&lt;p&gt;Das Werk untersucht auf Grundlage eines Rechtsvergleichs mit dem englischen und US-amerikanischen Recht das Instrument der Dissenting Opinion auf seinen möglichen Einsatz und Nutzen im Handelsschiedsverfahren. Unter Heranziehung der Kommentarliteratur, Rechtsprechung und einer Expertenbefragung wird ein Regelungsvorschlag entwickelt, der auf den Erfahrungen der englischen und US-amerikanischen staatlichen Gerichte und Schiedsgerichte mit dem Verfahrensinstrument beruht. Die Dissertation hinterfragt die Skepsis, die deutsche Schiedspraktiker einem Instrument entgegenbringen, das fester Bestandteil anderer Rechtsordnungen geworden ist und prüft, ob eine solche Skepsis im internationalen Schiedsverfahren Platz finden kann. &lt;/p&gt;

Traditional trade, which primarily involved the exchange of physical goods, has now expanded to encompass a wide range of digitally delivered services, online transactions, and data flows. This transformation has been driven by advancements in technology and the increasing interconnectedness of the global economy. The digital economy encompasses various digital technologies and platforms and has become a significant driver of economic growth and innovation. It allows businesses to reach international markets more quickly and efficiently, transcending geographical barriers. The internet, mobile devices, cloud computing, and artificial intelligence have facilitated this digital transformation. These technologies enable seamless communication, data storage and processing, automation, and personalised services, revolutionising how businesses operate and engage in international trade.Digital trade has created new opportunities for businesses of all sizes. Small and medium-sized enterprises have benefited from the ability to access global markets through digital platforms and e-commerce. Research Paper (postgraduate) from the year 2023 in the subject Law - European and International Law, Intellectual Properties, grade: 72, University of Kent, course: Contemporary Topics in IP Law, language: English, abstract: This Paper argues that the EU needs to adopt a harmonised policy framework promoting the right to repair and limiting manufacturers’ use of IPRs on software to restrict repair rights which ultimately impacts the achievement of sustainability goals. Part B begins with the origins of the right to repair movement and its significance. Part C discusses restrictions on repair rights, including the role of IPRs. Part D discusses how the EU legal framework recognises repair rights and contrasts this with the Australian approach. Part E discusses the suggestions of scholars on reforms to the EU legal framework to better tackle restrictions on repair rights.Modern electronics constitute not only the hardware in the device itself but also the embedded software that is critical to the device’s functionality. This software is usually pre-installed on the device by the manufacturer to run all its basic operations. This integration of software systems to devices, sometimes called the "softening of hardware",  requires the intervention of intellectual property rights (IPRs) to delineate the blurry lines separating the device and its functional components in software.  Consequently, manufacturers use IPRs on the embedded software to limit the consumer’s control over a device and effectively lock them out from doing basic repairs to restore functionality. These limitations discourage many consumers from pursuing repairs in favour of purchasing new devices and discarding the faulty ones. The result is a linear model of consumption and a throw away culture contributing to large amounts of electronics waste (e-waste) disposed worldwide.  In 2019, consumer electronics comprised 54 million Metric Tons of e-waste, with Europe contributing 12 million Metric Tons.  Worse still, the effects of e-waste pileups have for decades flowed downstream from developed to developing countries. In response, the European Union (EU) has focused on achieving a circular economy to reduce e-waste by extending the lifespan and usability of products through, inter alia, recognising the right to repair movement.

The question explored in this book is how contracts can manage uncertainties. Commercial parties face uncertainties on a regular basis. Market fluctuations, new laws and regulations, pandemics, rapid technology advancements, and geopolitical tensions are all examples of events whose nature cannot be easily foreseen or captured by the contractual parties' expectations. One possible way of addressing the uncertainty generated by such risks and events is through reliance on established contractual doctrines, such as variation or frustration. Under English law, these doctrines are traditionally limited. Another, and typically preferable, method is for contract drafters to include clauses that modify, suspend, or terminate the obligations or liabilities of one (or both) of the parties, or clauses that at least open up the options for renegotiation. Examples include material adverse change (or effect) clauses, hardship clauses, performance clauses, termination or suspension clauses, remedies clauses, and variation clauses. Such clauses raise a range of issues concerning their interpretation, effect and enforceability; the consequences that follow when the clauses do not work as planned; the consequences of allocating contractual discretion to a party to determine the existence of the relevant risk or event; and the extent to which the existence of specific clauses changes the options available to the parties beyond what general contract law principles offer. E-commerce brings with it many pros and cons. In addition, it significantly affects agreements between the various players of competition law. This research paper seeks to analyse the impact of e-commerce on vertical agreements, particularly, selective distribution agreements. Vertical agreements are agreements which are entered into by undertakings or firms which operate at different levels of the market. Selective distribution systems are a type of vertical agreement within which a supplier sells goods or services to distributors who are obliged to sell these goods or services based on specific criteria. Throughout this paper, the repercussions of e-commerce which are experienced by manufacturers, distributors and consumers will be examined in order to determine the role and effect of e-commerce on selective distribution systems. There will also be critical examination of the rules governing vertical agreements in the European Union and an assessment of their appropriateness and applicability. The pertinency of the aforementioned rules will be discussed and recommendations will be made accordingly.Both primary and secondary sources are to be utilized in the execution of this research paper.
