&lt;p&gt;This is the first socio-legal multi-jurisdictional study on hazing (ragging). This book considers four countries: the USA, India, Sri Lanka, and Australia. It states the legal position, identifies lacunas in law, and proposes possible legal solutions. Unfortunately, laws, regulations, and policies have failed to stamp out hazing from university campuses and residential colleges.&lt;/p&gt;&lt;p&gt;Hazing has spiralled out of control in a number of countries. It has descended into a cruel, barbaric, and inhuman practice. The number of students subjected to hazing and sexual abuse is alarming. According to a 2022 survey, more than half (53%) of American students who were part of a fraternity or sorority experienced hazing. Students are murdered, harmed, abused, and suffer long-term trauma. The prevention of hazing is one of the most important responsibilities of 21st century universities.&lt;/p&gt;&lt;p&gt;The theme of the book is that universities are in the best position to protect students from hazing and must play a vital role. As a sociological study, the book also considers why hazing occurs and what can be done to prevent it. Without engaging with the underlying causes, legal punitive measures continue to address the symptom rather than the cause. The book, therefore, explores how a more innovative approach to regulation can help tackle the cause.&lt;/p&gt;&lt;p&gt;The book will be of interest to policy makers, regulators at universities, education and legal academics, and personal injury lawyers.&lt;/p&gt;&lt;p&gt;&lt;/p&gt;

Hazing (Ragging) at Universities: A Legal Perspective

&lt;p&gt;Sowohl internationale Gerichtsstandsvereinbarungen als auch Schiedsvereinbarungen ermöglichen es Vertragsparteien, im Voraus zu regeln, wo und auf welche Weise potenziell entstehende Streitigkeiten beigelegt werden. Dass beide Arten von Vereinbarungen dieselbe Funktion erfüllen, spiegelt sich nicht in der Gesetzessystematik wider. Während Gerichtsstandsvereinbarungen insbesondere in §§ 38 und 40 ZPO und der Brüssel Ia-VO geregelt sind, gelten für Schiedsvereinbarungen das zehnte Buch der ZPO und völkerrechtliche Übereinkommen. Die Arbeit untersucht und vergleicht die einschlägigen Regelungen in sieben Rechtsquellen. Dabei zeigt sie neben Gemeinsamkeiten auch Widersprüche, die etwa im Bereich des Verbraucherschutzes bestehen.&lt;/p&gt;

&lt;p&gt;Die Verschwendung öffentlicher Gelder ist ein ernstzunehmendes Problem, nicht nur in Deutschland, sondern in der ganzen Welt. Es vergeht kein Tag, an dem die Bevölkerung nicht von einem Skandal im Zusammenhang mit öffentlicher Korruption erfährt. Reicht aber das geltende Strafrecht aus, um diese Art von Fehlverhalten zu bestrafen? Oder besteht eine sog. Strafbarkeitslücke, die verhindert, dass solche Verhaltensweise strafrechtlich geahndet werden? In diesem Buch versucht die Autorin, diese Fragen zu beantworten. Zunächst befasst sie sich mit der Frage, inwieweit der Straftatbestand der Untreue (§ 266 StGB) ausreichend ist, um die zweckwidrige bzw. missbräuchliche Verwendung öffentlicher Mittel straf-rechtlich zu erfassen. Anschließend befasst sich die Autorin mit dem Begriff der Strafbarkeitslücke und analysiert die Möglichkeit ihres Bestehens im Zusammenhang mit der Veruntreuung öffentlicher Mittel in Deutschland. Schließlich erörtert sie einige Alternativen zur Schließung einer etwaigen Strafbarkeitslücke und führt Beispiele für eine Regelung auf der Grundlage ausländischer Rechtsordnungen an.&lt;/p&gt;

Die strafrechtliche Erfassung von Fehlverhalten bei dem Umgang mit öffentlichen Mitteln

Academic Paper from the year 2024 in the subject Law - European and International Law, Intellectual Properties, grade: 28/30, Bocconi University, course: European and International Advanced IP Law, language: English, abstract: This paper aims to explore the interplay between trademark law and the often-elusive concept of bad faith against the backdrop of protecting the Champagne Geographical Indication by examining the case of CIVC and INAO v. Keep Waddling International Pte. Ltd. [2020] SGIPOS 10 and its implications within trademark and GI jurisprudence. 

The unique reputation of champagne is guaranteed by the protection afforded by the Champagne GI, a type of intellectual property right primarily cited in the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), ensuring that the label champagne can only be used for sparkling wines produced from certain grape varieties grown in the eponymous region in France. Protecting the appellation of origin reassures the consumer product authenticity and the strict restraints on the words use by the CIVC and INAO is motivated by the anticipation of the term and therefore the product of champagne becoming arbitrary and universal with unlimited use. 

The degree of similarity of terms and the therefore resulting likelihood of confusion for the consumer plays an essential role in deciding whether signs for products manufactured outside the Champagne region can be granted legal protection or not. In the case considered, the inclusion of "ChamPeng" in the Applicant’s trademark led to the refusal of its protection, not because the trademark would not meet the necessary registration requirements, but because its similarity to the champagne term gave inference for bad faith. Since the case’s dispute does not arise from a false claim or deceptive information, it particularly diverges from traditionally established bad faith categories. Therefore, the following question arises: How does the case contribute to the conduct of protection of GIs in trademark law?

