This book fills a gap in the existing literature by providing a thorough assessment of EU regulations as a source of secondary legislation and their application in all twenty-seven Member States. It also explores that application in neighbouring countries. EU regulations are perceived as the strongest and the most effective sources of EU secondary legislation and it is well-established by the Court of Justice of the European Union that their provisions have vertical and horizontal direct effect. Part 1 of this book examines these points, providing a backdrop to the analysis in the remaining chapters. Parts 2 and 3 focus on the national reception of EU regulations in Member States, and in selected neighbouring jurisdictions. Written by leading practitioners and academics, the book offers both a conceptual underpinning to this element of the European Union's law-making, as well as its practical application.

'Incisive' PUBLISHERS WEEKLY'A brilliant, funny, omnivorous excavation of how technology and entertainment have warped humanity' SOPHIE GILBERT, PULITZER PRIZE FINALIST AND AUTHOR OF GIRL ON GIRL _______From an award-winning staff writer for the Atlantic, Screen People is an eye-opening look at how the current media landscape conditions us to see everyone as characters in ongoing entertainment - and how we can fight backWhether it's our expertly curated Instagram feeds or the reality-television-star US President, the line between what's real and what's fabricated for entertainment has never been more blurred. Screen People explores what happens when we cede our reality to spectacle and explains how today's internet-inflected culture incentivises us to see one another as characters in a show, and how some of our most chronic and harmful social conditions - loneliness, depression, mistrust, misinformation and cynicism - stem from our demand for diversion. In ten chapters, each themed around an element of entertainment Garber argues that this comedy of our daily lives is quickly becoming tragedy. And we can't understand our politics without first understanding our culture.Screen People shows why Garber is one of the most respected and widely read journalists of our day. This book is an urgent, dazzling look at how we entertained ourselves into our current predicament and shows how we might find our way out of the chaos.

A Memoir of Discovery

Young Man in a Hurry

This book discusses some of the most important issues facing administrative law and related doctrines. Leading public law scholars from across the common law world have contributed chapters to recognise the exceptional scholarship and career of Matthew Groves, Distinguished Professor at Deakin University, Australia. Over the last century, the power of the administrative state has grown immensely and the scope of administrative law as a field of inquiry has grown with it. This collection of essays provides an up-to-date analysis of some of the most important issues in administrative law in the 2020s, including: access to justice issues; the role, purpose and future of ombuds institutions and tribunals; government liability within and beyond judicial review; integrity bodies; 'lawfare'; the role of policies in government decisionmaking; and the tension between military and civilian systems of justice. These topics have been central to the work and career of Matthew Groves. Readers interested in public law - whether practitioners, researchers or students - will discover a wealth of engaging and thought-provoking considerations of the most topical current issues in administrative law by a selection of prominent academics.

Controlling the Administrative State

From California Governor Gavin Newsom comes an intimate and poignant account of identity, belonging, and the defining moments that inspired a life in politics “Go slow,” his political elders advised him, but Gavin Newsom has never known such a speed. For Newsom, the California Dream is what lured his father’s family from County Cork, Ireland, six generations ago. His great-great-grandfather, a cop, walked a beat in San Francisco, where almost 150 years later, Newsom would be elected as mayor, running on the values instilled in him by his family history: that California’s open arms must continue to extend to each new generation. Newsom has never lived anywhere but California. Born in San Francisco, his parents divorced at a young age, and his childhood was spent being tugged between two worlds: his mother worked three jobs in order to care for her children while his father, a close friend of the Getty family, brought Newsom into San Francisco society, a world of wealth and connections. The dissonance was frustrating, and made all the more difficult because of undiagnosed dyslexia, but the vantage point was valuable: he inherited his mother’s perseverance and his father’s reverence of California, not only its wildness, but its opportunity. In Young Man in a Hurry, Newsom traces the forces that have defined his ambitions as a politician and have pushed him to outpace the nation on myriad cutting-edge social issues that have since entered the mainstream. As mayor of San Francisco, he made waves when he violated state law in order to issue marriage licenses to same-sex couples, more than ten years before the Supreme Court made such unions legal. He launched bold efforts to counter climate change, improve mental health care, and enhance gun safety, and worked to preserve the California Dream for his constituents. Elected as governor on the eve of unprecedented wildfires and entering office into immediate hyper-partisan headwinds from Washington, DC, Newsom has constantly and consistently stuck his neck out. Here for the first time, he reflects on the long personal journey that ultimately shaped him into one of the most recognizable and accomplished elected officials in America. Filled with intimate family history and written with candor and remarkable personal insight, here is a deeply resilient California story of identity, belonging, and the defining moments that inspired a life in politics.

This book brings together theoretical and empirical research, as well as interdisciplinary and comparative studies with the aim to direct the contemporary debates within the field of ombud scholarship. Most countries have public ombud institutions that are supposed to function as mechanisms of dispute resolution outside courts for citizens seeking redress for complaints against public bodies. While research on these oversight bodies has long focused on legal aspects, since the last decade scholars have increasingly become interested in historical, political and social aspects. This book makes a contribution in this multi-disciplinary field by filling two key gaps in the literature: the first part showcases recent empirical research, the second part covers critical analytical approaches. Taken together, this volume promotes a social science oriented understanding of ombud institutions as embedded in specific social contexts, which are formed by societal forces while also contributing to the shaping of modern societies. Critical examination of how and under which conditions ombuds operate enables us to identify blind spots in both the literature and practice. On the basis of case studies from different world regions, including Austria, Australia, Colombia, France, Germany, Ireland, Netherlands, Spain, Turkey, the UK and the USA, investigated from various disciplinary perspectives, the contributions develop the field of ombud research further. Its contents and accessible style make the book relevant for anyone interested in ombud and oversight institutions: academics, researchers, students, and practitioners alike.

From a renowned legal scholar, a new vision of how the judiciary has reconfigured rights and power. Ambitious and erudite, The Power Revolution is a new challenge to conventional wisdom from one of our most prominent constitutional scholars. Philip Hamburger's prior scholarship initiated the current judicial reconsideration of the administrative state. Here, he makes the broader point that the acclaimed rights revolution has been accompanied by a much more substantial power revolution-a vast judicial expansion of government power and a corresponding judicial erosion of rights. The slant toward power goes much further than has been understood, and because it cuts across much of the Constitution, its effects are sobering. It threatens both our freedom and our government. It even undermines the nation's stability. It's therefore important to understand the contemporary realities of unconstitutional power, not just our old constitutional ideals. In observing the judiciary's responsibility for how we are governed now, The Power Revolution calls upon Americans to push back against unconstitutional power and urges the judges to reconsider what they have done. After so much damage to the Constitution, it is time for repair.
