Rechtsfolgen der politischen Verfolgung im wiedervereinigten Deutschland

Die Arbeitsgruppe Aufarbeitung und Recht an der Europa-Universität Viadrina Frankfurt (Oder) bekam 2018 vom Bundeswissenschaftsministerium den Auftrag, die "Rechtsfolgen politischer Verfolgung im wiedervereinigten Deutschland" zu untersuchen. Die wesentlichen Ergebnisse dieser Untersuchung werden in dieser Publikation veröffentlicht. Die gesetzlichen Grundlagen für die Rehabilitierung und Entschädigung politisch Verfolgter und Benachteiligter waren insgesamt zwar ausreichend. Dagegen war die Durchführung der Gesetze mangels behördlicher Verwaltungsvorschriften und Struktur der Rehabilitierungsverfahren mangelhaft. So müssten im Bereich der Bodenreform und der Kollektivierung ca. 10 % der Verfahren wegen krasser Rechtsfehler noch einmal neu aufgerollt werden. Folge der unzureichenden Umsetzung der Rehabilitierungsgesetze ist nicht zuletzt, dass Angehörige und Nachkommen politisch Verfolgter mit dem Rechtsstaat unzufrieden sind.
