        &lt;p&gt;Das Werk untersucht das Spannungsverhältnis zwischen den Grund- und Menschenrechten professioneller Athlet:innen, der Autonomie von Sportorganisationen und der staatlichen Verantwortung zum Schutz dieser Rechte. Auf Basis aktueller nationaler und internationaler Gesetzesinitiativen analysiert der Autor Inhalt und Grenzen staatlicher Schutzpflichten im Leistungssport nach Maßstab des Grundgesetzes. Ein Schwerpunkt liegt auf der Verbands- und Vereinsautonomie und den daraus resultierenden Risiken für Athletenrechte. It investigates how community mediation, led by mediators who are themselves members of the community, fosters social inclusion, accountability, and empowerment among conflicting parties.
 The text traces the roots of these practices to Roman

 , concepts of friendship that served as social bonds or “social cement” in classical society. By revisiting these traditions, the book analyzes their relevance as a political basis for contemporary approaches to conflict resolution, showing how ancient ideals of consensus, fraternity, and solidarity can inform modern mediation processes.

With an ageing population, the number of people with dementia is expected to increase in the coming decades. Dementia can seriously impair a person's ability to act and decide. In the Netherlands, adults can provide for such a future period of incapacity through a so-called levenstestament. A levenstestament can include the appointment of an attorney for financial, medical and/or personal matters, but also the adult's wishes, preferences and instructions regarding these matters. Over the past decade, the levenstestament has become increasingly popular in the Netherlands. A major concern, however, is that the levenstestament becomes active at a time when adults will generally be increasingly unable to supervise the execution of the levenstestament and indicate whether they are satisfied with the actions of their attorney. This book provides a thorough analysis of the current regulation and application of the levenstestament based on legal-normative and empirical research. Based on comparative law research, recommendations have been formulated to improve the regulation of the levenstestament and address problems that arise in practice. The Family &amp; Law series broadly focuses on the debate between theory and practice in the field of Family Law. The Dutch 'Levenstestament' from a Legal, Empirical and Comparative Perspective

In Anticipation of a Future Period of Incapacity

This book explores how AI systems trained on neurodata are redrawing the boundaries of dignity, autonomy, and legal personhood. It reveals the emerging reality of NeuroAI: a world where machine-learning models anticipate our thoughts before we have even formed them. As neurotechnologies evolve, AI systems move beyond interpreting brain signals in labs and headsets to harvesting neurodata (whether extracted through direct interfaces, inferred from everyday behaviour, or reverse-engineered via predictive modelling) from users who never consented or even knew they were being monitored, transforming the subconscious into a commodified dataset. Drawing on case studies from criminal trials, law enforcement, and consumer technologies, the book reveals how Big Tech and platform operators increasingly treat neurodata as a resource for monetisation. Across the EU and the USA, emerging AI and data-protection regimes, including the EU AI Act and GDPR, as well as the US Fourth Amendment and HIPAA frameworks, offer incomplete or inconsistent safeguards against NeuroAI trained on neurodata to model and predict thoughts, emotions, or intentions, leaving cognitive inference primarily in a legal grey zone. Indispensable for legal scholars, technologists, and regulators, this critical roadmap illuminates the gaps in current law and identifies the safeguards needed to protect our most intimate inner lives.
