Originalism and Judicial Discretion. A Critical Analysis of Constitutional Interpretation in the United States

Examensarbeit aus dem Jahr 2024 im Fachbereich Jura - Öffentliches Recht / Staatsrecht / Grundrechte, Note: 15 Punkte, Universität Leipzig (juristische Fakultät), Veranstaltung: Seminar, Sprache: Deutsch, Abstract: Im Mittelpunkt der Arbeit stehen die BVerfGE 2, 1 und BVerfGE 5, 85 als Leitentscheidungen zum Parteiverbot aus den Gründungsjahren der bundesrepublikanischen Demokratie. Diese bilden bis heute den einzigen rechtsgeschichtlichen Vergleichspunkt für einen Verbotsausspruch und sind so angesichts gegenwärtiger hitziger Diskussionen über eine mögliche  Verfassungswidrigkeit der AfD von höchster Bedeutung. Zugleich wird eine Untersuchung der Weiterentwicklung der Rechtsprechung in BVerfGE 144, 20 vorgenommen, um feststellen zu können, welche Bedeutung den in den Leitentscheidungen aufgestellten Grundsätzen für künftige Parteiverbote zukommen kann.

&lt;p&gt;&lt;b&gt;Explores the failures of family court and calls for immediate and permanent change&lt;/b&gt;&lt;br&gt;&lt;br&gt;At the turn of the twentieth century, American social reformers created the first juvenile court. They imagined a therapeutic court where informality, specially trained public servants, and a kindly, all-knowing judge would assist children and families. But the dream of a benevolent means of judicial problem-solving was never realized. A century later, children and families continue to be failed by this deeply flawed court.&lt;br&gt;&lt;br&gt;&lt;i&gt;The End of Family Court &lt;/i&gt;rejects the foundational premise that family court can do good when intervening in family life and challenges its endless reinvention to survive. Jane M. Spinak illustrates how the procedures and policies of modern family court are deeply entwined in a heritage of racism, a profound disdain for poverty, and assimilationist norms intent on fixing children and families who are different. And the court’s interventionist goals remain steeped in an approach to equity and well-being that demands individual rather than collective responsibility for the security and welfare of families.&lt;br&gt;&lt;br&gt;Spinak proposes concrete steps toward abolishing the court: shifting most family supports out of the court’s sphere, vastly reducing the types and number of matters that need court intervention, and ensuring that any case that requires legal adjudication has the due process protections of a court of law. She calls for strategies that center trusting and respecting the abilities of communities to create and sustain meaningful solutions for families. An abolitionist approach, in turn, celebrates a radical imagination that embraces and supports all families in a fair and equal economic and political democracy.&lt;/p&gt;

Research Paper (undergraduate) from the year 2021 in the subject Law - Civil Action / Lawsuit Law, grade: Distinction, Nottingham Trent University (Nottingham Law School), course: GDL / Bar, language: English, abstract: In November 2017, the author witnessed a Family Court in Nottingham allow a Litigant in Person (LiP) to serve legal notice to his partner (the absent respondent) through the medium of Facebook Messenger.  The issues were emotive:  The applicant urgently sought disclosure for the whereabouts of their infant children, with whom she had absconded from their home.  Evidence presented in Court showed the respondent had a history of substance abuse and mental illness.  Consequently, she and their children may have been at risk of physical harm. 
While the applicant did not know her physical location, he was able to demonstrate a history of regular, ongoing communication between them via social media.  After deliberation, the Judge, at his own instigation, allowed the plaintiff to serve notice, instructing disclosure via Facebook Messenger.  He stated his confidence that the respondent would receive and understand the notice and emphasised that the expediency of this method would enable the Court to “move quickly” to next steps, in the event of non-compliance by the respondent. 
This report seeks to assess the prevalence of the use of Social Media in Civil Procedure in the UK; its origins, legality and future integration.
