From the rise of China as a technological superpower, to wars on its eastern borders, to the belief that the US is no longer a reliable ally, the European Commission sees the world as more unstable than at any other time in recent history. As such, the Commission has become the Geopolitical Commission, working to serve the interests of the Geopolitical Union. Central to many of these conflicts is technology - who produces it, where it is produced, and who controls it. These questions are central to the Commission's pursuit of digital/technological sovereignty, Europe's attempt to regain control of technology regulation. Focusing on topics such as setting technological standards, ensuring access to microchips, reining in online platforms, and securing rules for industrial data and AI, this book explores the EU's approach to lawmaking in this field; increased regulatory oversight and promotion of industrial policy at home, while exporting its rules abroad.

This book examines the persistence of blasphemy provisions, their increasing use in post-authoritarian Indonesia and the extent to which religion has been instrumentalised for political ends justified by law.Based on empirical research and an analysis of more than a hundred court decisions that connects evidence to theoretical discussions, this book traces the evolution and dynamics of capitalism in relation to the nature of legal order and the operation of laws, particularly those related to religion. Using an interdisciplinary approach, the author offers a rich analysis of the competing discourses on blasphemy in Indonesia. The work bridges the literatures of law and other social sciences. Providing an updated analysis of Indonesian blasphemy laws, this book also aims to shed light on the dynamics of legal order that affect how and why such laws exist. Rather than merely documenting regulations on and cases of blasphemy, the study aims to further understand the operation of law as a reflection of power relations. Specifically, the book reveals that the persistence of blasphemy laws has more to do with the illiberal nature of Indonesia's legal order, which renders laws that privilege religious orthodoxy a practical instrument for religious mobilisation for political purposes, than with the cultural distinctiveness of Indonesian society or the lack of modern bureaucratic and legal institutions supporting secularisation, as many scholars have argued.Offering original contribution to scholarship on blasphemy, the politicisation of religion and illiberalism in democracies, this book will be of interest to academics in the field of Asian politics, law and Southeast Asia studies.

Law and Politics of Blasphemy in Indonesia

How corporations can address legacies of historical oppression in ways that are good for them and good for others. Increasingly, corporate executives find themselves called upon to atone for their predecessors’ moral transgressions. While many are prepared to address inherited failed product lines or dysfunctional teams, few know how to handle demands that their enterprise address legacies of mass atrocity such as slavery, genocide, or colonialism. In Corporate Reckoning, Sarah Federman provides a corporate atonement model for corporate leaders and employees across industries around the world. When survivors and descendants demand reckoning, many corporate leaders initially shirk the responsibilities that follow from these requests. They may claim that history belongs to the historians, that their company’s activities were legal at the time, or that too much time has passed. If it comes to it, courts will rule in their favor, they reassure themselves. Others avoid these issues simply because they have no idea how to address them. Demands for reckoning ebb and flow, but these histories do not disappear. This book offers a way forward that serves companies and those affected by these historical harms. Taking responsibility for irreparable harm is not easy or comfortable. Despite the dilemmas and difficulties, the only way out is through.

Corporate Reckoning

Money in political campaigns is a subject of endless current interest and enormous consequence for American democracy. Beginning in 1976, in Buckley v. Valeo, the Supreme Court established a framework for public campaign regulation that declared that money constitutes "speech" and that the only constitutional basis upon which the government can regulate money was to prohibit corruption or the appearance of corruption. The Court then defined corruption narrowly and held that direct "contributions" to candidates could be limited on that basis but that "expenditures," by political candidates and others, could not. Over time as the role of money became more and more serious in politics the Court in a number of decisions seemed to be turning more willing to accept regulation. But in Citizens United v. Federal Election Commission, the new conservative Supreme Court sharply turned against permitting regulation, including of corporations. Today that regime of nearly full protection for anyone spending virtually any amount of money for or against candidates and issues remains securely in place. The question, after a half century of this system, is whether this interpretation of the First Amendment is sound or not. If yes, then what are the justifications and what will be the consequences? If not, then what are alternative interpretations and what would the world be like under each one? The contributors, all scholars and experts in this area, give their interpretations and proposals.

- Quadra Commodities SA v XL Insurance Company SE in relation damages for late payment of insurance claims under s.13A of the Insurance Act 2015
- Jones v Zurich in relation to avoidance of an insurance policy under the Consumer (Insurance and Disclosure) Act 2012

In addition Chapter 17, Specific Types of Insurance , is expanded to include a new section on cyber insurance.

Die Washingtoner Prinzipien von 1998, fordern die Signatarstaaten zu "gerechten und fairen Lösungen" im Umgang mit "NS-Raubkunst" auf. Das Vereinigte Königreich setzte diesen Appell im Jahr 2000 mit Einrichtung des "Spoliation Advisory Panel" (SAP) um, das seither einen Streitbeilegungsmechanismus bietet, um auf die Ansprüche Berechtigter zu reagieren. Dieser Band nimmt die 22 Empfehlungen in den Blick, die das Panel bislang ausgesprochen hat. Die Entscheidungen werden vor dem Hintergrund der englischen Rechtstradition und -praxis sowie der historischen Rolle des Vereinigten Königreichs analysiert, systematisiert und einem abstrakten Regelwerk zugeführt. Das auf mehrere Bande angelegte Werk prasentiert nahezu das gesamte deutsche Verfassungsrecht des Zeitraumes zwischen 1806 und 1918. Hiermit wird der sich gleichsam schrittweise vollziehende Ubergang von einem traditionell standischen oder gar furstlich-absolutistischen zu einem zumeist monarchisch-konstitutionellen System aufgearbeitet, dessen jaher Untergang schlielich in die nationalstaatlich-republikanisch gepragte demokratisch-parlamentarische Staatsform Weimars mundet. Mit dem Gesamtwerk steht dem Fachpublikum eine leicht zugangliche, bislang nicht gekannte Fulle von Dokumenten zur Verfugung, die fur die verfassungsrechtliche Entwicklung Deutschlands und seiner einzelnen Staaten von zentraler Bedeutung waren.
