Eyeless in Gaza… and Beyond

Wildfires are only one of the major threats and challenges that the nation addresses very inadequately. America had been a Beacon of Freedom to many, yet today it fails to live up to its credo, “life, liberty, and the pursuit of happiness.” It is wracked with turmoil ranging from an out-of-control pandemic to racial and political unrest that has resulted in violence even in the sacred halls of its Capitol. Its economic system concentrates wealth at the top levels of society, while millions struggle for a living wage and governments at all levels have inadequate resources. Since the overwhelming Soviet threat of nuclear devastation receded into the background, the nation faces a wide range of diffuse threats including Islamic radicalism, autocratic governments, global refugee flows, cyber intrusions, and global warming. A National Strategy is badly needed to balance the allocation of resources to best address the totality of threats and challenges facing the nation. That is the focus of this book.

&lt;div&gt;&lt;br&gt;&lt;/div&gt;&lt;div&gt;&lt;div&gt;This book explores how International Humanitarian Law (IHL) has been developed in the jurisprudence and practice of the International Criminal Court (ICC). A partial focus is given to the phenomenon of child soldiering which became symptomatic for the early practice of the ICC. The book provides readers with broad insight into the activity of the ICC. The first part contains chapters focused on the methodology of law-finding before the ICC, i.e., identification, interpretation, and application of the law. The authors address complex issues concerning the mutual relationship between treaty law (Article 8 of the ICC Statute) and customary international (humanitarian) law and explore the relevance of IHRL in the application and interpretation of Article 8 of the Rome Statute. The second part consists of chapters focused on substantive international criminal law. The authors address issues concerning contextual elements of war crimes, passive personal scope of IHL,denying judicial guarantees as a serious breach of IHL, forms of responsibility, and circumstances precluding wrongfulness.&lt;br&gt;&lt;/div&gt;&lt;/div&gt;

ICC Jurisprudence and the Development of International Humanitarian Law

The International Crimes Tribunal in Bangladesh was established in 2010 with the aim of bringing to trial perpetrators of crimes committed during the Liberation War in 1971, through which the country seceded from Pakistan. The International Crimes Tribunal is a domestic tribunal based on the International Crimes Tribunals Act from 1973 and the Rules of Procedure enacted by the Tribunal itself. The initiation of these trials almost 40 years after the war entails several challenges. The publication examines to what extent the Tribunal's legal framework as well as its jurisprudence comply with international standards as established in international treaties, customary international law and in the jurisprudence of international criminal law. To this end, the substantive law and its interpretation as well as the procedural standards applied at these trials are examined thoroughly. At the same time, the analysis takes into account the political environment surrounding the Tribunal's work and assesses its impact on the country's process of coming to terms with the past.

&lt;p&gt;This book provides a critical discussion of the way in which religion influences: criminal and antisocial behaviour, punishment and the law, intergroup conflict and peace-making, and the rehabilitation of offenders. The authors argue that in order to understand how religion is related to each of these domains it is essential to recognise the evolutionary origins of religion as well as how genetic and cultural evolutionary processes have shaped its essential characteristics. Durrant and Poppelwell posit that the capacity of religion to bind individuals into socially cohesive ‘moral communities’ can help us to understand its complex relationship with cooperation, crime, punishment, inter-group conflict and forgiveness. This book develops the discourse on the experiences of ex-combatants and their transition from war to peace, from the perspective of scholars across disciplines. Ex-combatants are often overlooked and ignored in the post-conflict search for memory and understanding, resulting in their voice being excluded or distorted. This collection seeks to disclose something of the lived experience of ex-combatants who have made the transition from war to peace to help to understand some of the difficulties they have encountered in social and emotional reintegration in the wake of combat. These include: motivations and mobilizations to participation in military struggle; the material difficulties experienced in social reintegration after the war; the emotional legacies of conflict; the discourses they utilize to reconcile their past in a society moving forward from conflict toward peace; and ex-combatants’ subsequent engagement – or not – in peacebuilding. It also examines the contributions that former combatants have made to post-conflict compromise, reconciliation and peacebuilding. It focusses on male non-state actors, women, child soldiers and, unusually, state veterans, and complements previous volumes which captured the voices of victims in Northern Ireland, South Africa and Sri Lanka.         &lt;p&gt;Unter dem Begriff des Gesamttatelements nimmt diese Arbeit eine erstmalige rechtsdogmatische Erfassung der tatbestandlichen Kollektivität in Völkerstraftaten vor. Dieses Gesamttatelement ist Alleinstellungsmerkmal der Völkerrechtsverbrechen gegenüber Straftaten nach nationalem Recht. Die rechtsdogmatische Analyse der Arbeit nimmt neben der für die Einordnung in der Straftatsystematik maßgebende Unrechtsrelevanz auch die Erfassung eines legitimen Zurechnungsmechanismus zwischen kollektivem Geschehen und strafrechtlicher Schuld des Individuums in den Blick. Die Ergebnisse der rechtsdogmatischen Analyse werden sodann an Instituten des „allgemeinen“ Teils des IStGH-Status der Überprüfung unterzogen.&lt;/p&gt;

Something dramatic happened in the late summer and autumn of 2008. The post-Cold War world came to an abrupt end. This was the result of two conjoined crises. First, in its brief war with Georgia in August 2008, Russia asserted its military power to halt the expansion of NATO to its very borders. Secondly, on 15 September 2008 the Wall Street investment bank Lehman Brothers collapsed. This precipitated a severe financial crash and helped to push the world economy into the worst slump since the 1930s.  &lt;p&gt; Both crises marked a severe setback for the global power of the United States, which had driven NATO expansion and forced through the liberalization of financial markets. More broadly they challenged the consensus that had reigned since the collapse of the Soviet bloc in 1989 that a US-orchestrated liberal capitalist order could offer the world peace and prosperity. Already badly damaged by the Iraq debacle, this consensus has now suffered potentially fatal blows.&lt;/p&gt;  &lt;p&gt; In &lt;i&gt;Bonfire of Illusions&lt;/i&gt; Alex Callinicos explores these twin crises. He traces the credit crunch that developed in 2007-8 to a much more protracted crisis of overaccumulation and profitability that has gripped global capitalism since the late 1960s. He also confronts the interaction between economic and geopolitical events, highlighting the new assertiveness of nation-states and analysing the tense, complex relationship of interdependence and conflict that binds together the US and China. Finally, in response to the revelation that the market is not the solution to the world's problems, Callinicos reviews the prospects for alternatives to capitalism.&lt;/p&gt;

The reality are new big wars like the war in Irak, Afghanistan, Islamic countries in Africas. It is also the reality, that Transnational Companies make a big profit from all this problems whitout respect for Human Rights.         &lt;p&gt;Die interdisziplinäre Tagung „Krieg in der Ukraine: Perspektiven“ fand vom 30. August–1. September 2023 in Münster statt. Veranstalter war die Deutsche Hochschule der Polizei (DHPol) in Münster. Thematisiert wurden die Hintergründe und Herausforderungen des fortdauernden russischen Angriffskrieges gegen die Ukraine, Möglichkeiten seiner Beendigung sowie Rahmenbedingungen einer stabilen und wehrhaften internationalen Friedensordnung aus völker(straf)rechtlicher, außenpolitischer und polizeipraktischer Perspektive. Der Tagungsband enthält ausgewählte Tagungsvorträge.
