Eva Rom focuses on the primacy of Union law, its properties, its justification, and - most delicately and most decisively of all - its limits. The Court of Justice of the European Union and some national constitutional courts have different understandings of where the primacy of Union law over national law finds its limits and whose task it is to define these limits. The consequence in certain cases is constitutional conflict. In the literature of Union law, one finds scholars drawing upon civil disobedience and conscientious objection to enrich the study of constitutional conflict, but this has not yet been done in an exhaustive, theoretically detailed manner. Eva Rom intends to remedy that. The literature on civil disobedience and conscientious objection contains important insights which can be drawn upon to build a framework with which to assess cases of constitutional conflict in the European Union. Civil disobedience and conscientious objection as concepts describing a qualified form of resistance will prove highly valuable to study in order to arrive at an analytically sharper understanding of constitutional conflict. The two concepts will not be used to formulaically defend breaches of Union law. The aim is not to provide for an apologetic endorsement of breaking the law. Instead, this project is aimed at moderation, differentiation, and at pondering the following question: Under what exact conditions could an opposing ruling by a national constitutional court be considered justified and what would the consequences of such a classification as justified be?

This book explores how both common law and civil law traditions have long devoted extensive attention to&nbsp;litigious facts—those directly related to the parties involved in a dispute. These facts have consistently been central to procedural theories, particularly the theory of evidence.
At the same time, it draws attention to another category of facts that remain largely unexamined by judges and lawyers. Why socially responsible investment promises to make investors richer and the world better—but fails at both. Wall Street thrives by telling investors that clever financial strategies can reverse the trade-off between corporate profits and social progress. But the link between greater corporate social responsibility and improved financial performance is an illusion. Profit vs. Progress dissects the massive $30 trillion “socially responsible” or “sustainable” finance industry—and finds the emperor has no clothes. At best, sustainable investing typically delivers average rates of financial and social returns. But it makes social and environmental crises harder to overcome, by using financial gimmickry to distract our attention from real solutions. Author Brad Swanson argues that corporations in competitive markets act without moral values, and ethical investment can’t prod them to take greater social responsibility. The only way to change the outcome of the game is to change the rules. The solutions will have to come from legislatures, not corporate boardrooms. Swanson calls for public policies to make businesses better serve all of society, not just their shareholders—without blunting their edge.
