&lt;p&gt;Dieses Buch untersucht die rechtlichen Fragen, die sich im Rahmen der ärztlichen Behandlung transidenter und intersexueller Minderjähriger stellen. Im ersten Teil des Werkes werden die medizinisch-biologischen Grundlagen von Transidentität und Intersexualität sowie der medizinische und gesellschaftliche Umgang mit beiden Phänomenen dargestellt. Anschließend folgt eine Auseinandersetzung mit der Bedeutung des Geschlechts im Recht und der personenstandrechtlichen Behandlung transidenter und intersexueller Personen. Im darauffolgenden Hauptteil des Werkes werden zunächst die allgemeinen Voraussetzungen rechtmäßigen ärztlichen Handelns analysiert und sodann auf die speziellen Fallgruppen der Transidentität und Intersexualität angewendet, wobei ein besonderes Augenmerk auf die Indikationsstellung und die Einwilligung durch einen Minderjährigen selbst beziehungsweise durch die sorgeberechtigten Eltern gelegt wird. Zudem erfolgt eine vertiefte Analyse des § 1631e BGB. Schließlich wird die rechtliche Behandlung beider Fallgruppen unter Berücksichtigung der bestehenden tatsächlichen Unterschiede in einen Vergleich gesetzt und die Frage erörtert, ob die aktuelle Rechtslage den jeweiligen spezifischen Anliegen beider Fallgruppen gerecht wird.&lt;/p&gt;&lt;p&gt;&lt;/p&gt;&lt;p&gt;&lt;/p&gt;

Rechtmäßigkeit ärztlicher Maßnahmen an transidenten und intersexuellen Minderjährigen

Im Zuge der Kodifizierung des Patientenrechtegesetzes im Februar 2013 normierte der Gesetzgeber in § 630c Abs. 2 Satz 2 BGB eine vertragliche Offenbarungspflicht des Behandelnden und ergänzte diese in § 630c Abs. 2 Satz 3 BGB um ein sog. Beweisverwendungsverbot. Dieser Regelungskomplex wurde innerhalb des rechtswissenschaftlichen Diskurses als eine der wenigen sachlichen Innovationen, die mit der Kodifizierung des Patientenrechtegesetzes einhergingen, gewertet. Das vorliegende Buch analysiert die konkrete Ausgestaltung der überaus kontrovers diskutierten Normierung und bettet sie in den Gesamtkontext fehlerbezogener Auskunfts- und Informationspflichten ein. Das Werk beleuchtet zudem die Frage, inwiefern über § 630c Abs. 2 Satz 2 BGB hinausgehende ärztliche (Fehler-)Offenbarungspflichten nach geltender Rechtslage existieren und zeigt rechtspolitische Ideen und Anreize zur Effektivierung der Offenbarungspflicht auf.

&lt;p&gt;Triage decision-making during a pandemic is linked to complex ethical, medical, and legal dilemmas, which in the past have been discussed mainly based on hypothetical scenarios. The crisis caused by Covid-19 has shown these dilemmas to be very real, and many countries faced significant health care challenges during the pandemic. The book presents different views on the problems of triage during the time of Covid-19 and to shed a light on how various countries approached triage during the pandemic.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;The absence of staff and resources in many countries opened a discussion of whether they should strive for the most egalitarian way of deciding whom to help with limited resources or to act in a utilitarian manner and establish a triage system based on saving as many people as possible. There were so-called conflicts of duty in many parts of the world, and decision-makers who had to choose which patients would survive in the absence of resources were under tremendous pressure. This book presents different views on the issue of such decision-making from legal, ethical, and medical points of view. The authors explain the origin of the concept of triage and its use in modern medicine. They point out the distinction between triage and the allocation of resources while also analysing how pandemic triage differs from emergency and disaster triage.&lt;/p&gt;
