This book offers a machine-generated literature overview of the legal and ethical considerations, in the context of technological growth, over implementing privacy and data protection measures in the last three decades. &nbsp;It showcases the expectations and challenges in mapping and operationalizing the information privacy and data protection measures. It is the second of a two-volume exploration of the narrative, wherein both volumes have consciously tried to remain both jurisdictional and technology neutral while considering a range of data protection and privacy issues. Towards that end, this volume addresses these issues at a conceptual level while dealing with the question of implementing data protection expectations in different environments. It, however, looks at the operational question of implementing the expectations, positioning itself in a context of ‘conflict’ and ‘uneasiness’ that often is assigned to the question of technology and privacy. Therefore, the volume starts with chapters on these conflicts and contradictions before moving on to articles that effectively implement data protection principles in a tech environment. The following chapter gives us a sense of how privacy and data protection issues are no longer obscure incidents and have become a part of our everyday living. The next chapter provides a snapshot of examples where technical advancements offer effective and practical solutions in implementing data protection measures to protect the privacy of individuals. However, the chapter also portrays the extent of risks that such implementation may have on individuals. At the end, the final chapter captures how often privacy and data protection questions come between technical growth and advancement.&nbsp;The first volume, titled ‘Expectations vs Realities of Information Privacy and Data Protection Measures,’ captures overarching issues about data protection and privacy; conceptualizes data protection from different perspectives and its existing debates with other rights and developments in a democratic society; provides a snapshot of developments happening in various jurisdictions and how data protection framework engages with other laws. It also broaches the critical issue of consent and how consent as a requirement has evolved and integrated with health research and other allied areas. Adam Smith’s Wealth of Nations After 250 Years

Torture and the Recognition of Psychological Suffering in International Law examines how and to what extent psychological suffering-or state violence not leaving overt physical marks-has been recognised under the prohibition of torture, inhuman and degrading treatment in international law. It systematically reviews interpretive practices across three authoritative adjudicatory bodies: the European Court of Human Rights, the Inter-American Court of Human Rights, and the United Nations Committee Against Torture. The book also draws on extensive interviews with advocates (applicant lawyers), adjudicators (judges and committee members) and institutional lawyers (senior registry or secretariat lawyers.) Psychological suffering has, in broad terms, been recognised as falling within the prohibition from the inception of these three institutions. A closer analysis, however, also shows that it has never been specifically categorised as torture when standing on its own. Moreover, psychological suffering is often excluded altogether from the purview of the prohibition, either categorised instead as 'lawful sanctions' or as falling below the 'minimum level of severity' threshold, and therefore not found to be a violation. Doctrinal scholarship offers only limited explanations for this categorisation and exclusion, as evident in interpretive practice. Ergün Cakal reveals numerous inter-related reasons for these practices: socio-political standards recognising the significance of psychological suffering are selectively applied or altogether overlooked; procedural pragmatism encourages caution and conservatism regarding categorisation; and scientific expertise documenting health impacts has not compelled adjudicators in all cases. Finally, interpretation often still depends on sense-centric reasoning (intuition-impression-empathy), potentially undercutting scientific evidence and perpetuating the preconception that severe suffering must be physical to be legally cognisable.
