The present volume provides a bioethical and legal-philosophical inquiry into three of the most ethically controversial and politically sensitive domains of contemporary biolaw: surrogacy, end-of-life decisions, and medical triage. The book’s approach transcends mere description or comparison, delving into the ethical and philosophical dimensions required to adopt a normative framework for evaluating the management of human life at its biological thresholds: birth and death. Within the central chapters, the text follows a consistent thread: through a legal-philosophical perspective, it examines whether the choices of giving life through surrogacy, ending life, and allocating medical resources in contexts of scarcity can be considered ethically admissible while investigating whether normative structures exist that are capable of guiding human action and upholding autonomy, equality, justice, and human dignity. Written in clear and accessible language, this book provides conceptual clarity and critical reflection for scholars and practitioners in bioethics, biolaw, philosophy of law, and health policy.&nbsp;

This book seeks answers to two basic questions: What are normative rules and how can and should we apply them? It takes a fresh look both at legal reasoning as a process and normative rules as instruments. On the one hand, based on a decision-making model, it suggests a more practical approach to rule application that isn’t limited to interpretation, but includes searching, evaluation and choice. On the other hand, it proposes a more precise structure for normative rules that includes not only their scope and normative consequences, but also their circumstances and purposes. It then goes on to study such features as their open- and mandatoriness as well as their generality, vagueness and ambiguity, and examines how these features impact the rules’ breadth and the discretion they offer in terms of their application. Lastly, it considers how these aspects affect rules’ validity, binding- and effectiveness. Because the application of normative rules requires a basis in evidence, the book also includes a discussion of fact-finding and points to some interesting similarities between the philosophies of law and science.&nbsp;

This book examines the underlying principles of criminal law, both substantive and procedural law. In continental law countries, the analysis of substantive criminal law has relied heavily on concepts such as "retribution" and "free will" under the strong influence of German legal thought. However, these concepts often lack a scientific basis and mean little for the function of criminal law in the real world. Norms prohibiting criminal conduct are not mere "ideas," but intersubjectively existent objects that affect human behavior and function in unique ways. As such, their force naturally depends on their enforcement. These norms function as a determinant factor in the decisions made through human consciousness; otherwise, criminal law would have no deterrent effect. However, this does not mean that the freedom guaranteed in liberal democracy can be violated arbitrarily; its protection must be the second principle of criminal law. Based on these discussions, this book proposes to take normative determinism and utilitarianism as the basis of analysis, and to establish normative deterrence and the protection of freedom as the two pillars of criminal law. With regard to procedural criminal law, this book argues that we should look at the adversarial and inquisitorial systems in their actual function, rather than focusing on their respective ideological doctrines, and try to identify the common practical principles to be followed from a utilitarian point of view. In these discussions, the book extensively examines the historical background of the two systems and examines, as an example, the serious deficiencies of the current criminal justice system in the United States. What is argued and proposed in this book is a creative application and development, in the field of criminal law, of the theory elucidated by H.L.A. Hart and Jeremy Bentham.

In this book, John Finnis provides a virtually unparalleled, in-depth assessment of Leon Petrażycki’s work by a Western scholar. In the opening chapter, Finnis takes up the challenge of reading Petrażycki not simply as a historical curiosity of Eastern European jurisprudence but as a thinker whose wide-ranging and ambitious ideas continue to spark debate today. He critiques not only Petrażycki’s non-standard “economic analysis of law,” which differs markedly from the Chicago School model (not to mention from Guido Calabresi’s and Pietro Trimarchi’s versions), but also many other aspects of Petrażycki’s various contributions to jurisprudence. These include, above all, his legal-realistic but nonetheless appreciative treatment of the natural-law tradition(s), which makes Petrażycki both distinctive and difficult to classify in terms of standard schools of thought.Finnis’ essay is followed by nine further contributions. Written by scholars from different traditions and standpoints, they criticize, reassess, and elaborate upon Finnis’ arguments, creating a rich and multi-voiced dialogue. Das Buch beschäftigt sich mit den normativen Rahmenbedingungen der gesundheitlichen Versorgung von Onkologiepatient:innen unter Pandemiebedingungen. Ethische, rechtliche und ökonomische Herausforderungen, wie z.B. Triage und Allokation, Einschränkung der Grundrechte und -freiheiten und der Schutz von Mitarbeiter:innen bedeuten, dass die Erfahrungen aus der Corona-Pandemie eine Gelegenheit bieten, Wissen für zukünftige Situationen zu generieren. Die durch das SARS-CoV-2 ausgelöste Pandemie stellte das deutsche Gesundheitssystem vor bislang ungekannte Herausforderungen. Während der Pandemie müssen medizinisch Handelnde (insbesondere auch in der Krebsversorgung) wegen aktuell begrenzter Ressourcen Prioritäten setzen. Dies wirkt sich direkt auf klinische Entscheidungs- und Behandlungsprozesse aus und wirft ethische, medizinrechtliche und gesundheitsökonomische Fragen auf.

This edited collection illuminates what the concept of a specifically epistemic type of injustice has to offer socio-legal analysts. The epistemic aspects of injustice comprise more than knowledges, meaning and understanding, to include the supporting material and discursive (infra)structures for their production and dissemination arising in space/place/time. This book focuses on legal and regulatory arrangements, and the forms of knowledge and meaning they carry and with which they interact, in order to bring to light their spatial and place-relatedness or boundedness, which includes their temporal dimensions at various scales.

These highly innovative studies of epistemic injustice encompass the responsibilisation of patients in the North of England and Northern Ireland, housing, the systemic operations of law, the construction of digital spaces by algorithms, hospital discharges, case law affecting Indigenous communities in Kenya, the experience of mining disaster in Brazil, and the perspectives of rare diseases patients in Austria during the COVID-19 pandemic.

The book contributes towards law and geography, in particular through the emphasis on temporality as part of space and place. By highlighting the importance of author positionality and reflexivity, and pausing so as to bolster the development of humility and sensitivity for more fully informed studies on epistemic injustice and its ameliorations, the book also advances methodology for future studies.
