Originalism and Judicial Discretion. A Critical Analysis of Constitutional Interpretation in the United States

Telling the crucial and under-studied story of the U.S. legal doctrines that underpin the dispossession and domination of Indigenous peoples, this book enhances global Indigenous movements for self-determination. In this wide-ranging historical study of federal Indian law-the field of U.S. law related to Native peoples-attorney and educator Peter P. d'Errico argues that the U.S. government's assertion of absolute prerogative and unlimited authority over Native peoples and their lands is actually a suspension of law. Combining a deep theoretical analysis of the law with a historical examination of its roots in Christian civilization, d'Errico presents a close reading of foundational legal cases and raises the possibility of revoking the doctrine of domination. The book's larger context is the increasing frequency of Indigenous conflicts with nation-states around the world as ecological crises caused by industrial extraction impinge drastically on Indigenous peoples' existences. D'Errico rethinks the role of law in the global order-imagining an Indigenous nomos of the earth, an order arising from peoples and places rather than the existing hegemony of states.

Adopting a multidisciplinary approach to climate adjudication, this book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania. This open access book addresses a palpable, yet widely neglected, tension in legal discourse. In our everyday legal practices - whether taking place in a courtroom, classroom, law firm, or elsewhere - we routinely and unproblematically talk of the activities of creating and applying the law. However, when legal scholars have analysed this distinction in their theories (rather than simply assuming it), many have undermined it, if not dismissed it as untenable.

The book considers the relevance of distinguishing between law-creation and law-application and how this transcends the boundaries of jurisprudential enquiry. It argues that such a distinction is also a crucial component of political theory. For if there is no possibility of applying a legal rule that was created by a different institution at a previous moment in time, then our current constitutional-democratic frameworks are effectively empty vessels that conceal a power relationship between public authorities and citizens that is very different from the one on which constitutional democracy is grounded.

After problematising the most relevant objections in the literature, the book presents a comprehensive defence of the distinction between creation and application of law within the structure of constitutional democracy. It does so through an integrated jurisprudential methodology, which combines insights from different disciplines (including history, anthropology, political science, philosophy of language, and philosophy of action) while also casting new light on long-standing issues in public law, such as the role of legal discretion in the law-making process and the scope of the separation of powers doctrine.

From Creation to Application of Law

The Making of Constitutional Democracy

Studienarbeit aus dem Jahr 2023 im Fachbereich Jura - Öffentliches Recht / Staatsrecht / Grundrechte, Note: Gut (13 Punkte), Heinrich-Heine-Universität Düsseldorf (Juristische Fakultät), Veranstaltung: Grundrechtsentwicklung, Sprache: Deutsch, Abstract: Die Seminararbeit beschäftigt sich mit der Entwicklung der Wahlrechtsgleichheit und der damit verbundenen schrittweisen Verschärfung der Rechtsprechung des Bundesverfassungsgerichts.  Dazu wird ältere Literatur ab Beginn der 1950er-Jahre gezielt heutiger Literatur gegenübergestellt. Auch auf die Interpretation der WRV wird eingegangen. Beim Wandel der Auslegungsmaßstäbe findet zudem eine Betrachtung des historischen Kontextes statt.Dank der Debatte um das Wahlgesetz der Ampel-Koalition hat die Wahlrechtsgleichheit an öffentlicher Aufmerksamkeit gewonnen. Die Arbeit möchte die Entwicklung dieses grundrechtsgleichen Rechts in der Bundesrepublik Deutschland genauer betrachten. Der Prozess der schrittweisen Verschärfung der Rechtsprechung soll anhand dessen exemplarisch deutlich gemacht werden. Ohne einen Überblick über die Ausgestaltung des Wahlrechts in Preußen, damit verbunden dem Kaiserreich und der WRV lässt sich die moderne Ausprägung der Wahlrechtsgleichheit kaum nachvollziehen. Deshalb erfolgt zu Beginn eine historische Einordnung unter Berücksichtigung der Leitentscheidung des Staatsgerichtshofs zum preußischen Wahlrecht. Anschließend soll der Beratungsgang im Parlamentarischen Rat zu Art. 38 GG unter Würdigung des Einflusses Hermann von Mangoldts auf den Wortlaut dargestellt werden. Das Hauptaugenmerk liegt auf der Entwicklung in den 1950er-Jahren, sodass die Interpretation zu Beginn und zum Ende des Jahrzehnts herausgearbeitet und miteinander verglichen wird. Zuletzt stellt die Arbeit die Perspektive der 1950er-Jahre dem heutigen Verständnis der Wahlrechtsgleichheit gegenüber. Den Schwerpunkt der Arbeit bildet die Frage nach der Zulässigkeit und Ausgestaltung von Sperrklauseln. Aktuell bedeutsame Themen wie der – in den 1950er-Jahren kaum beachtete und erst seit Ende der 1980er-Jahre näher problematisierte – Einfluss von Überhangmandaten auf das Wahlergebnis werden dabei bewusst nur am Rande erwähnt. Methodisch erfolgt eine Auswertung der älteren Kommentare von Mangoldts bzw. Kleins und der heutigen herrschenden Literatur. Dabei gilt besondere Aufmerksamkeit der Auseinandersetzung mit der Rechtsprechung des BVerfG und einschlägiger Fachliteratur. Die Analyse der frühen Interpretation der Wahlrechtsgleichheit erfolgt unter Berücksichtigung der Verhältnisse in den 1950er-Jahren und dem persönlichen Lebensweg der Kommentarbearbeiter.

Examensarbeit aus dem Jahr 2024 im Fachbereich Jura - Öffentliches Recht / Staatsrecht / Grundrechte, Ruhr-Universität Bochum (Juristische Fakultät), Veranstaltung: Europäisches Wirtschaftsrecht, Sprache: Deutsch, Abstract: In dieser umfassenden Seminararbeit wird die Klimaschutzkonzeption des Europäischen Gerichtshofs für Menschenrechte (EGMR) und des Bundesverfassungsgerichts (BVerfG) eingehend analysiert. Die Arbeit beleuchtet die rechtlichen Rahmenbedingungen und die Entwicklung der relevanten Rechtsprechung, die den Schutz der Menschenrechte im Kontext des Klimawandels behandelt.

Durch eine vergleichende Analyse der Ansätze beider Gerichte werden Gemeinsamkeiten und Unterschiede herausgearbeitet, um die Wirksamkeit ihrer Entscheidungen in der Klimapolitik zu bewerten. Herausforderungen und rechtliche Grenzen werden ebenfalls thematisiert, wobei der Fokus auf den politischen Implikationen der Urteile liegt. Diese Seminararbeit bietet eine tiefgehende Analyse der Klimaschutzkonzeption des Europäischen Gerichtshofs für Menschenrechte (EGMR) und des Bundesverfassungsgerichts (BVerfG) mit einem besonderen Fokus auf das Recht auf chancengerechte Freiheitsverteilung. Sie untersucht die wissenschaftlichen Grundlagen, die diese Konzepte untermauern, sowie die Gewaltenteilung zwischen dem Bundestag und dem BVerfG in Bezug auf die Klimapolitik.
