This book offers a comprehensive reconstruction of proportionality in constitutional law, tracing its trajectory from its origins in Prussian administrative law and German constitutional adjudication to its contemporary application across diverse legal systems. Against the conventional approaches that equate proportionality with the weighing of competing values, it argues that this test was originally conceived as a dogmatic instrument for the protection of rights, not as a balancing technique. Through a detailed comparative analysis of the German and Brazilian experiences, the book reconstructs how proportionality gradually shifted from a strict limit on state power to an open formula of judicial discretion, and proposes a coherent model to restore its normative function. The book critically re-examines the philosophical and theoretical assumptions that transformed proportionality into an indeterminate balancing exercise and reconstructs it as a structured dogmatic test defined by constitutional parameters of protection. Engaging with authors such as Robert Alexy, Bernhard Schlink and Ralf Poscher, it maps how proportionality became the dominant method of constitutional adjudication and how that dominance produced both methodological uncertainty and jurisprudential uniformity. Finally, it proposes a theoretical framework that distinguishes proportionality in the singular, as a general abstraction, from proportionalities in the plural, calibrated to the specificities of each right, context and mode of judicial review. This plural and context-sensitive approach restores the analytical precision that contemporary constitutional law often lacks. By combining historical analysis, comparative dogmatics and legal theory, the study contributes to current debates on the legitimacy and limits of judicial review, the boundaries of fundamental rights and the crisis of constitutional interpretation in modern democracies.

The house at 38 Londres Street is home to the legacies of two men whose personal stories span continents, nationalities and decades of atrocity: Augusto Pinochet, President of Chile, and Walther Rauff, a Nazi SS officer responsible for the use of gas vans. On the run from justice at the end of the Second World War, Rauff crosses the ocean to southern Chile. He settles in Punta Arenas, Patagonia, managing a king crab cannery at the end of the world. But there are whispers about this discreet and self-possessed German - rumours of a second career with Pinochet's secret intelligence service, the dreaded DINA. In 1998, Pinochet is in a London medical clinic when the police enter his room and arrest him on charges of crimes against humanity and genocide. Philippe Sands is called to advise the former head of state on his claim to immunity, but will instead represent a human rights organisation against him. Years later, Sands makes a discovery while working on another book which reignites his interest in the case and leads to a decades-long investigation into Pinochet's crimes, his unexpected connection to Rauff and the former Nazi's possible connection to Chile's disappeared.

This book examines the relationship between LGBTIQ communities and law in Australia from colonial times to the present day, with a particular concentration on the last 40 years. Using a socio-legal analysis that combines legislation, case law, media reports, policy materials and government data, it traces the historical shift from criminalisation and erasure to conditional legal recognition. The book develops a critical queer perspective, analysing how sexual and gender minorities moved from being classified through the figure of the criminal ‘homosexual’ to being recognised as members of LGBTIQ communities with a status of almost legal equality. Structured historically, its chapters examine distinct phases of legal reform, governance and LGBTIQ activism. The book covers key issues in sexuality, gender, family, embodiment and sex classification, while offering an extended account of the legal questions affecting lesbian, gay, bisexual, transgender, intersex and queer people. From Erasure to Eligibility

Law, Governance and the Queer Subject

For centuries, the Latin notarial system has evolved in response to society's growing demand for legal certainty. Yet the increasing complexity of economic relations calls for a new stage in that evolution: a notarial system capable not only of ensuring legal certainty but also of realizing its full institutional potential to promote economic efficiency in private legal relationships through enhanced governance, conflict prevention, and the preservation of the contractual rationale built throughout the notarial process, so that disputes, when unavoidable, may be resolved consistently with the parties' legitimate choices, interests, and objectives.
 
 This book argues that such evolution requires neither abandoning nor replacing the historical foundations of the Latin notariat, but reinterpreting them in light of contemporary economic challenges. It introduces the Law-and-Economics Notary as the central institutional figure of the Law-and-Economics Notarial Paradigm, a new theoretical framework explaining how the civil-law notarial system can meet growing demands for economic efficiency while preserving the principles that have historically defined its identity.
 
