This Palgrave Pivot offers a groundbreaking reassessment of the concept of slavery in the Bible. Taking an interdisciplinary perspective, it interweaves historical semantics with an analysis of language to argue that slavery as it is primarily understood today – as a legal institution which reduced individuals involuntarily to the status of property - was not legitimized by biblical doctrine.
 The book presents a concise, accessible argument, focused around the translation of the Bible into English and the use of the language of slavery. The term ‘slavery’, emerging in the sixteenth century, was at first used to identify a condition of dishonour, as well as a system of forced labour, and it was only in the seventeenth century that it came to be equated with the Roman institution of 
 servitus
 , and in the eighteenth with the ownership of people as property. As a result, and uniquely among studies of slavery in the Bible, this book does not seek to engage in debates about whether or not the Bible supported slavery, claiming the premise itself is mistaken. The idea that slavery was an ancient legal institution that reduced individuals involuntarily to the status of property is a product of modernity.
 This book has far-reaching implications for a range of disciplines including economic and legal history and biblical scholarship as well as slavery studies.Judith M. Spicksley 
 is an economic and social historian with an interest in language. She worked in the Department of Economics at the University of York and in the Wilberforce Institute at the University of Hull. An Intellectual History of Migration Law and Policy c.1535-2020

This book provides the first in-depth study of the crime of bigamy from the 17th century to the present day. Between 1604 and 2024, around 30,000 individuals were prosecuted for bigamy in England and Wales. A few were able to establish a defence to the charge, but most were convicted. How they were punished varied hugely across the centuries - from execution, branding, whipping, transportation, and imprisonment through to fines and community service. Double Trouble details the legal framework that underpinned such prosecutions. As a companion volume to Double Lives: Stories of Bigamy in England and Wales, 1604-2024, it sets the offence in the context of the changing laws on marriage and divorce, and examines the consequences of bigamy for those involved, including the remedies that were available to the often-deceived second spouse. Drawing on a wide array of sources from the 17th century to the present day, including formal law reports, legal treatises, newspapers, censuses, parish registers, divorce petitions and Parliamentary debates, this book shows how bigamy should be taken seriously as an offence that all too often involved deception, abandonment and heartbreak.

This book investigates the structural limits of the principle of party initiative and the rule of congruence within the contemporary civil procedural system, with a primary focus on Brazilian law and a comparative outlook that resonates with other legal traditions. It critically examines how the liberal-individualist foundations of civil procedure—rooted in 18th- and 19th-century private law—continue to shape the concepts of jurisdiction, action, defense, and process, often in ways that are misaligned with the collective and complex nature of modern legal disputes.Through the lens of financial compensation for mineral exploitation, the work explores the dual role of the Public Power as both rights-holder and representative of diffuse interests, revealing the inadequacy of traditional procedural categories in addressing collective claims. This tension underscores the need to rethink the procedural framework, especially when the judiciary is called upon to act beyond the strict confines of party-submitted claims.The book proposes a shift toward a more systemic and public-oriented understanding of judicial activity, grounded in the principle of proportionality—understood here in its pan-procedural dimension. Rather than evaluating procedural guarantees solely within the boundaries of individual cases, it advocates for a broader analysis that considers the efficiency and legitimacy of the judiciary as a public service. Drawing on constitutional principles and comparative jurisprudence, it argues that judicial decisions must be guided by a balance between means and ends, ensuring that interventions are not only legally sound but also socially and economically justified.This approach is further developed through a critical analysis of the classification of legal actions and the effects of judicial decisions. The book revisits traditional distinctions—declaratory, constitutive, condemnatory, mandamental, and executive—highlighting their historical evolution and practical limitations. It challenges the rigidity of these categories, especially in contexts such as third-party embargoes and fraud against creditors, where procedural formalism can hinder effective legal protection. The discussion extends to the controversial admissibility of declaratory actions on facts, advocating for a more pragmatic and flexible interpretation that aligns with the realities of legal uncertainty and the need for judicial affirmation of rights and obligations.This work offers a renewed theoretical and practical framework for understanding the boundaries of judicial action. By integrating the principles of proportionality and adequate representation into the heart of procedural reasoning, it seeks to reconcile the individualistic origins of civil procedure with the demands of a complex, pluralistic, and constitutionally committed legal order.

