11.2020 – C-59/19, Wikingerhof). Dieser Beitrag widmet sich unter umfassender Auswertung der einschlägigen Literatur der Frage, ob dem EuGH mit dem Urteil eine überzeugende Lösung der Abgrenzungsproblematik gelungen ist.

Seminar paper from the year 2023 in the subject Law - European and International Law, Intellectual Properties, grade: 1,3, Christian-Albrechts-University of Kiel, language: English, abstract: While until the mid 2000’s the proliferation of international treaties, conventions and organizations that intended to guide state’s behavior could be found, scholars do currently observe a rejection of legalization and judicialization (Mondré et al 2010; Voeten 2022). This does not mean a hostile attitude towards “globalization, international organizations, and democracy” (Voeten 2022). States rather abandon bilateral investment treaties, and leave, or threaten to leave international courts (cf. ibid.). But this does not apply to all types of international treaties and Courts. 

States can, e.g., decide to leave the Rome Statute within the International Criminal Court (ICC), while they cannot decide to leave the International Court of Justice (ICJ) since it is, acc. to Art. 1 ICJ-Statute, the principal judicial organ of the United Nations and shall function in accordance with its provisions of the Statute. What they can do though, is to decide to withdraw from the “optional clause”, acc. to Art. 36 para. 2 ICJ-Statute, meaning states may at any time declare that they recognize the jurisdiction as compulsory ipso facto and without special agreement or on the opposite avoiding the ICJ at all. 

A form of rejection or avoidance can thereby be determined, whenever states do not use the ICJ at all or withdraw from its optional clause as the United States did in 1985 after the Court issued an unfavorable jurisdictional decision in a case relating to a U.S. military intervention in Nicaragua (cf. Anderson 2018). Scholars describe this kind of behavior as “pushback”, meaning states accept the system in general but do not use it on their own and practice criticism (Madsen et al 2018).

The International Court of Justice. The weakness within the World Court

Master's Thesis from the year 2024 in the subject Law - European and International Law, Intellectual Properties, grade: A, Lund University (School of Economic and Management), course: HARN 63, language: English, abstract: This legal dissertation explores Sweden’s role in implementing anti-dumping measures within the European Union while fulfilling its obligations to the World Trade Organization (WTO). The study highlights the inherent tension between Sweden’s traditionally liberal trade policy and the necessity of protecting domestic industries—especially in the steel and chemical sectors—against unfair competition.

Using a legal-dogmatic and comparative law approach, the analysis focuses on the implementation of Council Regulation (EU) 2016/1036 in Sweden and examines relevant WTO dispute cases that have affected Swedish industry. The research aims to clarify how Sweden balances its open-market principles with its responsibilities under EU trade defence policy and WTO law.

In doing so, the study provides insights into Sweden’s potential to act as a reform-oriented player within the EU—supporting a more transparent and sustainable trade defence policy that aligns with both international liberalization principles and national interests. The dissertation also addresses Sweden’s biennial reports and its position on EU trade strategy reform, presenting the country as a constructive force in shaping a progressive trade policy framework.

Law of The European Union. From Single Market to Brexit and Beyond. Is EU law still applicable?

Research Paper (postgraduate) from the year 2023 in the subject Law - European and International Law, Intellectual Properties, grade: 72, University of Kent, course: Contemporary Topics in IP Law, language: English, abstract: This Paper argues that the EU needs to adopt a harmonised policy framework promoting the right to repair and limiting manufacturers’ use of IPRs on software to restrict repair rights which ultimately impacts the achievement of sustainability goals. Part B begins with the origins of the right to repair movement and its significance. Part C discusses restrictions on repair rights, including the role of IPRs. Part D discusses how the EU legal framework recognises repair rights and contrasts this with the Australian approach. Part E discusses the suggestions of scholars on reforms to the EU legal framework to better tackle restrictions on repair rights.Modern electronics constitute not only the hardware in the device itself but also the embedded software that is critical to the device’s functionality. This software is usually pre-installed on the device by the manufacturer to run all its basic operations. This integration of software systems to devices, sometimes called the "softening of hardware",  requires the intervention of intellectual property rights (IPRs) to delineate the blurry lines separating the device and its functional components in software.  Consequently, manufacturers use IPRs on the embedded software to limit the consumer’s control over a device and effectively lock them out from doing basic repairs to restore functionality. These limitations discourage many consumers from pursuing repairs in favour of purchasing new devices and discarding the faulty ones. The result is a linear model of consumption and a throw away culture contributing to large amounts of electronics waste (e-waste) disposed worldwide.  In 2019, consumer electronics comprised 54 million Metric Tons of e-waste, with Europe contributing 12 million Metric Tons.  Worse still, the effects of e-waste pileups have for decades flowed downstream from developed to developing countries. In response, the European Union (EU) has focused on achieving a circular economy to reduce e-waste by extending the lifespan and usability of products through, inter alia, recognising the right to repair movement.

Restrictions on the Right to Repair under IP Law. Impacts on Achievement of Sustainability Goals

Master's Thesis from the year 2022 in the subject Law - European and International Law, Intellectual Properties, grade: 16/20, Leuven Catholic University, language: English, abstract: This thesis examines the European paradigm shift (i.e., from unconditional openness to foreign direct investment to the statement “we are not naive free traders” pronounced by the former President of the European Commission Jean-Claude Juncker) toward the concerns raised by the Franco-German Manifesto and the subsequent interventions of European legislator. The research will focus on the new Foreign Direct Investments Screening Regulation and Cybersecurity Regulation. Furthermore, this thesis addresses a final proposal for a regulation to address state aid from non-European countries, as well as prospects for amending European competition law to meet Member States' desire to create "national and European champions". Globalization, the development of new technologies and the recent COVID-19 pandemic crisis prompted the reopening of old issues in the European Union concerning the demand for protection and the interplay between industrial policy and European competition law. To preserve the internal market, sovereignty and the future economic independence of Europe, unified and strategic European thinking is required. In this vein, Germany and France formulated an industrial policy proposal to induce the European Union to amend its rules on the subject, now perceived as 'outdated' when confronted with increasingly fierce industrial competition from the Asian powers and the United States. This understanding, labelled as the Franco-German Manifesto, illustrates Member States' concerns on the need for new European defence tools for technologies, companies and the European market, along with the reform of the current regulatory framework to enable European companies to compete globally. The analysis performed in this thesis thus investigates the rationale underpinning the new regulations and their approach to the critical issues highlighted by the Member States. The scrutiny of the mentioned regulations will concentrate on their effectiveness in countering risks related to (i) foreign acquisition of strategic assets, (ii) new technologies, and (iii) distortions of the internal market due to the lack of a global level playing field, will lead this thesis to argue in favour of further action by the legislator.
