Warum sollte man das Vererben moderieren? Eigentlich ist es doch ganz einfach: Bestimmt ein Erblasser nichts, gilt die gesetzliche Erbfolge. Wer das nicht will, der schreibt ein Testament. Die Nachwelt hat sich danach zu richten. So funktioniert das Vererben heute aber nicht mehr. Die Zahl der Rechtsstreite in Erbsachen vor deutschen Gerichten nimmt kontinuierlich zu.&nbsp;
In diesem Buch geht es darum, den Erblasser im Zusammenhang mit seiner Testamentsgestaltung durch die Brille der Erben und anderen Hinterbleibenden blicken zu lassen und so ein harmonisches Vererben zu ermöglichen. Es geht darum, aus der Psychologie, der Soziologie, der Pädagogik, der Philosophie und sogar der Epigenetik Erkenntnisse gewinnen, um anhand dieser für einen zukünftigen Erbfall Gestaltungen empfehlen zu können, die dazu beitragen, dass die Hinterbleibenden sich auch nach dem Erbfall gut verstehen.
Neben diesem Blick auf (zwischen)menschliche Aspekte der Vermögensübertragung wird in einem juristischen Fachteil der Blick auch auf die konkreten testamentarischen Gestaltungsmittel gerichtet. Mit konkreten Praxishinweisen wird dargestellt, welche juristischen Gestaltungen in welcher persönlichen Situation der Beteiligten risikogeneigt oder streitvermeidend sind.
Der Autor
Prof. Dr. Jan Roth ist Rechtsanwalt, Fachanwalt für Erbrecht, Fachanwalt für Steuerrecht und Fachanwalt für Insolvenz- und Sanierungsrecht sowie erfahrener, zertifizierter Testamentsvollstrecker (AGT) und als Nachlassinsolvenzverwalter tätig. Nachdem er bis 2024 Partner bei Wellensiek war, wechselte er im selben Jahr zu der auf Nachlassvermögensverwaltung spezialisierten Kanzlei LINTILIA LAW. &lt;&nbsp;Darüber hinaus ist er Honorarprofessor an der Christian-Albrechts-Universität zu Kiel.
