Modern Studies in European Law

This book explores discretionary decision-making in migration systems in Europe. It investigates how European law influences the existence, exercise and effects of discretion. Firstly, it argues that national lawmakers often regard discretionary decision-making as the most viable option to accommodate standards of European law in their national migration systems. Secondly, the book shows how the exercise of this power has changed from an area of free choice to an instance of legally instructed decision-making. Ultimately, it illustrates how both the proliferation and transformation of discretionary decision-making have improved the legal position of migrants in the European Union, providing a compelling interpretation of a key field of EU law.

Corruption is a complex phenomenon that challenges ethics and integrity in public administration. Over the past decade, increased societal monitoring - particularly through the media and civil society organizations - has brought corruption back to the forefront of public concern and political debate. Since most state bureaucracies are formally grounded in a Weberian ethos of meritocracy, competition, and discipline, this raises fundamental questions: What causes corruption in the public sector, and what factors shape the likelihood that a public servant will engage in corrupt or unethical behaviour? This Element addresses these questions by advancing survey experiments as a central methodological approach for studying corruption in public administration. By reviewing existing experimental research and outlining research protocols for the design and analysis of survey experiments, this Element aims to contribute methodologically and substantively to the study of corruption and integrity in the public sector.

This book examines how artificial intelligence systems and their applications in security and defence are entangled with governance and policy processes in the EU. Combining concepts and insights from (critical) security studies and science and technology studies, it argues that behind the various AI-related policy initiatives in the EU are particular narratives on security and defence based on European fears of technological innovation and strategic gaps. In this respect, the book casts light on how such beliefs have become increasingly instrumentalized in the European governance dynamics, and subsequently embedded in successive policy initiatives and security and defence research programmes. It challenges conventional understandings of AI technologies as mere security and defence-enabling instruments, by providing a conceptually driven analysis of how certain visions of AI help govern and control one of the most dynamic emergent socio-technical fields. The book will appeal to all those interested in artificial intelligence, security studies, technology and European governance.&nbsp;
 
 Raluca Csernatoni is a Research Fellow at Carnegie Europe, where she works on the nexus between European defence and emerging technologies. She is also Guest Professor at the Centre for Security, Diplomacy and Strategy (CSDS), Vrije Universiteit Brussel, Belgium, and Visiting Faculty in the Department of International Relations, Central European University, Austria.

A Sicilian Man

This book explores how both common law and civil law traditions have long devoted extensive attention to&nbsp;litigious facts—those directly related to the parties involved in a dispute. These facts have consistently been central to procedural theories, particularly the theory of evidence.
At the same time, it draws attention to another category of facts that remain largely unexamined by judges and lawyers. Especially in the context of constitutional review and binding precedents, there are facts that do not concern the litigants—or at least not exclusively. These are general facts, connected to social life and the functioning of the world, and they closely resemble&nbsp;legislative facts. Since law presupposes reality and social needs—facts that concern everyone—their presence in constitutional adjudication should not come as a surprise.
The volume&nbsp;introduces the concept of&nbsp;constitutional facts, which emerge when constitutional review moves beyond its normative roots and engages with the lived reality of society. Deciding based on constitutional facts carries a significant democratic dimension.
While the analysis&nbsp;acknowledges that constitutional decisions should remain open to institutional dialog, it also argues that deliberation should not be prematurely closed when constitutional facts—overlooked by the legislature or still under public debate—are brought before the judiciary through legal challenges.
Beyond theory, the work also addresses decision-making strategies that foster institutional dialog around these facts, offering a framework that supports more transparent and participatory constitutional adjudication.

This book provides a comprehensive account of the achievements of the economic regions set up in France after the First World War. It identifies exactly how they operated, as well as critical success factors such as effective leadership. Some recent historians have taken a very negative view of the part played by these regions in economic development. This new study instead argues that they made a significant contribution and laid the foundations for the regions created in France after 1945. The key areas which they identified: transport, power generation, and technical education, have remained the preoccupations of regional governments in France and elsewhere to this day. The author covers the needs of commerce and industry, but also agriculture and tourism. Based on fresh research using a wide range of primary sources, this book will appeal to economic historians, economists, and geographers, as well as historians with a particular interest in France.
Terence Cudbird gained his doctorate from the University of Oxford in 2020 and is an Associate Member of the History Faculty there. He published an article on the French regions in French History in 2023.
