This book delves into the transformative efforts that sought to redefine punishment and rehabilitation, highlighting the pivotal role of Community Service Orders (CSO) and the legislative push to abandon the use of Short-Term Prison Sentences (STPS) for fine default. However, a deeper investigation reveals a critical oversight: the unique predicaments of women entangled in the criminal justice system were neglected. Through meticulous research and analysis, this work sheds light on the nuances of judicial discretion in the District Court, the inconsistencies in sentencing, and the challenges in implementing effective diversion policies. It presents an in-depth exploration of the legislative adjustments aimed at both ends of the sentencing spectrum and the unforeseen consequences these changes have had, particularly on women.Quantitative and qualitative research demonstrate that, in Ireland, there is a higher risk that when a woman reoffends this leads to increasingly harsher penalties. Women are offered fewer meaningful opportunities for self-improvement or programs aimed at addressing the socio-economic factors underscored by their offences.This book will be of interest to a broad spectrum of readers interested in criminal justice reform, gender studies, and socio-political history. Transforming Justice for Women

Examensarbeit aus dem Jahr 2024 im Fachbereich Jura - Öffentliches Recht / Staatsrecht / Grundrechte, Note: 15 Punkte, Universität Leipzig (juristische Fakultät), Veranstaltung: Seminar, Sprache: Deutsch, Abstract: Im Mittelpunkt der Arbeit stehen die BVerfGE 2, 1 und BVerfGE 5, 85 als Leitentscheidungen zum Parteiverbot aus den Gründungsjahren der bundesrepublikanischen Demokratie. Diese bilden bis heute den einzigen rechtsgeschichtlichen Vergleichspunkt für einen Verbotsausspruch und sind so angesichts gegenwärtiger hitziger Diskussionen über eine mögliche  Verfassungswidrigkeit der AfD von höchster Bedeutung. Zugleich wird eine Untersuchung der Weiterentwicklung der Rechtsprechung in BVerfGE 144, 20 vorgenommen, um feststellen zu können, welche Bedeutung den in den Leitentscheidungen aufgestellten Grundsätzen für künftige Parteiverbote zukommen kann.

Living Signs of Law

The Communicational Theory of Law (CTL) is a successful synthesis of the hermeneutic and analytical postulates, proceeding under the assumption that Law is the heritage of jurists and can be enriched by a rational and systematic reconstruction of the legal order. CTL offers an original perspective on the classic tension between normativity and institutionality, between Legal Theory and Legal Sociology, helping readers rediscover the value of Theory of Law in terms of explaining and advancing a range of legal functions.

It wouldn’t be saying too much to claim that through CTL, the contributions of the European philosophy of law from the 19th and 20th centuries (jurisprudence of concepts, legal sociology, legal positivism, institutionalism, etc.) can be reclaimed and now coordinated from a communicational and philosophy of language perspective, offering us a complete and useful Theory of Law. CTL does not avoid the problem of the idea of justice; rather, it confronts it by distinguishing between the Theory of Justice and ambital justice. As such, readers are equipped to verify the originality of the Theory of Legal Decision in the CTL framework and, thus, will find new tools for critically assessing the performance of courts and public authorities.

This book details the epistemological presuppositions on which CTL is built, but also offers new lines of critical development, which reflect CTL’s theoretical and philosophical potential. In the studies presented here, readers will find original answers to classic problems of the Theory of Law, together with examples of CTL’s practical application to the great challenges of our time, such as interculturalism, legal AI, populist demagogy, the transparency of public powers, etc. – all without forgetting the challenges of the future of Law.

With social changes and changes in the social system, it becomes inevitable to update laws. In China's reform and opening-up era, the social relations governed by civil and commercial laws are constantly evolving, resulting in noticeable changes. However, the enacted and effective civil and commercial laws may not immediately keep pace with these changes. Against this background, it may not always be appropriate to apply the law mechanically, especially in individual cases. Judgments in particular cases may be based on the details of those cases, guided by fundamental principles, and may disregard certain specific provisions in order to achieve fairness and justice. Some of the nine cases discussed in this volume have successfully practiced these principles, but most still have room for criticism and improvement.The book will appeal to scholars and students interested in China's civil litigation, civil law system and judicial reform, and comparative law.