The examination of the aforementioned issue will involve a comprehensive review of the case under consideration. Initially, the legal foundations and the Applicant's claims that prompted the legal proceedings will be outlined to establish the legal basis of the case. Subsequently, attention will be directed towards presenting the counterpart’s position, providing insights into the potential resolution of the dispute afterwards. Finally, the Court's ultimate decision will be scrutinized to discern its potential impact on enhancing the broader legal framework and in its challenging of conventional boundaries within trademark jurisprudence.

Protecting Champagne as a Geographical Indication. The ChamPengWine Case

        &lt;p&gt;Die Untersuchung befasst sich mit der Notwendigkeit einer Harmonisierung der Verfolgungsverjährung in der Europäischen Union. Eine solche Notwendigkeit begründet der Autor mit den gravierenden Unterschieden zwischen den nationalen Verjährungsregelungen in der EU und den daraus resultierenden negativen Auswirkungen auf die justizielle Zusammenarbeit in Strafsachen. Nach einer umfassenden Analyse der Rechtsetzungs- und Harmonisierungskompetenzen der EU in Bezug auf die Verfolgungsverjährung gelangt der Autor zu dem Schluss, dass sich eine nennenswerte Angleichung des Verjährungsrechts nur durch freiwillige Reformen in den Mitgliedstaaten erreichen lässt. Den Anstoß hierzu könnte eine Europäische Modellregelung zur Verjährung liefern.&lt;/p&gt;

E-commerce brings with it many pros and cons. In addition, it significantly affects agreements between the various players of competition law. This research paper seeks to analyse the impact of e-commerce on vertical agreements, particularly, selective distribution agreements. Vertical agreements are agreements which are entered into by undertakings or firms which operate at different levels of the market. Selective distribution systems are a type of vertical agreement within which a supplier sells goods or services to distributors who are obliged to sell these goods or services based on specific criteria. Throughout this paper, the repercussions of e-commerce which are experienced by manufacturers, distributors and consumers will be examined in order to determine the role and effect of e-commerce on selective distribution systems. There will also be critical examination of the rules governing vertical agreements in the European Union and an assessment of their appropriateness and applicability. The pertinency of the aforementioned rules will be discussed and recommendations will be made accordingly.Both primary and secondary sources are to be utilized in the execution of this research paper. Through a critical examination of such materials, there will be thorough analysis of the primary focus of this paper, the impact of e-commerce on selective distribution systems.

Especially, in the context of contract theories, possible opportunistic behavior of any market player might appear and subsequently, create a market imbalance. The initial legal framework for the natural gas market was developed on short notice to protect the strategic intentions of energy suppliers. However, nowadays, the environment changed significantly, resulting in a possible shift of opportunistic behavior.Power markets are highly complex. Energy sources, such as oil, coal or natural gas, are the fuel for the world economy. Many market players depend on and try to influence the development of future energy prices, output volumes or distribution infrastructure. To ensure a fair interaction in this industry, trade aspects and related issues are contractually governed. However, while coal and crude oil are well-developed energy sources since centuries, natural gas was considered as possible energy alternative, only several decades ago. Within a very short period, a legal framework for the natural gas market had to be set-up, resulting nowadays in the revision and adjustment of this traditional contract model.

The Take-or-Pay Clause in Long-Term Natural Gas Contracts. Strategic Intention or Opportunistic Behavior?

Doctoral Thesis / Dissertation from the year 2018 in the subject Economics - Case Scenarios, , language: English, abstract: Publicly Owned Enterprises (POEs) in Kosovo are present largely in the market, with a focus on sectors such as electricity, railways, telecommunications, waste management, etc. This presence is followed by the constant need for subsidies from the government and weak financial and commercial performance. POEs in Kosovo are faced with numerous challenges including weak governance and management. Agency Theory is used widely as a tool with which to explain governance and functioning of organisations and companies. In addition, Agency Theory is used to explore relations between stakeholders in politics and the economy. This study first elaborates upon the applicability of Principal–Agent Theory in POEs in Kosovo and then identifies the presence of principal–agent problems and identifies the nexus between such problems and poor performance of POEs. Identification of principal–agent problems may help to identify the reason for poor performance of POEs and the lack of transparency, accountability and supervision. POEs are subsidised by the state on an annual basis, which makes the identification of problems in having profitable POEs important for public interests, too. Such importance is due not only to the fact that POEs are financed by taxpayers but also to the fact that they are supposed to provide services in public interests by being self-sustainable and profitable for the government as a shareholder. The study aims to conclude that principal–agent problems such as capture, rent-seeking, moral hazard, information asymmetry and adverse selection are present in POEs in Kosovo, and that they have a negative impact on their performance. Such principal–agent problems and their negative performance may also be influenced by gaps in legislation and weak law enforcement.
