Mit dem Diakonischen Corporate Governance Kodex hat der Diskurs um die Unternehmensverfassung in der Diakonie zweifelsohne eine qualitativ neue Ebene erreicht. Warum aber stellt sich Corporate Governance überhaupt als Problem auch für diakonische Organisationen dar - und worin besteht es? Wie lässt sich die Notwendigkeit von Corporate Governance ökonomisch und organisationstheoretisch begründen? Woher leiten wir unser Wissen über die in solchen "Standards guter Unternehmensführung" unterstellten Zusammenhänge ab? Und was ist darauf für die Corporate Governance diakonischer Unternehmen abzuleiten? 
 

 Die theoretische Verortung des Diskurses um die Corporate Governance und deren Kodifikation macht Grundfragen der Verfassung diakonischer Unternehmen fruchtbar für deren praktische Gestaltung.

 With the Diaconal Corporate Governance Code, the discourse on corporate governance in diaconal organizations has undoubtedly reached a qualitatively new level. But why does corporate governance pose a problem for diaconal organizations in the first place - and what does it consist of? How can the necessity of corporate governance be justified from an economic and organizational theory perspective? Where do we derive our knowledge of the relationships assumed in such 'standards of good corporate governance'? And what can be derived from this for the corporate governance of diaconal organizations? 
 

 The theoretical positioning of the discourse on corporate governance and its codification makes fundamental questions about the constitution of diaconal organizations fruitful for their practical design.

This book provides the first detailed analysis of the decision to prosecute made by the statutory Australian Offices of Director of Prosecution.

It examines the system of prosecution as part of the executive branch of government, and the role and challenges of the individual prosecutors who make decisions within the system. It explores the tension between prosecutorial independence and prosecutorial accountability, and the paradox that political involvement in prosecutions is necessary for accountability and to uphold the public interest, but can compromise independence. 

The book makes a unique contribution to both Australian criminal law scholarship and to the international literature on criminal prosecution, by drawing on the sub-disciplines of criminal law and administrative law. It includes case studies on prosecuting child sexual abuse, rape, and government espionage, and comparisons with common law and civil law countries including the USA, the UK, Italy and South Africa.

A troubling account of the unexpected impacts of treatment-based alternatives to criminal punishment. Every year, courts send hundreds of thousands of people to treatment-based programs as alternatives to traditional punishment. These alternatives--known as 'diversion programs'--are widely celebrated as reforms that reduce the punishment of the mentally ill. But in Trial by Treatment, Mary Ellen Stitt shows that they have, in fact, expanded the reach of the criminal legal system and its power over the lives of the most vulnerable. The inner workings of diversion programs are obscure, partially by design, and data on outcomes is hard to come by. Stitt draws on two years of fieldwork in criminal courtrooms and court-mandated treatment sessions, as well as an original national dataset, in-depth interviews, and experimental survey data, to document the hidden impacts of diversion. She shows that placing mental healthcare under the control of the courts has helped to legitimize the criminalization of illness, warped treatment environments, and amplified inequalities in punishment. In vivid and humanizing detail, Trial by Treatment shows how reforms that keep power and discretion in the same hands can entrench the very problems they promised to solve.
