Recognition and Protection of Well-Known Marks under Rwanda's Intellectual Property Law

The study highlights the inherent tension between Sweden’s traditionally liberal trade policy and the necessity of protecting domestic industries—especially in the steel and chemical sectors—against unfair competition.

Using a legal-dogmatic and comparative law approach, the analysis focuses on the implementation of Council Regulation (EU) 2016/1036 in Sweden and examines relevant WTO dispute cases that have affected Swedish industry. The research aims to clarify how Sweden balances its open-market principles with its responsibilities under EU trade defence policy and WTO law.

In doing so, the study provides insights into Sweden’s potential to act as a reform-oriented player within the EU—supporting a more transparent and sustainable trade defence policy that aligns with both international liberalization principles and national interests. The dissertation also addresses Sweden’s biennial reports and its position on EU trade strategy reform, presenting the country as a constructive force in shaping a progressive trade policy framework.

The 2030 Agenda for Sustainable Development as an example of global norm evolution at the United Nations

Studienarbeit aus dem Jahr 2023 im Fachbereich Jura - Europarecht, Völkerrecht, Internationales Privatrecht, Note: 1,0, IU Internationale Hochschule, Sprache: Deutsch, Abstract: Die Hausspitze des Bundesministeriums für Verteidigung (BMVg) sieht für das Themengebiet Flugplatznutzung noch Bedarf an einer Entscheidungshilfe und hat den zuständigen Fachreferenten des Bundesamtes für Infrastruktur, Umweltschutz und Dienstleistung der Bundeswehr (BAUIDBw) beauftragt, eine zusätzliche Expertise im Rahmen einer extern zu vergebener Studie einzuholen. Diese zu vergebene Studie soll die erweiterten Nutzungsmöglichkeiten eines vorhandenen Flugplatzes in Roth (Bayern) auf deren Umweltverträglichkeit überprüfen. Um eine entsprechende mögliche erweiterte Nutzung des Flughafengeländes in Roth abschließend entscheiden zu können, wird eine Entscheidungshilfe benötigt, die nur durch einen externen Partner zufriedenstellend und rechtssicher erledigt werden kann. Diese Studie soll durch eine öffentliche Ausschreibung im Rahmen der dafür vorgesehenen Haushaltsmittel und innerhalb eines Zeitraumes von ca. 30 Monaten vorliegen, um über eine erweiterte Nutzung des Flugplatzes in Roth entscheiden zu können. Der dafür zuständige Fachreferent soll hier schnellstmöglich eine Vergabe in die Wege leiten, um diesen Auftrag zu vergeben. Bevor die Studie beauftragt und vergeben werden kann, müssen zunächst einige grundlegende rechtliche und organisatorische Voraussetzungen vorliegen. Es muss der Umfang und die Art der zur vergebenden Studie (der Bedarf) feststehen. Danach müssen ebenfalls die dazu notwendigen Haushaltsmittel nach der Bundeshaushaltsordnung (BHO) vorliegen. Sobald der Bedarf und die entsprechende Finanzierung feststehen, sind die notwendigen Vergabeunterlagen vorzubereiten und die entsprechende Vergabe für die Ausschreibung nach den gesetzlichen Vorgaben zu wählen. Erst dann kann die Ausschreibung der Studie erfolgen. Je nach Vergabeart und Höhe der Gesamtsumme hat die Ausschreibung europaweit, stattzufinden. Nach Ende der Ausschreibungsfrist sind die verschiedenen Angebote einzeln zu bewerten und in eine entsprechende Reihen- bzw. Rangfolge zu bringen. Anschließend sind die jeweiligen Bieter entsprechend zu informieren, ob sie die Ausschreibung gewonnen haben oder nicht. Nach einer bestimmten gesetzlichen Frist kann der Vertrag mit dem Sieger der Ausschreibung geschlossen werden, wenn in diesem Zeitraum keine Rüge bei dem zuständigen Gericht eingegangen ist.

