Standards der Psychotherapie

Menschen, die ihr Leben nicht an den eigenen Werten orientieren, haben ein erhöhtes Risiko für die Entwicklung psychischer Störungen und erleben häufig Gefühle der Sinnlosigkeit und Einsamkeit. Auf die Bedeutung einer werteorientierten Lebensführung für die psychische Gesundheit verweisen zahlreiche psychotherapeutische Ansätze, so z.B. die Logotherapie von Viktor Frankl oder die Akzeptanz- und Commitment-Therapie (ACT). Dieser Band liefert einen Überblick über wissenschaftlich fundierte Konzepte, die sich auf die Themen Werte, (Lebens-)Ziele und Sinn beziehen, und über bewährte Methoden für die Arbeit an der Ziel- und Werteklärung sowie Sinnorientierung. 
Zunächst werden verschiedene Modelle und Erklärungsansätze zu den Themen Werte und Sinn vorgestellt und diagnostische Methoden zur Erfassung von Zielen und Werten beschrieben. Anschließend wird auf die Grundprinzipien einer wertezentrierten Gesprächsführung eingegangen und es werden verschiedene prospektive und retrospektive Interventionen erläutert, die die Arbeit mit Werten, Sinn und Lebenszielen unterstützen können. Hierzu werden u.a. die Exploration wichtiger Wertebereiche, imaginatives Arbeiten, der Umgang mit Ziel- und Wertekonflikten sowie der Einsatz von Metaphern und einer Lebenslinie in der therapeutischen Arbeit dargestellt. Zudem wird Bezug auf Ansätze zur Bilanzierung genommen, z.B. im Rahmen eines Lebensrückblicks, sowie auf den Umgang mit Reue über verpasste Lebenschancen eingegangen.

The book contemplates the relations between national security and human rights. It studies how national security and human rights interact with each other in Europe and China, and how each actor seeks to protect one without damaging the substance of the other. The book aims to offer an insight into the legitimacy of the assumption that China is partial to security while European nations opt for freedom.
By comparing the approaches taken by Europe and China, the book finds that both parties tend to allow the government authorities to take proactive actions against national security threats, even those threats may be potential, distant or cumulative. The substantive control, internal and external, concerns mainly the task of preventing the impugned power from being abused.
Nevertheless, divergences do exist. In terms of how countries deal with national security threats, it is not determined only by the nature of threats, but by the extent to which government authorities are sensitive to them. Divergences are also found in how the two parties unfold their approaches. It is noted that the approach taken by China is short of an effective arrangement against abuse of power by the government authorities. In this context, the book proposes the areas that China can work on without meeting resistance from its existing political system.
The book sheds new light on how to read the national security case law, which helps readers get hold of the main threads of the ECtHR’s decision-making patterns and categorise relevant case law. Scholars generally hold that the Court’s reasoning is short of clarity and consistency. The book proposes a way in which we can find the consistence and patterns that lie in the Court’s reasoning in national security case law.
The intended readership includes scholars and researchers in the fields of human rights, legal studies, political science and Chinese studies, especially those whose research interests centre on

The edited volume examines the constitution as a symbol and explores its cultural, political, and normative dimensions beyond its strictly legal content. It is based on the observation that constitutions not only structure social orders but also generate narratives, shape identities, and frame conflicts. Especially in comparison to the symbolically charged U.S. constitutionalism, the German Basic Law lacks a revolutionary founding moment and tangible constitutional documents. This gives rise to the guiding research question: How does a constitution produce symbolic force-historically, in the present, and for the future? The volume does not conceive of the constitution as a closed system of norms but as an open emblem of collective self-understanding. It shows that symbolic references are not an accessory but a prerequisite for normative validity. The contributions situate the symbolic power of constitutions in the interplay between history and the present, ritual and critique, political identity and societal contestation, and between the national and European levels. They reveal how constitutional narratives emerge, how they remain contested, and how they provide orientation in times of crisis-while also producing exclusions and generating blind spots. The focus of the work thus lies on the constitution as a cultural repository, a projection surface, and a performative practice. The volume understands constitutional symbolism as a dynamic process: it links past and future, creates belonging within plurality, and remains open to reevaluation. The constitution appears not as a static text but as a living site of social negotiation.

The scientific status of law has long been a source of unease within legal scholarship. This interdisciplinary study offers a systematic exploration of what jurisprudence can learn from the philosophy of science. Adopting a historical and contextual approach, the author engages with three major theoretical traditions of the twentieth century: logical empiricism, Karl Popper's falsificationism, and Thomas Kuhn's historical epistemology. Popper's critical rationalism profoundly shaped legal thought, yet it addresses questions that do not arise within the domain of legal doctrine. The empiricists' critique of metaphysics, by contrast, reveals striking parallels to Hans Kelsen's Pure Theory of Law. Both, however, fall short of achieving the conceptual purification they envision. In this respect, Thomas Kuhn's re-evaluation of the distinction between validity and genesis marks a decisive shift. His model of paradigm change, though imperfect as historiography, exposes the deep contextuality of all knowledge practices - including legal reasoning. The study concludes that the pursuit of a purely "scientific" legal method is misguided if it seeks to emulate an idealised image of empirical science that even the natural sciences themselves do not uphold. Instead, the conceptual resources of historical epistemology allow for a more productive reflection on how legal doctrine negotiates its social, cultural, and historical contexts while preserving its normative autonomy.

Teleological reduction is an established component of legal methodology, even though it is not without controversy. Particularly in criminal law, it has long enjoyed great popularity and, in many places, has led to modifications of the Criminal Code. Against this background, it is surprising that the theoretical foundations of this doctrine have so far scarcely been the subject of in-depth legal scholarship. The aim of the present study was to clarify the unresolved questions that remain regarding the use of this instrument in criminal law.
 

 Kristina Peters concludes that teleological reduction can be viewed as a phenomenon through which the level of development of legal scholarship in general, and criminal law scholarship in particular, can be examined. Her analysis shows that the system of legal scholarship-and criminal law scholarship specifically-has reached a high level of development, even if certain gaps are still apparent. In the course of an axiomatic reconstruction of teleological reduction, it can be interpreted as a legal theory composed of meaning-proclamation procedures, substantive axioms (including their domain-specific manifestations), and domain-specific doctrine. When applied in criminal law, it does not pursue an outdated ideal such as realizing a "true meaning" or a notion of "justice" detached from the law. Rather, it is a highly domain-specific instrument of flexibilization, capable of eliminating teleological disruptions within the axiomatic network.
