A Contribution to the History of Doctrine in Tort Law': The state of legal disorder that exists in the dogma of tort law is examined in a longitudinal study of the history of dogma to determine its origins. To this end, the present work focuses on the basic concepts of tort law. The origins of the difference hypothesis are examined and its transferability to contemporary tort law is critically questioned. The long-contested concept of damages is traced back to its conceptual and dogmatic core.

Historically the law of tort has offered limited protection for personal privacy however, since the enactment of the Human Rights Act 1998 this branch of the law of tort has seen rapid development. This book analyses the extent to which the law of tort currently affords protection against invasions of personal privacy and the remedies that are available. The book considers tort law and privacy in other common law jurisdictions including the US, Australia and New Zealand. It then goes on to explore the potential for a common law tort to be developed which would be capable of offering broader protection for personal privacy and its prospects for statutory codification.

Historically the law of tort has offered limited protection for personal privacy using a patchwork of established torts such as private nuisance and battery. Until recently no tort was recognised in English law which was exclusively concerned with protecting what could properly be described as a ‘privacy interest.’ However, since the enactment of the Human Rights Act 1998 which brought about the incorporation into domestic law of Article 8 of the European Convention on Human Rights (ECHR) this is a branch of the law of tort which has seen rapid development, with the judiciary developing a tort of ‘misuse of private information’ which is now capable of preventing and remedying violations of the ‘informational’ aspects of personal privacy. The possibility of introducing a statutory tort of privacy has been considered by a number of review bodies but so far no progress has been made in this area.This book analyses the extent to which the law of tort currently affords protection against invasions of personal privacy and the remedies that are available. The book considers tort law and privacy in other common law jurisdictions including the US, Australia and New Zealand where debates concerning the legal protection of personal privacy are also taking place. It then goes on to explore the potential for a common law tort to be developed which would be capable of offering broader protection for personal privacy and its prospects for statutory codification.

The book examines the practice of judicial reasoning in Tort law, understood as a process of justification, consisting of both deductive and non-deductive elements, and therefore involving a significant element of choice or discretion. The book divides the elements of judicial reasoning into four conceptual categories: factual assessments, application of legislative and judge-made rules, reliance on reasonableness, and policy considerations. To discuss these elements in a comparative perspective the book uses the English and French judicial traditions of Tort law as case studies. Judicial Reasoning in Tort Law

This book brings together leading scholars from private law and employment law to reflect upon private law doctrines as they relate to the employment contract. Developing an interdisciplinary dialogue, these contributions explore the regulatory functions of private law doctrines at the cutting edge of modern employment law. Topics include the potential and limitations of private law damages; the role of injunctions and specific performance; the interactions between express and implied terms; vicarious liability; substantial performance and breach; and the common law right to work. The integration of scholarly perspectives from the realms of private law and employment law enriches and deepens our understanding of core private law doctrines. Historically, employment law was defined in terms of its autonomy from general private law. This achievement of autonomy was highly prized, and considered necessary to facilitate industrial freedoms for trade unions and the protection of employees from exploitation. But the contractual basis of employment means that any such autonomy has always been partial and unstable. Furthermore, as trade unions have declined and governments have deregulated statutory employment rights, private law has assumed growing practical importance in strategic appellate litigation. In many common law jurisdictions, private law doctrines have become the new battleground between employers, workers and trade unions. Umgekehrt kann der Informationsanspruch aber auch erst nach dem Hauptanspruch verjähren, sodass er ins Leere läuft, weil der vorzubereitende Hauptanspruch bereits verjährt ist. Die Arbeit untersucht systematisch, wann ein solches Auseinanderfallen der Verjährung eintritt und zu unbilligen Ergebnissen führt. Sie zeigt, dass sich billige Ergebnisse im geltenden Recht dann nicht erreichen lassen, wenn der Informationsanspruch vor dem Hauptanspruch verjährt und dies auf einem späteren Verjährungsbeginn des Hauptanspruchs beruht. Insoweit besteht gesetzgeberischer Handlungsbedarf. Vorgeschlagen wird eine Sonderverjährungsfrist für vorbereitende Informationsansprüche.
