Ausgehend von den Konzepten der Bioethik, des ärztlichen Handelns und der Normativität ärztlicher Praxis sowie von früheren Studien, die sich mit Struktur, Rolle und Funktion des Rechts befasst haben, entwickelt die Autorin eine pentadimensionale Struktur des Rechts. Diese Struktur dient sowohl als konzeptioneller Rahmen als auch als analytisches Instrument zur Untersuchung komplexer Fragestellungen, insbesondere im Schnittfeld von Recht und Medizin sowie im Kontext medizinisch-ethischer Dilemmata - Bereichen, die gegenwärtig erhebliche Herausforderungen für Richter, Ärzte und die Gesellschaft insgesamt darstellen. Die Autorin argumentiert, dass das Recht fünf miteinander verknüpfte Dimensionen umfasst: eine technische, eine soziologische, eine axiologische, eine normative und eine politische Dimension, wobei letztere als eine Dimension hervorgehoben wird, die sich aus der Einbettung der rechtlichen Erfahrung in das institutionelle und normative Gefüge des Staates ergibt. Das Modell ermöglicht somit ein multidimensionales Verständnis rechtlicher Phänomene und bietet eine strukturierte Grundlage für die Entwicklung fallbezogener Analyseprotokolle.