 The book demonstrates that the Law-and-Economics Notary represents a new understanding of the notarial function. Public faith is conceived not only as an instrument of documentary authentication but also as a mechanism of private governance capable of structuring incentives, reducing transaction costs, mitigating information asymmetries and behavioral biases, strengthening trust among economic actors, and fostering more efficient, predictable, and socially beneficial legal relationships.
 
 Developed independently through the integration of law, economics, and notarial practice, the Law-and-Economics Notarial Paradigm later proved to converge with the evolutionary direction reflected in the studies and institutional agenda of the International Union of Notaries. This independent convergence confirms its capacity to explain and operationalize institutional transformations already emerging across the modern civil-law notariat.
 
 By integrating law, economics, and contractual governance, this book offers a new understanding of the notarial function and a coherent paradigm for the evolution of the Latin notarial system. Rather than replacing its traditional foundations, it demonstrates how they can be reinterpreted and further developed, thereby contributing to legal certainty, economic efficiency, preventive justice, and, ultimately, to economic development.

This book assembles critical contributions on the work of TRS Allan, the Professor Emeritus of Jurisprudence and Public Law at the University of Cambridge, whose leading work in legal and constitutional theory spans almost 45 years. Allan has charted a distinctive path for legal, political, and moral theory and practice and has become a highly significant figure in the UK and in common law/parliamentary systems around the world. His ideas challenge established opinions about constitutional law within these systems as well as established views about the rule of law from more abstract or philosophical perspectives. Allan claims that law and morality find an inherent connection through the rule of law. He argues that there is a connection that flourishes in common law jurisdictions because although Parliament has sovereign legislative powers, its laws gain their full legal meaning only through an interpretive lens. This lens seeks to reconcile sovereign will with legality's basic moral ideals, especially the idea that law must be general and capable of guiding behaviour and thus respectful of the equality and dignity of its subjects. Allan's scholarship is powerful yet controversial, and it has inspired 20 leading scholars from the UK, Canada, Australia and New Zealand to engage with the central themes of his work. By doing so, the contributors help to make that work accessible to a new generation of scholars and students. Principle of Party Initiative

The first history of US federal law enforcement from the nation's founding to the creation of the Justice Department in 1870, showing how federal prosecutions have always been shaped by local institutions and interests. The public imagines the Department of Justice and its agencies as mighty juggernauts. The reality is strikingly different. The FBI is barely larger than the Chicago Police Department, federal courts handle far fewer cases than state courts do, and federal prosecutors rely heavily on state and municipal authorities. The feds cannot function without local support, which means that the projects on which DOJ intervention is most needed-the ones that local communities oppose or don't care about-are also those least likely to succeed. This is no accident. Fragile Authority shows that this weakness is built into the structure of federal enforcement. To understand why, Daniel Richman traces the present-day workings of the DOJ all the way back to the nation's founding. The system was so circumscribed at the start that districts went years without a single conviction; enforcement efforts were often just performances of sovereignty for foreign audiences. And while a stronger enforcement apparatus emerged from the 1850 Fugitive Slave Act, its protection of Black civil rights during Reconstruction lasted only a few years before the federal retreat. After its creation in 1870, the Justice Department concealed its limitations by turning the agendas of local police-such as prosecuting gangsters, car thefts, and prostitution-into ostensibly national priorities. For better and for worse, federal law enforcement missions without local buy-in remain rare and difficult to sustain. The resistance to President Trump's immigration enforcement surge in sanctuary jurisdictions showed yet again that this norm is not easily broken.

More than four hundred years have passed since the Statute of Charitable Uses of 1601, whose Preamble set out a list of charitable purposes which has formed the basis of the modern legal definition of charity. This book explores the substantial body of judge-made rules and principles developed since then, highlighting a carefully curated selection of the landmark cases which have shaped charity law. Each chapter analyses one or more judicial decisions, setting them in their historical context, explaining their contemporary importance, and considering their future relevance. The selected cases cover a broad range of topics. Some go to the heart of what it means to be a charity, elucidating charity's legal definition and public benefit requirement.