The Dala Law is known through only one remaining medieval manuscript, written c.1335 - 1353, and shows strong influence from older Swedish provincial law. It is one of the oldest known texts revealing details of life and conditions in medieval Dalar during the thirteenth and early fourteenth centuries.Contradicting older assumptions that this might have been an older law of Västmanland, the Dala Law is well adapted to prevailing conditions in medieval Dalarna Dalar. In contrast to most provincial laws where the lawman had a central position, in the Dala Law it is the written word, the law-book, that is addressed and appealed to. Although the text is comparatively short, this English translation is an important tool for facilitating the internationalisation of Swedish research and making Nordic material more accessible for international scholars. Aided by maps which show medieval Dalarna, Västmanland, and the value of the mining industry in the area, this text provides crucial insight into the history, life, and culture of medieval Dalar which has never been seen before in the English language.With an Introduction that places medieval Darlarna Dalar in its geographical, judicial and ecclesiastical contexts, The Dala Law is an essential resource for all students and scholars interested in medieval Swedish history and law.

For centuries, the Latin notarial system has evolved in response to society's growing demand for legal certainty. Yet the increasing complexity of economic relations calls for a new stage in that evolution: a notarial system capable not only of ensuring legal certainty but also of realizing its full institutional potential to promote economic efficiency in private legal relationships through enhanced governance, conflict prevention, and the preservation of the contractual rationale built throughout the notarial process, so that disputes, when unavoidable, may be resolved consistently with the parties' legitimate choices, interests, and objectives.
 
 This book argues that such evolution requires neither abandoning nor replacing the historical foundations of the Latin notariat, but reinterpreting them in light of contemporary economic challenges. It introduces the Law-and-Economics Notary as the central institutional figure of the Law-and-Economics Notarial Paradigm, a new theoretical framework explaining how the civil-law notarial system can meet growing demands for economic efficiency while preserving the principles that have historically defined its identity.
 
 The book demonstrates that the Law-and-Economics Notary represents a new understanding of the notarial function. Public faith is conceived not only as an instrument of documentary authentication but also as a mechanism of private governance capable of structuring incentives, reducing transaction costs, mitigating information asymmetries and behavioral biases, strengthening trust among economic actors, and fostering more efficient, predictable, and socially beneficial legal relationships.
 
 Developed independently through the integration of law, economics, and notarial practice, the Law-and-Economics Notarial Paradigm later proved to converge with the evolutionary direction reflected in the studies and institutional agenda of the International Union of Notaries. This independent convergence confirms its capacity to explain and operationalize institutional transformations already emerging across the modern civil-law notariat.
 
 By integrating law, economics, and contractual governance, this book offers a new understanding of the notarial function and a coherent paradigm for the evolution of the Latin notarial system. Rather than replacing its traditional foundations, it demonstrates how they can be reinterpreted and further developed, thereby contributing to legal certainty, economic efficiency, preventive justice, and, ultimately, to economic development.

Beyond Victor’s Justice and Pursuit of Sustainable Development in International Law

This book explores how different legal systems handle a particularly difficult type of corporate wrongdoing: Catholic dioceses' responsibility for child sexual abuse. Usually, when people think about corporate wrongdoing, they think about tax fraud, insider trading, and similar 'white-collar' crime. As corporations, dioceses' responsibility for child sexual abuse exists separately from that of individual perpetrators, and this corporate responsibility is the focus of this book. Through an analysis of cases involving dioceses that have significant documented histories of priests abusing children, this book illustrates how criminal law, canon law, tort law, bankruptcy law and an Australian Royal Commission have responded (or why they have not). The cases involve the Diocese of Ballarat, in Victoria, Australia, and the Diocese of Gallup, in northern Arizona and New Mexico, in the United States. Each diocese faced similar claims in a diverse field of legal systems, so very different legal systems were handling, in essence, the same cases in dissimilar contexts. Employing a novel interdisciplinary approach, the book traces the theories, purposes, doctrines, procedures, and logistics of engaging with these different legal systems - evaluating what they can and cannot do. Revitalising theories of responsive law, the book demonstrates that it is possible for legal systems to better hold not just Catholic dioceses, but corporations more generally, to account for wrongdoing, but we may need to rethink how those systems are structured.
