Originalism and Judicial Discretion. A Critical Analysis of Constitutional Interpretation in the United States

This book examines the history, theories and legal principles underpinning the rules and practice of civil litigation in England and Wales. English civil procedure has been the object of renewed interest in the last 20 years since Lord Woolf proposed and implemented reforms of the civil justice system on a scale unequalled since the mid-19th century. Focusing on the overarching theoretical framework of civil procedure, this book provides a rigorous contextual analysis of the rules and practice of civil litigation in England and Wales and identifies the applicable rule of process and its rationale and connection to these rules and determines the scope of judicial discretion and regulatory flexibility. Chapter 1 sets out the core themes of the work, Chapter 2 provides the important historical background to modern English rules of court. Chapter 3 focuses on the rules of court as addressed to and concerning the litigant. This chapter therefore presents the 'fundamental principles' as the 'promises' by the state to litigants, that their rights will be enforced. It addresses the nature of a civil lawsuit and of the right to sue itself, whether private, that is, part of the litigant's "estate" either directly or as an extension of his other property at stake, or public, as the forum for the determination of the substantive law albeit in an individualized context. This also includes a discussion of the need for - or existence of, in all but name - separation between civil and administrative adjudication. Chapter 4 identifies the current theories of justice determining the function of the civil court in English law and their application to discrete moments of litigation but from the perspective of the way in which the judges conducting the litigation have their role and power reflected and amplified in the rules. Chapters 5 and 6 addresses the nature of the result of litigation, primarily the judgment (but also other types of final adjudicative decisions) and its characters, and the possibilities and nature of appeals in the current system. Chapter 7 considers the result of litigation in the notoriously difficult and uneven area of enforcement of final judgments.

As the final volume of a three-volume set that critically examines typical civil cases in China, this book focuses on resolving conflicts between outdated laws and an advancing society.Laws may become obsolete over time, or their relevance may be greatly diminished. With social changes and changes in the social system, it becomes inevitable to update laws. In China's reform and opening-up era, the social relations governed by civil and commercial laws are constantly evolving, resulting in noticeable changes. However, the enacted and effective civil and commercial laws may not immediately keep pace with these changes. Against this background, it may not always be appropriate to apply the law mechanically, especially in individual cases. Judgments in particular cases may be based on the details of those cases, guided by fundamental principles, and may disregard certain specific provisions in order to achieve fairness and justice. Some of the nine cases discussed in this volume have successfully practiced these principles, but most still have room for criticism and improvement.The book will appeal to scholars and students interested in China's civil litigation, civil law system and judicial reform, and comparative law.

Analysiert wird dabei die Auslegung des Begriffs der Grundrechtsverwirkung und es wird auf die rechtlichen Feinheiten eingegangen, die diesen Artikel prägen. Die Arbeit bietet eine gründliche Betrachtung und kritische Analyse dieses zentralen Instruments unserer wehrhaften Demokratie.Im Anschluss beschäftigt sich der Autor zunächst mit den Grundrechten an sich, gefolgt von einer genaueren Betrachtung von Art. 18. Dabei wird die systematische Stellung, der historische Kontext sowie die Wirkung und Bedeutung der Grundrechtsverwirkung für unsere Demokratie näher analysiert. &lt;p&gt;&lt;span&gt;This book compares the volume and nature of online print and broadcast television coverage from major media outlets from all U.S. Supreme Court oral argument sessions during the October 2019, 2020, and 2021 Terms. The authors demonstrate that the move to livestreaming the Court’s oral argument sessions increased the frequency and depth of online print news media’s coverage in the short term but not in the long term. For both online print and broadcast outlets, their findings suggest that the benefits of increased transparency offered by livestreaming oral argument audio did not come with significant disadvantages for the Court in terms of long-term changes in its news media coverage.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;/p&gt; &lt;p&gt;&lt;span&gt;The authors analysis provides timely evidence that speaks to the current, and ongoing, debate about public access to the Supreme Court. It also speaks to the likely consequences of permanently continuing the practice of livestreaming oral argument audio and sheds light on the ramifications of other potential expansions in transparency at the Supreme Court, such as livestreaming opinion announcement audio or providing live video coverage of the Court’s proceedings. This work speaks to the impact of increased access to oral arguments and the inner workings of government institutions more broadly. Indeed, the U.S. Supreme Court was not the only institution to grapple with the constraints of the COVID-19 pandemic and opportunities for unprecedented, and instantaneous, access to anyone, anywhere. Better understanding the implications of the Court’s decision to livestream audio from its proceedings provides leverage on the consequences of greater government transparency for news media coverage and, by extension, individuals’ exposure to, and interaction with, government more generally.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;/p&gt;

Essay from the year 2024 in the subject Law - Public Law / Constitutional Law / Basic Rights, , language: English, abstract: The global refugee crisis has presented a formidable challenge to the traditional understanding of state sovereignty and the control of national borders. While sovereignty affords States the right to control their borders and protect their nationals, States also have a humanitarian obligation to respect the human rights and dignity of refugees, who are often people fleeing from persecution, violence and abject poverty. This research explores the complex interplay between state sovereignty and humanitarian obligations in the context of refugee protection, by exploring the legal, ethical, and political dimensions of the issue. It argues that sovereignty should not be seen as an absolute or fixed concept, but rather as a dynamic and relational one, that is shaped by the changing realities and norms of the international community. By balancing sovereignty with the humanitarian obligation to protect refugees, this research also proposes a balanced approach that respects the rights of sovereign states while addressing the urgent needs of refugees. The research concludes that the legal framework which governs refugees, continues to be characterized on the one hand, by, the principles of state sovereignty and related territorial supremacy, self-defense, and self-preservation; and on the other hand by competing humanitarian principles, derived from general international law (including the purposes and principles of the United Nations) and treaty law.

Adopting a multidisciplinary approach to climate adjudication, this book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania.
