The concept makes it possible to assess the effectiveness of legal norms in relation to the intended level of enforcement. The analysis is based on the assumption that enforcement is not only an opportunity but also a burden for the rights holder, who must take active steps to realise their rights. Whether enforcement through the courts actually occurs depends to a significant extent on the actors involved. The burden of enforcement thus connects doctrinal perspectives with empirical analyses of legal effectiveness. The use of technology can shift this burden by either automatically accessing goods or preventing legal violations without recourse to state authorities. The “Right of Control” section includes practical exercises and explores its central role in DAPL’s evolution, concluding with an application to verified carbon credits. The following parts offer detailed reflections on each of the 19 Principles. Each reflection follows a consistent structure: the Principle’s text, commentary, illustrative examples, and explanations, all grounded in official Unidroit documents. The book clarifies the rationale, aims, and drafting process behind each Principle, showing their relevance and alignment with international standards. This resource is invaluable for lawmakers, judges, lawyers, entrepreneurs, and students seeking clear guidance on interpreting and applying the DAPL Principles to digital assets law.

UNIDROIT Principles on Digital Assets and Private Law

When it comes to what couples fight about, money is the number one thing couples argue about. Financial issues can take its toll on a relationship and arguments about money are the leading cause of divorce. Long before they realize they're living beyond their means, couples tend to battle about abusing credit cards, conflicting priorities, and different philosophies about spending, saving, and investing their money. When couples fight over money they tend to blame each other and anger and resentment build. Money is a touchy topic for most couples. There is no "right" or "wrong" way to deal with issues such as unequal assets, layoffs from work, and credit card debt. Disagreements about finances are usually not really about money but about our dreams, fears, and insecurities. Our relationship with money starts in childhood. Everyone has a story about money which includes myths, misconceptions, and habits. When our histories, attitudes, and beliefs about money collide with our partner, sparks can fly. If this "Us against each other" mindset doesn't change to a "Us against the problem," high-conflict can become perpetual and a source of chronic tension in a relationship. Learning how to talk about finances is a critical way for couples to protect their relationship and strengthen it.
