Payer le moins d'impôts et taxes possible, tel est le sens de l'optimisation fiscale. Cette démarche n'est pas réservée qu'aux seules multinationales qui défraient régulièrement l'actualité. Elle est à la portée de toutes les entreprises même les plus modestes. Point n'est nécessaire de concevoir forcément des montages juridiques sophistiqués. Il suffit souvent de revenir aux fondamentaux : maximiser les charges déductibles, minimiser les recettes et les bénéfices imposables, utiliser toutes les opportunités de défiscalisation offertes par l'Etat, privilégier une approche globale des situations fiscales de l'entreprise et de son dirigeant, sur le plan du bénéfice, des rêvenus, du patrimoine. C'est tout l'objet de cet ouvrage d'aider les professionnels à détecter les leviers d'action à leur disposition et prendre les décisions les moins onéreuses fiscalement, voire, en quelque sorte, de tendre vers une évasion fiscale totalement légale.</p>


In The Artful Aussie Tax Dodger Lex Fullarton studies the impact of 100 years of taxation legislation in Australia 1915–2016.  He finds that despite the lessons of a century of actions and reactions of taxpayers and administrators little changes—despite entering a new century old habits are hard to break.

At Federation on January 1, 1901, the Commonwealth of Australia was empowered to impose income tax on its citizens. However, it was not until September 3, 1915 that it began a century of ‘tax reform’ when its first Income Tax Assessment Act was introduced. For 100 years, driven by the winds of various political and social interests, Australia ‘reviewed and reformed’ its tax legislation.  Fullarton studies that transformation.

Fullarton’s examination considers the oldest of tax planning entities—the British Trust (‘received‘ in Australia at colonisation)—, the introduction of Australia’s ‘reformed‘ consumption tax—its VAT, referred to as Goods and Services Tax (GST) in Australia—, an analysis of tax avoidance schemes, and finally government taxation reform activities over the century.

Fullarton notes that, just one year into a new century of taxation, the Australian Federal Government put forward a proposal to go forward to the past by repealing certain sections of the Income Tax Assessment Act and transferring Income Taxing powers back to the Australian States, a position which existed prior to 1936.

This book looks at how Australia’s tax legislation was grounded, added to, avoided, and evolved, until it went ‘Back to the Future’. It is a collection of studies compiled from a rich mosaic of experience and research conducted over 20 years of involvement in taxation law in rural and remote Australia.

&lt;p&gt;This book provides a comprehensive overview of the implications of tax avoidance for a firm’s capital structure, highlighting the key role played by free cash flow and agency conflicts. First, the book provides an outline of the theories and empirical evidence concerning the role of taxes in the Theory of Capital Structure. It reviews the studies investigating the relationship between agency conflicts and capital structure. The book explores the role of free cash flow and agency conflicts in the relationship between tax avoidance and capital structure. In the final section, the results of an empirical investigation conducted on a sample of U.S. public firms are also presented. The empirical research examines whether and how tax avoidance is associated with debt covenant violation across the stages of the corporate life cycle. Specifically, the research uses the concept of the corporate life cycle stage to analyse whether and how the association between tax avoidance and debt covenant violation varies in different agency settings. Consistent with the hypotheses drawn on the Agency Theory, the findings of the empirical research suggest life cycle stages moderate the association between tax avoidance and debt covenant violation. &lt;/p&gt;&lt;p&gt;Overall, this book sheds light on the potential implications of tax avoidance activities for a firm’s capital structure.
