Practical Tools for Building High-Performance Legal Teams

Seminar paper from the year 2019 in the subject Economics - Industrial Economics, grade: 1,0, Saint-Petersburg State University of Economics, language: English, abstract: "The energy market is not just built by straightforward supply-and-demand mechanisms". Various environmental and legal factors shape and influence the overall interplay within this industry, resulting in direct or indirect consequences for all market players. Especially, in the context of contract theories, possible opportunistic behavior of any market player might appear and subsequently, create a market imbalance. The initial legal framework for the natural gas market was developed on short notice to protect the strategic intentions of energy suppliers. However, nowadays, the environment changed significantly, resulting in a possible shift of opportunistic behavior.Power markets are highly complex. Energy sources, such as oil, coal or natural gas, are the fuel for the world economy. Many market players depend on and try to influence the development of future energy prices, output volumes or distribution infrastructure. To ensure a fair interaction in this industry, trade aspects and related issues are contractually governed. However, while coal and crude oil are well-developed energy sources since centuries, natural gas was considered as possible energy alternative, only several decades ago. Within a very short period, a legal framework for the natural gas market had to be set-up, resulting nowadays in the revision and adjustment of this traditional contract model.

The Take-or-Pay Clause in Long-Term Natural Gas Contracts. Strategic Intention or Opportunistic Behavior?

Doctoral Thesis / Dissertation from the year 2018 in the subject Economics - Case Scenarios, , language: English, abstract: Publicly Owned Enterprises (POEs) in Kosovo are present largely in the market, with a focus on sectors such as electricity, railways, telecommunications, waste management, etc. This presence is followed by the constant need for subsidies from the government and weak financial and commercial performance. POEs in Kosovo are faced with numerous challenges including weak governance and management. Agency Theory is used widely as a tool with which to explain governance and functioning of organisations and companies. In addition, Agency Theory is used to explore relations between stakeholders in politics and the economy. This study first elaborates upon the applicability of Principal–Agent Theory in POEs in Kosovo and then identifies the presence of principal–agent problems and identifies the nexus between such problems and poor performance of POEs. Identification of principal–agent problems may help to identify the reason for poor performance of POEs and the lack of transparency, accountability and supervision. POEs are subsidised by the state on an annual basis, which makes the identification of problems in having profitable POEs important for public interests, too. Such importance is due not only to the fact that POEs are financed by taxpayers but also to the fact that they are supposed to provide services in public interests by being self-sustainable and profitable for the government as a shareholder. The study aims to conclude that principal–agent problems such as capture, rent-seeking, moral hazard, information asymmetry and adverse selection are present in POEs in Kosovo, and that they have a negative impact on their performance. Such principal–agent problems and their negative performance may also be influenced by gaps in legislation and weak law enforcement.

A clear and comprehensive overview of presidential impeachment from a leading expert in the field

As a result of Donald Trump’s presidency, impeachment was once again thrust into the spotlight of American political discussion. However, its history goes back to the very founding of the nation, when American colonists, remembering their grievances against their former king, entrenched the process in their new Constitution.

The Law of Presidential Impeachment breaks down both the law and politics of this process, providing a comprehensive, nonpartisan, and up-to-date explanation of the Constitution’s various mechanisms for holding presidents accountable for their misdeeds. Based on a lifetime of scholarly research, as well as unique experience as a witness and consultant in the impeachment trials of Bill Clinton and Donald Trump, Michael J. Gerhardt’s new book takes the reader back to the basics of presidential impeachments. Rather than provide reasons for or against impeaching particular presidents, he explains the law and procedures that govern impeachment, examining a number of significant, yet under-explored, issues and themes. Gerhardt offers new perspectives on the subject, arguing that it cannot be properly understood in a vacuum, but must instead be viewed in the context of its coordination with such other mechanisms as criminal prosecutions, censure, elections, congressional oversight, and the Fourteenth and Twenty-Fifth Amendments.

The Law of Presidential Impeachment will be an invaluable, accessible guide for future generations, giving them a succinct yet remarkably nuanced understanding of this core aspect of our executive branch and overarching governmental system.

50 Years of The Waitangi Tribunal

“Badfellas” takes the reader behind the scenes to reveal what it is like to be a trial lawyer in justice’s great arena, the courts of America. Mr. Roth writes from the vantage point of an attorney who had been a prosecutor, defense attorney and civil litigant for more than 40 years. His “badfellas” include drug traffickers, organized criminals, terrorists, murders, a pimp, a pedophile priest, and a TV talk show villain. He chooses 7 of his most intriguing cases and trials to tell his compelling story:
•	“The Smuggler and the Terrorist Prince”: The prosecution of America’s most wanted drug smuggler who became a hostage aboard an airliner hijacked by Pakistani terrorists.
•	“Welcome to Palermo”: The prosecution of the first Sicilian Connection heroin importation case, where the top echelon of an entire international smuggling operation was dismantled in coordinated trials in New York and Italy.
•	“The Charity That Wasn’t”: The trial of a gang of incorrigible criminals and murderers which used a charity as a front for their drug organization.
•	“Hush Money”: A lawsuit involving a pedophile priest and the Catholic’s Church’s unsuccessful attempts to conceal the clergyman’s crimes.
•	“The Mouth That Roared”: The defense of a popular television personality who was charged with assaulting a gay rights activist on his show.
•	“Tony Montana and the Bird Dog”: The defense of an Atlantic City pimp accused of laundering money for a 25-year-old crack kingpin who fancied himself the “Tony Montana” of Queens.
•	“The Bad Side of Mansfield”: A DEA Agent who faced the travails of a modern-day Job, all orchestrated by a rogue drug informant whose deceitful conduct turned the criminal justice system upside down.
