Biopiracy Menace

Threats to Traditional Knowledge, Indigenous Rights, and Global Biodiversity

Should deep seabed mining (DSM) stop or proceed? The international community is now facing a difficult choice. No matter what decision is made, environmental consideration is the core of the issue. This book tackles the compelling question of how to secure the marine environmental protection in DSM from an international law perspective. It deals with two major research questions: What are the international environmental requirements of participants - the contractor, the sponsoring State and the International Seabed Authority (ISA)? What are the legal consequences for them when environmental damage occurs? In doing so, it analyses the international DSM legal regime and general international environmental principles, observes the functioning of the ISA, and draws on law and practice of various environmental treaty mechanisms. The examination reveals the potential practical difficulties as well as fundamental obstacles in the application of international environmental rules and principles in the specific context of DSM.

International Environmental Obligations and Liabilities in Deep Seabed Mining

Distributed energy resources (DERs) such as solar panels, microgrids, and residential battery storage are reshaping electricity systems by enabling autonomous consumption and localised generation. They challenge the traditional centralised power model and offer significant potential for decarbonisation, decentralisation, digitisation, and democratisation—essential pillars for the energy transition. However, the DER revolution is not purely technological; it beckons important legal and policy changes too. While the need for DERs is widely recognised, their design, financing, and implementation can present complex economic, environmental, social, and governance risks including land tenure issues, legal liability, and protracted disputes. Electricity laws and policies—often drafted decades ago—are increasingly ill-equipped to address the challenges of integrating these technologies. At the same time, communities are demanding a greater role in shaping DER law and policy, calling for inclusive frameworks that ensure equitable access, data privacy, consumer protection, participation, human rights, and gender justice—particularly in low-income and indigenous communities. Sustainable Distributed Energy Resources: Law and Policy explores how legal and regulatory systems worldwide are responding to these challenges. Through a sustainability lens, it offers practical tools for managing legal, contractual, and governance risks across the DER value chain and presents a roadmap for improving coherence in the design, financing, generation, and consumption of DERs. It also highlights the role of energy entrepreneurship education in building a secure and inclusive energy future. ***** This book is the result of a long-standing collaboration between the International Bar Association's Section on Energy, Environment, Natural Resources, and Infrastructure Law (IBA SEERIL), Oxford University Press (OUP), and the Academic Advisory Group (AAG) of IBA SEERIL. As an active section of the IBA, SEERIL leads public interest initiatives and keeps its members informed about key developments across its six committees: Environment, Health and Safety Law; International Construction Projects; Mining Law; Oil and Gas Law; Power Law; and Water Law. Sustainable Distributed Energy Resources

This book concerns the often fractious interface between drug discovery and commercialisation, environmental degradation, the biodiversity crisis, the exploitation of indigenous peoples and the destruction of their culture, the right to health, inequalities of power, and the ability of the law to protect knowledge.

For millennia, medicinal plants have provided a trove of treatments for human ailments, and the key to that treasure has been the traditional knowledge of the indigenous peoples who have lived alongside these plants. More recently that knowledge has been taken, often without consent or recompense, by Western science as a springboard for the development of pharmaceutical agents. As a response to threats to biodiversity and indigenous culture, international mechanisms have created, or are creating, enforceable rights for indigenous peoples to control such knowledge.

With a background in pharmacology and molecular biology and significant experience as a lawyer in pharmaceutical and biotech patent litigation, the author brings a fresh perspective to understanding the difficulties of enforcing such rights and, in particular, examines whether there is a philosophically justifiable limit to the downstream scope of such rights.

This book is aimed at all those with an interest in the control of indigenous genetic knowledge and the protection of indigenous culture, whether academics, anthropologists or pharmaceutical researchers, and those seeking to make indigenous rights work, as activists, legislators or practising lawyers.

The Protection of Traditional Knowledge at the Frontiers of Drug Discovery

This book argues that, beyond the apparent fracture between humans and Nature that defines the Anthropocene crisis, there exists a shared cultural foundation in legal traditions, converging on the recognition of the intrinsic value of Nature and of the ecosystem interconnections between human and non-human life. The legal innovations explored here-particularly from Latin America- embody a holistic, integrated view coherent with the ecosystem approach. It is proposed that these ideas offer potential not only within their own legal systems but also as models for Western legal frameworks. Influential scholars from across the world address pressing issues concerning the integration of business and human rights standards for better governance of natural resources. Should Chinese energy investments be excluded from the liberal economic system based on geopolitical assessments only?This book explores the potential regulatory control by the Chinese government over foreign energy investments to achieve their perceived strategic objectives.

Host states in which Chinese energy companies make investments have increasingly opposed Chinese energy investments in their national security reviews, based on concerns that these investments have strategic objectives. The book analyses China's investment-related law, regulations, and energy policies to examine how overseas energy investment-making is governed. The book also explores the role of the Chinese government in energy investment promotion and protection.

It identifies and addresses the use (or overuse) of criminal punishment for protecting IP rights, a long-overlooked aspect of IP law that is shaping and distorting the IP landscape in Asia. This is in stark contrast to leading Western jurisdictions, whose criminal punishment of IP infringement, while provided for, is rarely enforced. The overarching theme of this book is to critically review the rationale, legitimacy, and effectiveness of criminalizing IP infringement; assess its significance; expose its consequences; and propose suggestions for reform. The volume is divided into five parts. It starts with criminological discussion of IP crimes, followed by five chapters that study the sources and models of criminal punishment of IP infringement, namely international treaties, the US, UK, Germany, and the EU. This book retraces the emergence of conceptions of authorship in late-eighteenth-century Germany by studying the material form of Immanuel Kant's 1785 essay, 'On the Wrongfulness of Reprinting'. Drawing upon book history, media theory, and literary studies, Benjamin Goh analyses the essay's paratexts as indices of literary production in the German Enlightenment. Far from being an idealist proponent of intellectual property, Kant is shown to be a media theorist and practitioner, whose critical negotiation with the evolving print machinery in his time helps illuminate our present struggle with digital technology and the mounting pressures borne by copyright as a proprietary institution.
