Sie leistet einen Beitrag zum besseren Verständnis der dogmatischen und funktionalen Grundlagen des deutschen und des französischen Rechts. Zu diesem Zweck werden die die beiden Rechtsordnungen prägenden Leitgedanken herausgearbeitet und miteinander in Beziehung gesetzt. Damit schafft sie eine wichtige Basis für ein tieferes Verständnis des Internationalen Privatrechts, speziell der Europäischen Erbrechtsverordnung und ihrer Abgrenzung zum Internationalen Gesellschaftsrecht.         &lt;p&gt;Der 2023 verstorbene, national und international hochgeschätzte Rechtswissenschaftler Prof. Dr. Dr. h.c. mult. Spiros Simitis war nicht nur Pionier des Datenschutzrechts, sondern hat auch in anderen Rechtsgebieten wie etwa im Arbeits-, Familien- und Produkthaftungsrecht, in der Rechtsgeschichte und -theorie, im Europarecht und in der Rechtsvergleichung wichtige Weichen gestellt. Diese weisen in ihrer Aktualität weit über seinen Tod und den Zeitpunkt der Erforschung hinaus. This volume sets out to explore the relationship between individual will (voluntas) and the legal rule. What unfolds in the following pages is a wide-ranging itinerary, moving between past and present, most notably ancient Rome and the contemporary world.The guiding question is as radical as it is enduring: in what way can voluntas (a psychological impulse internal to the individual) come to determine the legal rule? European private law tradition rests on the premise that legally binding acts - contract and will, to mention only two paradigmatic cases - derive their force from individual will. From the Roman sources arises, with exemplary force, the notion of lex privata: the idea that private will itself may generate binding legal norms. Such a premise immediately leads to further questions. Above all, it compels reflection on the authenticity of that will: what if voluntas is compromised? The law of defects (error, dolus, metus) opens the problem of whether distorted or corrupted will can truly sustain the validity and effects of a legal rule.The reflections gathered in this book approach the European civil law tradition as a broad and unified phenomenon, one in which law is inseparably bound to the historical and cultural contexts in which it takes shape.

        &lt;p&gt;Während viele Bereiche des Privatrechts durch das Europarecht inzwischen weitgehend harmonisiert sind, ist das Sachenrecht und insbesondere auch die Übereignung von Eigentum nach wie vor in den verschiedenen Staaten der EU sehr unterschiedlich geregelt. Die Arbeit untersucht die Strukturprinzipien, die der Übereignung zu Grunde liegen. Dabei konzentriert sie sich auf das niederländische Sachenrecht, das einen Mittelweg zwischen den in der EU bestehenden Extremen bildet. Darüber hinaus ist in den Niederlanden umstritten, ob ein dinglicher Vertrag existiert. Im Vergleich mit dem deutschen Recht wird untersucht, ob der dingliche Vertrag außerhalb des Abstraktionsprinzips einen Mehrwert bietet und welches System insgesamt das konsistentere ist.&lt;/p&gt;

        &lt;p&gt;Wie kann eine steuerliche Maßnahme zur Förderung von privaten Forschungs- und Entwicklungsinvestitionen optimal ausgestaltet werden? Dieser Frage geht die Arbeit aus ökonomischer und rechtlicher Perspektive nach und versucht damit eine ganzheitliche Antwort zu geben. Hierzu werden zunächst die zu berücksichtigenden ökonomischen und rechtlichen Rahmenbedingungen identifiziert. Darauf aufbauend wird ein Vergleich sowie eine ökonomische und rechtliche Einordnung der in den Gewinnsteuersystemen Deutschlands, Frankreichs, der Niederlande und des Vereinigten Königreichs normierten Maßnahmen vorgenommen und daraus Ausgestaltungsempfehlungen für den Gesetzgeber abgeleitet.&lt;/p&gt;