Um diesen Konflikten auf eine konstruktive und außergerichtliche Weise zu begegnen, hat sich die Mediation als ein bewährtes Verfahren etabliert. Ihre Wirksamkeit beruht nicht nur auf einer langen Tradition, sondern auch auf dem Prinzip der Vertraulichkeit, das ihr zugrunde liegt.Die Vertraulichkeit ist ein wesentliches Merkmal der Mediation, das den Beteiligten ein geschütztes Umfeld bietet, um offen über ihre Anliegen zu sprechen und gemeinsam nach Lösungen zu suchen. Doch diese Vertraulichkeit steht oft im Spannungsfeld mit dem berechtigten Interesse der Öffentlichkeit, insbesondere der Presse, an Informationen über staatliches Handeln und Konfliktlösungsverfahren.Die vorliegende Arbeit setzt sich mit diesem Spannungsverhältnis auseinander und untersucht die Fragestellungen: Inwieweit können sich aus der Vertraulichkeit der Mediation Grenzen für den presserechtlichen Auskunftsanspruch ergeben? Welche Auswirkungen ergeben sich daraus für die Durchführung von Mediationsverfahren mit Beteiligung von Behörden oder anderen staatlichen Stellen?Um diesen Fragen gerecht zu werden, wird zunächst das Prinzip der Vertraulichkeit in der Mediation näher betrachtet, einschließlich seiner Bedeutung im Kontext anderer wesentlicher Prinzipien dieses Verfahrens. Anschließend erfolgt eine Darstellung des presserechtlichen Auskunftsanspruchs, wobei Umfang und Grenzen dieses Anspruchs im Fokus stehen.Darauf aufbauend wird untersucht, wie sich die Vertraulichkeit der Mediation auf den Auskunftsanspruch der Presse auswirkt und welche Konsequenzen sich daraus für die Praxis ergeben. Dabei werden mögliche Lösungsansätze für den Umgang mit dieser Thematik diskutiert.Es ist zu beachten, dass diese Arbeit sich auf Bundes- und Landesrecht beschränkt und ausschließlich den Auskunftsanspruch der Presse betrachtet. Challenging decades of scholarship and Supreme Court jurisprudence, newly discovered historical documents reveal that the First Amendment's Free Exercise Clause was meant to protect only the freedom to worship, not broader rights of conscience. The First Amendment proclaims that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." This language has been taken to provide sweeping constitutional protection for the freedom of belief and the freedom to act on one's beliefs, underpinning conscience-based claims by people seeking to avoid military service, mandatory schooling for their children, or being required to work on the Sabbath. Recently, religious traditionalists have appealed to the Free Exercise Clause to seek exemptions from laws connected with abortion, contraception, and same-sex marriage. In The Free Exercise Clause and the Rights of Conscience, Donald Drakeman demonstrates that such readings of the First Amendment are dramatically overbroad. Numerous newly available sources clearly show that when the Bill of Rights was ratified, Americans understood "free exercise of religion" as a well-established term of art referring solely to the ability to hold public worship services. That meaning remained unchanged well into the twentieth century. Time and again, when believers asked the courts for conscience-based exemptions from statutes, judges turned them down, telling them to address the legislature instead. It was only in the mid-twentieth century that the Supreme Court radically reimagined the Free Exercise Clause, granting religious exemptions from statutory duties for the first time in American history. As a result, today's Free Exercise Clause bears little resemblance to that of the framers and the American tradition of religious liberty. Given the current Supreme Court's heavy emphasis on original meaning and tradition when interpreting the Constitution, Drakeman's discovery could have significant implications for the future of conscience-based exemptions and the First Amendment itself.

While sovereignty affords States the right to control their borders and protect their nationals, States also have a humanitarian obligation to respect the human rights and dignity of refugees, who are often people fleeing from persecution, violence and abject poverty. This research explores the complex interplay between state sovereignty and humanitarian obligations in the context of refugee protection, by exploring the legal, ethical, and political dimensions of the issue. It argues that sovereignty should not be seen as an absolute or fixed concept, but rather as a dynamic and relational one, that is shaped by the changing realities and norms of the international community. By balancing sovereignty with the humanitarian obligation to protect refugees, this research also proposes a balanced approach that respects the rights of sovereign states while addressing the urgent needs of refugees. The research concludes that the legal framework which governs refugees, continues to be characterized on the one hand, by, the principles of state sovereignty and related territorial supremacy, self-defense, and self-preservation; and on the other hand by competing humanitarian principles, derived from general international law (including the purposes and principles of the United Nations) and treaty law.

Balancing State Sovereignty with Refugees Rights under International Law
