In The Unknowable Body, Lisa Jean Moore explores the profound disconnect between how we experience our bodies and how the medical world interprets them. Drawing on her own journey through DCIS diagnosis, mastectomy, and reconstruction - alongside her family's navigation of her ex-partner's brain tumour - Moore investigates various unsettling dimensions of bodily uncertainty that emerge when illness enters our lives. As scans revealed secrets that human perception failed to, and while navigating a queer family system that didn't fit institutional categories, the author found herself in territory few roadmaps could chart. This book weaves candid humour and poetic personal narrative and analytical vision to examine how bodies resist complete knowing - medically, emotionally, in time, and through gender and identity. It offers new ways of thinking about embodiment in an age of increasing medical surveillance, technological intervention, and economically profitable uncertainty. What began as an investigation into cancer treatment evolved into a deeper exploration of how bodies exceed our frameworks for understanding. Whether through scans that simultaneously reveal and obscure, emotional reverberations that transform family systems, temporal disruptions that fracture our sense of before and after, or gender expectations that shape medical encounters, our bodies remain fundamentally mysterious even as we attempt to make them knowable. Das Problem der Wirklichkeitstreue rückt die ethische Dimension von Mimesis in den Blick. Ziel des Bandes ist es, die polyvalente Treue-Semantik auf ihre Brauchbarkeit für die Beobachtung des Realismus zu befragen. Das geschieht in Studien zu Stifter, Fontane, Keller, C.F. Meyer, Flaubert u.a.
Die Semantik der Treue bezieht sich auf eine Ästhetik der Genauigkeit und eine Beziehung der Loyalität gleichermaßen: Im Ehe- und Ehebruchsroman birgt gerade die Ambivalenz der Semantik (Treue zum Anderen, Treue zu sich) ein schier unerschöpfliches Potential der narrativen Konfliktgestaltung. Politisch wird Herrschaftstreue im Programmrealismus nach 1848 vorausgesetzt, konfligiert allerdings mit dem Verlangen nach Gegenwartsromanen und der demokratischen Aufwertung aller möglichen Stoffe. This book connects European private international law with decolonial theory. Decolonial theory calls for alternative modes of producing legal knowledge - ones that give greater weight to the worldviews of formerly colonised peoples across the globe, including in Europe. At the same time, private international law has been described as a particularly suitable field for welcoming more otherness (altérité) in European law. This book therefore develops a decolonial theory of European private international law. To do so, it begins with Western court cases involving what the author terms a 'conflict of worldviews': a clash between the legal frameworks governing the dispute and the worldviews of the formerly colonised parties involved, referred to here as 'postcolonised worldviews'. Through three case studies - respectively addressing religious arbitration, Indigenous sacred land, and faith-based politics - the book demonstrates that courts routinely overlook these conflicts. As a result, the claims of formerly colonised parties are inadequately addressed. To remedy this structural discrimination within European private international law, the book proposes a pluralised theory of choice of court, foreign law, and international jurisdiction, more empowering of the postcolonised worldviews present in the case studies, and supportive of the emancipation of vulnerable identities among postcolonised people. This is an important work, thought-provoking and challenging, which should be read by private international law and comparative law scholars, and more generally by legal and non-legal scholars interested in legal theory and decoloniality.

This book seeks answers to two basic questions: What are normative rules and how can and should we apply them? It takes a fresh look both at legal reasoning as a process and normative rules as instruments. On the one hand, based on a decision-making model, it suggests a more practical approach to rule application that isn’t limited to interpretation, but includes searching, evaluation and choice. On the other hand, it proposes a more precise structure for normative rules that includes not only their scope and normative consequences, but also their circumstances and purposes. It then goes on to study such features as their open- and mandatoriness as well as their generality, vagueness and ambiguity, and examines how these features impact the rules’ breadth and the discretion they offer in terms of their application. Lastly, it considers how these aspects affect rules’ validity, binding- and effectiveness. Because the application of normative rules requires a basis in evidence, the book also includes a discussion of fact-finding and points to some interesting similarities between the philosophies of law and science.&nbsp;
