This book offers a groundbreaking perspective on the use of documentary evidence in legal proceedings.
 
 In its first part, the book presents a critical overview of the current state of legal scholarship and jurisprudence concerning documentary evidence. It argues that, particularly in civil law jurisdictions, the law often rests on two flawed assumptions: that documents are sensory equivalents and that they are objective, with self-evident meaning that requires no interpretation or intersubjective validation. The result, in the author's view, is a legal culture that treats documentary evidence as a kind of objective "gold standard," obscuring the subjectivity and interpretive work that actually goes into creating and evaluating such evidence.
 
 The second part draws on general epistemology and semiotics to challenge these assumptions. It explores the role of context, the differences between human testimony and machine-generated evidence, and the need for comprehensive evidentiary sets. Through a semiotic lens, it examines various types of signs and the processes of representation and interpretation that underlie each type of documentary evidence.
 
 Building on these theoretical foundations, the third part proposes a new framework for understanding documentary evidence. It emphasizes the need for understanding the “physiological” functioning of each type of document and considers factors such as the nature of the sign, potential pathological or physiological alterations, and whether the source is human or mechanical.
 
 Finally, offers both theoretical insights and practical recommendations for all actors involved in the admission, production, and evaluation of documentary evidence—judges, lawyers, prosecutors, and others—providing tools for a more critical, contextual, and accurate approach to legal proof.

Natives of My Person

This book offers a comprehensive reconstruction of proportionality in constitutional law, tracing its trajectory from its origins in Prussian administrative law and German constitutional adjudication to its contemporary application across diverse legal systems. Against the conventional approaches that equate proportionality with the weighing of competing values, it argues that this test was originally conceived as a dogmatic instrument for the protection of rights, not as a balancing technique. Through a detailed comparative analysis of the German and Brazilian experiences, the book reconstructs how proportionality gradually shifted from a strict limit on state power to an open formula of judicial discretion, and proposes a coherent model to restore its normative function. The book critically re-examines the philosophical and theoretical assumptions that transformed proportionality into an indeterminate balancing exercise and reconstructs it as a structured dogmatic test defined by constitutional parameters of protection. Engaging with authors such as Robert Alexy, Bernhard Schlink and Ralf Poscher, it maps how proportionality became the dominant method of constitutional adjudication and how that dominance produced both methodological uncertainty and jurisprudential uniformity. Finally, it proposes a theoretical framework that distinguishes proportionality in the singular, as a general abstraction, from proportionalities in the plural, calibrated to the specificities of each right, context and mode of judicial review. This plural and context-sensitive approach restores the analytical precision that contemporary constitutional law often lacks. This book, as a monograph devoted to the concept of right, takes as its vantage point the historical transformation of human society from agricultural civilization to commercial–industrial civilization. It traces the formation and evolution of the concept of right, analyzes the strengths and weaknesses of the right‑related thought of three major Western jurisprudential traditions and their representative figures, repudiates the intellectual constraints that existing Western notions of right have imposed upon the Chinese legal academy, and develops a theoretical system of right supported by such core concepts as the constitution of right, the ontological foundation of right, the bearer of right, the function of right, and the semantic transformation of right.

Das auf mehrere Bande angelegte Werk prasentiert nahezu das gesamte deutsche Verfassungsrecht des Zeitraumes zwischen 1806 und 1918. Hiermit wird der sich gleichsam schrittweise vollziehende Ubergang von einem traditionell standischen oder gar furstlich-absolutistischen zu einem zumeist monarchisch-konstitutionellen System aufgearbeitet, dessen jaher Untergang schlielich in die nationalstaatlich-republikanisch gepragte demokratisch-parlamentarische Staatsform Weimars mundet. Mit dem Gesamtwerk steht dem Fachpublikum eine leicht zugangliche, bislang nicht gekannte Fulle von Dokumenten zur Verfugung, die fur die verfassungsrechtliche Entwicklung Deutschlands und seiner einzelnen Staaten von zentraler Bedeutung waren. Dabei wird groer Wert auf die authentische, d. h. buchstaben- und zeichengetreue Ubernahme der Texte gelegt. Dem jeweiligen Dokumententeil sind in jedem Band "Historische Einfuhrungen" vorangestellt. In diesem Rahmen werden an den einschlagigen Dokumenten orientierte (verfassungs-) rechtliche, zeitlich wie territorial ubergreifende entwicklungsgeschichtliche Darstellungen vorgenommen. In dem hier vorliegenden 3. Band werden erstmals uber 450 Verfassungsdokumente prasentiert, welche fur die verfassungsstaatliche Entwicklung des Groherzogtums Berg und des Herzogtums Braunschweig pragend waren.