Erstellung einer Leistungsbeschreibung für ein Bundesministerium

Masterarbeit aus dem Jahr 2021 im Fachbereich Jura - Europarecht, Völkerrecht, Internationales Privatrecht, Note: 11,0, Albert-Ludwigs-Universität Freiburg, Sprache: Deutsch, Abstract: Verstößt die Strafbarkeit der Holocaustleugnung tatsächlich gegen die Meinungsfreiheit? Wo beginnt und wo endet die Meinungsfreiheit? Handelt es sich hierbei um ein deutsches Sonderproblem? Wie gehen die beiden Nachbarländer Deutschland und Frankreich mit diesem Spannungsfeld um? Wo liegen die Gemeinsamkeiten und wo die Unterschiede? Auch in zahlreichen anderen Staaten wird die Holocaustleugnung unter Strafe gestellt und die Verfassungsmäßigkeit dessen lebhaft diskutiert, sodass sich die Frage nach einer europäischen oder gar internationalen Regelung aufdrängt. Die Antwort auf diese Fragen gilt es, in dieser Arbeit herauszufinden.Seit Jahren wird in Deutschland in unregelmäßigen Abständen über die Strafbarkeit der Holocaustleugnung und deren Legitimität diskutiert. Seit in den 1950er Jahren sowohl in Frankreich als auch in Deutschland erstmals Bücher veröffentlicht wurden, in denen der Holocaust in unterschiedlicher Weise angezweifelt wird, stellte sich immer wieder die Frage, ob derartige Äußerungen von der Meinungsfreiheit gedeckt sind oder sein sollten.Dabei sollte man jedoch nicht vergessen, dass es bereits ein immanenter Bestandteil der nationalsozialistischen Politik der Vernichtung der Juden war, alle Spuren samt der Erinnerung an die Verbrechen zu beseitigen, sodass eine Leugnung der Verbrechen gewissermaßen von Anfang an das Ziel der NS-Politik war.Bekannte Holocaustleugner seit Kriegsende sind bspw. die Franzosen Paul Rassinier und Robert Faurisson sowie die Deutschen Thies Christophersen und Ernst Zündel. Als Gemeinsamkeit aller Holocaustleugner kann der „Zweifel an den historischen Eckdaten des Holocaust[s]“ gesehen werden. Diejenigen, die derartige Zweifel äußern, berufen sich hierbei stets auf ihre Meinungsfreiheit und fühlen sich bei Bestrafung wegen ihrer Äußerungen in derselbigen verletzt. Die, die sich für eine Strafbarkeit der Holocaustleugnung aussprechen, sehen in der Leugnung des Holocausts eine Gefahr für die Demokratie, sodass seine Strafbarkeit dem Grundrechtsschutz diene. Dennoch ist es doch gerade die Meinungsfreiheit, die eine Demokratie ausmacht. Daher äußern sich nicht nur die Holocaustleugner selbst, sondern auch viele Rechtswissenschaftler, wie bspw. zwei Bundesverfassungsrichter, kritisch zur Strafbarkeit der Holocaustleugnung in Deutschland und auch in Frankreich wird selbst in akademischen Kreisen darüber diskutiert, ob diese Strafbarkeit die Meinungsfreiheit verletze.

Academic Paper from the year 2022 in the subject Law - European and International Law, Intellectual Properties, grade: 19/20, Leuven Catholic University, language: English, abstract: After a long journey, the Court of Justice of the European Union (CJEU) finally opened to an external system of judicial review. Indeed, despite the CJEU's historically notorious lack of openness towards an Investment Court System (ICS), a positive attitude was expressed in the opinion (C-1/17). This new attitude assumes a high degree of relevance in the discussions for a reform of the current Investor-State Dispute Settlement mechanism (ISDS), whose recursive criticalities will be by this paper investigated. In relation to the latter, the effectiveness of the proposed reforms will be analysed to contribute to the discernment as to which of the reform alternatives would be most effective. The analysis that will be carried out will begin by illuminating points of conflict with the interests involved in the current system. Consequently, the reforms proposed and currently being negotiated to resolve these issues will be analysed in order to (i) verify the manner in which they propose to offer a solution to the aforementioned criticalities; and (ii) assess which of the reform alternatives is best suited in terms of effectiveness and associated risks both in terms of coordination with the existing system and scope innovativeness.In framing the reform framework under negotiation, the analysis will devote particular attention to the debate on the most suitable of the alternatives between (i) the creation of a stand-alone court of appeal and (ii) the creation of a two-tier 'multilateral investment court' (MIC).

Towards a Reform of the Investor-State Dispute Settlement. An Assessment of the Innovation Route

Master's Thesis from the year 2022 in the subject Law - European and International Law, Intellectual Properties, grade: 16/20, Leuven Catholic University, language: English, abstract: This thesis examines the European paradigm shift (i.e., from unconditional openness to foreign direct investment to the statement “we are not naive free traders” pronounced by the former President of the European Commission Jean-Claude Juncker) toward the concerns raised by the Franco-German Manifesto and the subsequent interventions of European legislator. The research will focus on the new Foreign Direct Investments Screening Regulation and Cybersecurity Regulation. Furthermore, this thesis addresses a final proposal for a regulation to address state aid from non-European countries, as well as prospects for amending European competition law to meet Member States' desire to create "national and European champions". Globalization, the development of new technologies and the recent COVID-19 pandemic crisis prompted the reopening of old issues in the European Union concerning the demand for protection and the interplay between industrial policy and European competition law. To preserve the internal market, sovereignty and the future economic independence of Europe, unified and strategic European thinking is required. In this vein, Germany and France formulated an industrial policy proposal to induce the European Union to amend its rules on the subject, now perceived as 'outdated' when confronted with increasingly fierce industrial competition from the Asian powers and the United States. This understanding, labelled as the Franco-German Manifesto, illustrates Member States' concerns on the need for new European defence tools for technologies, companies and the European market, along with the reform of the current regulatory framework to enable European companies to compete globally. The analysis performed in this thesis thus investigates the rationale underpinning the new regulations and their approach to the critical issues highlighted by the Member States. The scrutiny of the mentioned regulations will concentrate on their effectiveness in countering risks related to (i) foreign acquisition of strategic assets, (ii) new technologies, and (iii) distortions of the internal market due to the lack of a global level playing field, will lead this thesis to argue in favour of further action by the legislator.

