A National Governance Perspective

On Translation of Laws and Regulations in China

Why elite Chinese women find themselves caught in a cycle of burnout. Burnout Market Feminism explores the lives of elite urban businesswomen in the Internet Age. Burnout market feminism combines Han Byung-Chul's concept of the Burnout Society and feminist Li Xiaojiang's market feminism theory. To unravel the puzzle of how women in China have thrived in business despite state crackdowns on feminism, Ling Tang argues that it is important to examine the role of the market in postsocialist China and the evolving interplay between illiberal politics and a neoliberal economy. Drawing on multisited ethnography conducted primarily in Shenzhen and Hefei during the Xi era, the author looks at the multiplicity and nuance of the lived experiences of businesswomen and their negotiations with patriarchy across different sociocultural contexts, particularly their confrontations with hetero-patriarchal intimacy norms and male-dominated guanxi business practices. Despite following diverse paths, these women share a common pursuit of achievement and growth—a pursuit that paradoxically narrows their market feminist efforts and leads to burnout, as these negotiations are often reduced to contingent bargains within a neoliberal framework. The book also extends the discussion of burnout beyond that framework, incorporating feminist critiques of women’s burnout under patriarchy and postcolonial critiques of burnout within a rhetorically socialist authoritarian state.

This book assembles critical contributions on the work of TRS Allan, the Professor Emeritus of Jurisprudence and Public Law at the University of Cambridge, whose leading work in legal and constitutional theory spans almost 45 years. Allan has charted a distinctive path for legal, political, and moral theory and practice and has become a highly significant figure in the UK and in common law/parliamentary systems around the world. His ideas challenge established opinions about constitutional law within these systems as well as established views about the rule of law from more abstract or philosophical perspectives. Allan claims that law and morality find an inherent connection through the rule of law. He argues that there is a connection that flourishes in common law jurisdictions because although Parliament has sovereign legislative powers, its laws gain their full legal meaning only through an interpretive lens. This lens seeks to reconcile sovereign will with legality's basic moral ideals, especially the idea that law must be general and capable of guiding behaviour and thus respectful of the equality and dignity of its subjects. Allan's scholarship is powerful yet controversial, and it has inspired 20 leading scholars from the UK, Canada, Australia and New Zealand to engage with the central themes of his work. By doing so, the contributors help to make that work accessible to a new generation of scholars and students. They also provide a timely framework for engaging in the most important challenges facing our democracies today: how our legal systems do, or do not, honour and respect democracy and therefore legislative sovereignty while at the same time honouring and respecting the rule of law, or the 'Promise of Legality'.

Nevertheless, MPs often argue that a proposed law would be unconstitutional. What does this mean in a system without a written constitution? What counts as a sound argument about constitutional rights? And what influence do constitutional arguments have on the legislative process? The book takes a close look at these questions. This book examines the origins, deployment, and legacy of Order 1305, a measure introduced in 1940 to make it a criminal offence to take part in a strike. Surprisingly, the prohibition on the right to strike was retained by the Attlee administration after the Second World War, and was transformed to become a weapon of government during the Cold War to deal with what were wrongly claimed by ministers to be Communist-inspired strikes engineered for subversive purposes. In a deep analysis of Order 1305, the authors provide a reassessment of the role of the State in industrial relations. Challenging much contemporary learning in labour law, the book is informed by a very detailed engagement with Cabinet and ministerial papers, which highlight the contradictions on the part of government in simultaneously promoting and containing trade union power. These sources also highlight the extent to which trade unions both relied on and were co-opted by the State. The main focus of the book, however, is the role of Order 1305 in the control of trade union activists, with the continuing presence of the criminal law and allegations of communist inspired strikes ensuring an important role for MI5 and Special Branch in post-war industrial relations. Material unearthed at the National Archives demonstrates unequivocally not only that trade unions were deeply penetrated, but also that trade union activists were the subject of extensive surveillance, as the authors fully reveal.

It analyses what defines the conscientiousness of an objection from both legal and ethical standpoints. It explores the increased reliance on “grounds of religion, belief or conscience” as providing justification for excusing some citizens from complying with certain responsibilities – mandated by equality and non-discrimination legislation – that are binding for all others. By conducting a comparative evaluation of national law and judicial rulings on a fixed agenda of issues, this book identifies key jurisdictional differences concerning conscientious objection. In so doing, it highlights the importance of cultural context and constructs a jurisdiction-specific overview of legislation, policies and case law.