Foreign Direct Investment and Competition Policy after the Franco-German Manifesto. Embedding Political Dissent in Law

In particular, it highlights the challenges posed by the specific characteristics of digital markets. Further, it explains the operating principles of the Digital Markets Act and compares it with s.19a GWB. It examines the functioning of both laws with regard to their respective advantages and disadvantages and develops a recommendation on how the DMA should be adapted in the future. 

For decades, arts.101 and 102 TFEU have been the main rules for EU competition authorities to prevent companies from engaging in unfair and anti-competitive practices. Now, with the Digital Markets Act ("DMA"), a new set of rules has come into force in 2023 to address such practices by companies operating in digital markets, thereby seeking to ensure the contestability and fairness of these markets. The DMA, which also aims to simplify and speed up procedures, moves away from the case-by-case analysis of competition law, where competition authorities sanction infringements of arts.101 and 102 TFEU ex post. Instead, the DMA adopts a more regulatory approach aimed at preventing certain practices in the first place. This was seen as necessary because of the enforcement problems posed by the specific characteristics of rapidly developing digital markets. 

Regulating Digital Markets in Europe. A Comparative Assessment of the Digital Markets Act and Recommendations for Future Adjustments

Seminar paper from the year 2021 in the subject Law - European and International Law, Intellectual Properties, grade: 1,3, , language: English, abstract: The years of discussion about the question of the legal status of the settlements already indicates that it is not easy to come up with a distinct answer. For this reason, this paper does not aim to provide a definitive determination of the legal status of the Israeli settlements/communities in West Bank/Judea and Samaria (= Occupied Palestinian Territory = OPT). Rather, the goal to examine the legal arguments put forward by the various parties to the conflict and other actors in this debate and to explain why it is so difficult to come to a clear answer. The first step will be a brief overview of the Israeli settlements/communities in general. Here I focus primarily on the critical aspects of the Israeli settlements/communities in order to make clear why they are so controversial. Then the arguments supporting illegality are presented. A distinction must be made here between the arguments based on the International Humanitarian Law and the arguments based on the International Human Rights Law. To continue with the other side, the arguments for the legality of settlements will be considered, in order to finally draw some conclusions in relation to the question.

What are the Main Legal Arguments for and against the Legality of Israeli Settlements and Communities in the Westbank/Judaea and Samaria?

Seminar paper from the year 2023 in the subject Law - European and International Law, Intellectual Properties, grade: 1,3, Christian-Albrechts-University of Kiel, language: English, abstract: While until the mid 2000’s the proliferation of international treaties, conventions and organizations that intended to guide state’s behavior could be found, scholars do currently observe a rejection of legalization and judicialization (Mondré et al 2010; Voeten 2022). This does not mean a hostile attitude towards “globalization, international organizations, and democracy” (Voeten 2022). States rather abandon bilateral investment treaties, and leave, or threaten to leave international courts (cf. ibid.). But this does not apply to all types of international treaties and Courts. 

States can, e.g., decide to leave the Rome Statute within the International Criminal Court (ICC), while they cannot decide to leave the International Court of Justice (ICJ) since it is, acc. to Art. 1 ICJ-Statute, the principal judicial organ of the United Nations and shall function in accordance with its provisions of the Statute. What they can do though, is to decide to withdraw from the “optional clause”, acc. to Art. 36 para. 2 ICJ-Statute, meaning states may at any time declare that they recognize the jurisdiction as compulsory ipso facto and without special agreement or on the opposite avoiding the ICJ at all. 

A form of rejection or avoidance can thereby be determined, whenever states do not use the ICJ at all or withdraw from its optional clause as the United States did in 1985 after the Court issued an unfavorable jurisdictional decision in a case relating to a U.S. military intervention in Nicaragua (cf. Anderson 2018). Scholars describe this kind of behavior as “pushback”, meaning states accept the system in general but do not use it on their own and practice criticism (Madsen et al 2018).

Sie stellt einen Paradigmenwechsel dar, weg von der unverbrüchlichen Souveränität der Staaten hin zu einer internationalen Schutzverantwortung für Individuen in Fällen von schweren Menschenrechtsverletzungen. Diese Zulassungsarbeit untersucht die R2P aus einer interdisziplinären Perspektive und zielt darauf ab, ihre theoretischen Grundlagen, ihre Anwendung in der Praxis sowie die damit verbundenen ethischen, rechtlichen und politischen Herausforderungen zu beleuchten.
